Section 3 of the Land Titles Act,

chapter L-1.1 of the Acts of New Brunswick, 1981, is amended 1(1) L’article 3 de la

a) by repealing the definition “electronic instru- ment” and substituting the following:

Section 17.1 of the Act is amended 1(2) L’article 17.1 de la Loi est modifié (

b) the electronic instrument that is a digitally scan- ned image of the instrument is an exact and complete scan of the entire original instrument referred to in paragraph (a).

a) has not been witnessed by the subscriber, the sub- scriber is entitled to rely on the certification of the per- son as to the due execution of that instrument or the sworn affidavit of the person who was a witness to the execution of the instrument as to the due execution of that instrument, unless the subscriber has reason to be- lieve that 17.2(7) Le souscripteur qui a authentifié un instrument électronique et qui n’a pas été témoin de la passation de l’instrument visé à l’alinéa

b) the instrument was signed or witnessed by a per- son who is not the person who is purported to have signed or witnessed the instrument.

section requires that the sub- scriber or land surveyor who authenticates an electronic instrument be the subscriber or land surveyor who sub- mits the instrument for registration or filing. 17.2(8) Le présent

Section 17.5 of the Act is repealed and the fol- lowing is substituted: 1(5) L’article 17.5 de la Loi est abrogé et remplacé par ce qui suit : 17.5 The submission of an electronic instrument by a subscriber or land surveyor to a land titles office is a cer- tification by the subscriber or land surveyor that he or she is authorized to submit the instrument for registra- tion or filing. 17.5 La présentation d’un instrument électronique à un bureau d’enregistrement foncier par un souscripteur ou par un arpenteur-géomètre constitue une certification émanant de lui attestant qu’il est autorisé à le présenter pour enregistrement ou dépôt. 1(6)

Section 17.8 of the Act is amended 1(6) L’article 17.8 de la Loi est modifié (

a) in subsection (1)

a) by striking out “A member of the Law Society of New Brunswick” and substituting “A member of the Law Society of New Brunswick or a land sur- veyor”; (

Section 1 of the Registry Act,

chapter R-6 of the Revised Statutes, 1973, is amended by adding the fol- lowing

definitions in alphabetical order: 2(1) L’article 1 de la

2(4) The Act is amended by adding after
