B.C. Reg. 269/2016 , deposited November 7, 2016, under the FARM PRACTICES PROTECTION (RIGHT TO FARM) ACT [section 12 (3) (a.1)]. Ministerial Order M446/2016, dated September 27, 2016.

I, Norm Letnick, Minister of Agriculture, order that, effective on the later of the date that

section 7 of the Fish and Seafood Act , S.B.C. 2015, c. 14, comes into force and the date that this order is deposited, the Specialty Farm Operations Regulation, B.C. Reg. 53/99, is amended by adding the following section:

Aquaculture

2.1 The following types of aquaculture are prescribed for the purpose of paragraph (

h) of the definition of “ farm operation ” in

section 1 of the Act:

(

a) aquaculture and prescribed activities within the meaning of the Pacific Aquaculture Regulations, SOR/2010-270 (Canada), if conducted

(

i) under an aquaculture licence issued under that regulation, and

(

b) the growing of aquatic plants that may be distributed to the public for human consumption, if conducted

(

i) under an aquatic plant culture licence issued under the Fish and Seafood Licensing Regulation, and

— N. LETNICK, Minister of Agriculture .
