B.C. Reg. 208/2017 , deposited November 14, 2017, under the PHARMACEUTICAL SERVICES ACT [section 59] and the MEDICARE PROTECTION ACT [sections 8 and 51]. Order in Council 438/2017, approved and ordered November 14, 2017.

On the recommendation of the undersigned, the Lieutenant Governor, by and with

the advice and consent of the Executive Council, orders that

(a)

section 42 (3) (

b) of the Drug Plans Regulation, B.C. Reg. 73/2015, is amended

by striking out “ any of sections 11, 13 and 14 ” and substituting “ either of sections 11 and 13 ”,

(

b) the Medical and Health Care Services Regulation, B.C. Reg. 426/97, is amended

as set out in the attached

Schedule 1, and

(

c) effective January 1, 2018, the Medical and Health Care Services Regulation

is amended as set out in the attached

Schedule 2.

Schedule 1

Section 7.6 of the Medical and Health Care Services Regulation, B.C. Reg. 426/97,

is amended in the definition of “eligible person” in paragraph (

a) by striking out “ the date on which premium assistance is first provided to him or her under

section 11, ” and substituting “ the date on which his or her grant of premium assistance first takes effect under

section 11, 13 or 14, as applicable, ”.

Section 10 is amended

(

a) in subsection (1) by striking out “ payable by a resident ” and substituting “ payable by a beneficiary ”,

(

b) by repealing subsection (1) (

a) and (

b) and substituting the following:

(

a) is a recipient of hardship assistance or income assistance under the Employment and Assistance Act ,

(a.1) is a continued person under

section 66.3 or 66.4 of the Employment and Assistance

Regulation,

(

b) is a recipient of hardship assistance or disability assistance under the Employment and Assistance for Persons with Disabilities Act ,

(b.1) is a continued person under

section 61.1 of the Employment and Assistance

for Persons with Disabilities Regulation, ,

(

c) in subsection (1) (

c) by striking out “ recipient under paragraph (

a) or (b) ” and substituting “ person described in paragraphs (

a) to (b.1) ”,

(

d) by repealing subsection (1.1) and substituting the following:

(1.1) No premiums are payable by a beneficiary for 6 months after the beneficiary

has ceased to be a person described in subsection (1) (

a) to (b.1). , and

(

e) in subsection (2) by striking out “ payable by a resident ” and substituting “ payable by a beneficiary ” and by striking out “ until the resident ” and substituting “ until the beneficiary ”.

Section 25.1 (1) (

b) is amended

(

a) in subparagraph (

i) by striking out “

section 10, 11, 12 or 13 ” and substituting “

section 11 or 13 ”, and

(

b) in subparagraph (ii) by striking out “

section 13 ” and substituting “

section 10 ”.

Section 29.1 (2) (a) (

i) is amended by striking out “ February 10, 2018 ” and substituting “ March 1, 2018 ”.

Section 47 is repealed and the following substituted:

Prescribed forms

(1) The form in

Schedule A is prescribed for the purpose of

section 8.2 (1) of the

Act.

(2) The forms in Schedules B to E are prescribed for the purpose of

section 7 (5)

of the Act and sections 7.1 and 7.4 of this regulation.

Schedule 2

Section 8 of the Medical and Health Care Services Regulation, B.C. Reg. 426/97,

is amended by striking out “ $75.00 per month ” and substituting “ $37.50 per month ”.

Section 11 is amended

(

a) in subsection (3) by striking out “ does not exceed $24 000 ” and substituting “ does not exceed $26 000 ”, and

(

b) in subsection (4) by striking out the table and substituting the following

table:
