OIC Text: The Governor in Council on the report and recommendation of the Minister of Justice and Attorney General dated March 5, 2015, and pursuant to Sections 3 and 4 of

Chapter 252 of the Revised Statutes of Nova Scotia, 1989, the Legal Aid Act , is pleased to: (

a) re-appoint Donald G. Harding, Q.C., Shelburne, Shelburne County, as a part-time Director and Chairman of the Nova Scotia Legal Aid Commission for a term of three years, commencing March 30, 2015; (

b) re-appoint George P. Ash, Halifax Regional Municipality (Dartmouth), as a part-time Director of the Nova Scotia Legal Aid Commission for a term of three years, commencing May 1, 2015; (

c) re-appoint Ronald R. Chisholm, Truro, Colchester County, as a part-time Director of the Nova Scotia Legal Aid Commission for a term of three years, commencing March 30, 2015; (

d) re-appoint Naiomi Metallic, Halifax Regional Municipality (Halifax), as a part-time Director of the Nova Scotia Legal Aid Commission for a term of three years, commencing May 1, 2015; (

e) re-appoint Trinda L. Ernst, Q.C., Coldbrook, Kings County, as a part-time Director of the Nova Scotia Legal Aid Commission for a term of three years, commencing June 22, 2015; (

f) determine that the remuneration of Donald G. Harding, Q.C., as part-time director and Chairman, shall be at the rate of $300.00 for each day of attendance at meetings of the Commission or a committee of it; (

g) determine that the remuneration of George P. Ash, Ronald R. Chisholm, Naiomi Metallic, Trinda L. Ernst, Q.C., as Directors, shall be at the rate of $150.00 for each day of attendance at meetings of the Commission or a committee of it, to a maximum of $600 for each fiscal year; (

h) determine that Donald G. Harding, Q.C., George P. Ash, Ronald R. Chisholm, Naiomi Metallic, Trinda L. Ernst, Q.C. shall be paid such actual and reasonable travelling and other expenses as may be incurred by them in the performance of their duties, payable in accordance with the travel policies and guidelines of the Province of Nova Scotia applicable to civil servants; and (

i) order that the Province shall defend, negotiate or settle claims or charges made against Donald G. Harding, Q.C., George P. Ash, Ronald R. Chisholm, Naiomi Metallic, Trinda L. Ernst, Q.C., and indemnify them from personal liability, provided that the Province is satisfied that the claim arises out of their activities in relation to their appointment and is not based on fraud or criminal activity and where the Province so defends them, the Province will be in control of the case.
