Approval of Purchaser's Protection Program

(Condominium Property Act)

Erratum

The following notice, which was published in the October 31, 2020 issue of the

Alberta Gazette, contained an error. It should have read as follows:

On August 10, 2020, the Minister of Service Alberta, Nate Glubish, approved the

Purchaser's Protection Program for The Alberta New Home Warranty Program,

revised May 6, 2020. This program will be delivered by the New Home Warranty

Insurance (Canada) Corporation and replaces the program approved for The Alberta

New Home Warranty Program on December 1, 2008.

The Condominium Property Regulation requires a notice summarizing the terms and

conditions of the program and a notice of the approval of the program by the Minister

before the program is applied in respect of any property.

A purchaser protection program must comply with

section 67 of the Condominium

Property Regulation and provide protection against a loss by a purchaser because a

developer fails to complete construction of the units or common property. Where a

developer is covered by a purchaser's protection program, the developer must provide

a certificate to the purchaser containing information specified in the Regulation about

the program and its effective dates and coverage.

The May 6, 2020 revision of The Alberta New Home Warranty Program states that it

is delivered by the New Home Warranty Insurance (Canada) Corporation. This

revised program will provide deposit protection insurance for a condominium

containing units that are attached to one or more other self-contained dwelling units in

a registered Condominium Plan. The limit of liability of the warranty provider under

the condominium deposit protection insurance policy is the lesser of fifty thousand

($50,000.00) dollars or one million five hundred thousand ($1,500,000.00) dollars,

divided by the number of new units within the Condominium Plan that have been

enrolled by New Home Warranty Insurance (Canada) Corporation. In the event of a

default, the warranty provider agrees to indemnify the Insured (the purchasers),

subject to the terms, conditions and exclusions of the policy.

Notice of Adjustment to the Minor Injury Amount

(Insurance Act)

Pursuant to the Minor Injury Regulation, the maximum amount awarded for minor

injuries is adjusted to $5,365 and is applicable to minor injuries caused in automobile

accidents occurring in Alberta on or after January 1, 2021.

The following appendix sets out the method of calculating the adjustment to the

minor injury amount.

Appendix

The maximum amount recoverable as damages for non-pecuniary losses for all minor

injuries sustained by a claimant as a result of an automobile accident, occurring

during the 2021 calendar year, is $5,365.

This amount is based on the annual change in the Alberta Consumer Price Index

(CPI), and calculated using the following formulas:

(

a) The annual change in the Alberta CPI was calculated to one-tenth of a

percentage point using the formula X = (A-B) / B where:

X is the annual change in the Alberta CPI;

A is the sum of the 12 individual monthly CPI indexes for the 12 month

period ending on September 30, 2020; and

B is the sum of the 12 individual monthly CPI indexes for the 12 month

period ending on September 30, 2019;

(

b) The result in (

a) is multiplied by the 2020 minor injury amount and rounded

to the nearest whole dollar to derive the increase in the minor injury amount

for 2021; and

(

c) The increase in (

b) is added to the 2020 minor injury amount and rounded to

the nearest whole dollar to establish the 2021 minor injury amount.

Based on the above, the annual change in the Alberta CPI, rounded to one-tenth of a

percentage point, is 0.013404 (or 1.3 per cent). The increase in the minor injury

amount for 2021 is 1.3 per cent of the 2020 minor injury amount of $5,296 rounded to

the nearest whole dollar (or $69). Accordingly, the 2021 minor injury amount is set at

$5,365.
