Definition

1 In this regulation, "Act" means The Agricultural Producers' Organization Funding Act .

Maximum annual membership fee

2 For an individual, corporation or partnership, the maximum annual membership fee of the certified organization is $275.63, plus GST.

Designated purchaser

3(1) Those persons listed in the

Schedule to this regulation are designated purchasers.

3(2) A body corporate affiliated with a person designated under subsection (1) is also a designated purchaser.

3(3) A person who acquires title to or possession of an agricultural product as a principal or as an agent on behalf of a person designated under subsection (1) or (2) is also a designated purchaser.

Percentage value

4 The percentage value of an agricultural product that must be withheld under

section 27 of the Act is 1% of the gross selling price payable by a designated purchaser for an agricultural product.

Refunds of overpayments

6 When the certified organization is required by subsection 28(2) of the Act to refund amounts withheld under

section 27 of the Act, it must do so not later than 60 days after receiving the excess amount.

Refund on request

7 When a person requests a refund under

section 29 of the Act, the certified organization must refund the person not later than 60 days after receiving an amount from the designated purchaser that is subject to the request.

Minimum amounts excepted

8 The certified organization is not required to refund any amount under

section 6 which is less than $50 prior to 90 days of the end of its fiscal year.
