1999 BILL Third Session, 24th Legislature, 48 Elizabeth II THE LEGISLATIVE ASSEMBLY OF ALBERTA BILL CONSTITUTIONAL REFERENDUM AMENDMENT ACT, 1999 THE MINISTER OF JUSTICE AND ATTORNEY GENERAL First Reading Second Reading Committee of the Whole Third Reading Royal Assent B ill BILL CONSTITUTIONAL REFERENDUM AMENDMENT ACT, 1999 (A ssented to , 1999) HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Alberta, enacts as follows: Amends SA cC-22.25 The C onstitutional R eferendum A ct is amended by this Act. 2 The following is added after

section 2: Referendum re “notwith- standing clause” 2 .1 (1 ) Before a Bill is introduced in the Legislative Assembly that declares that

an Act or a provision of

an Act operates notwithstanding a provision included in

section or sections to of the C anadian C harter of R ights and F reedom s, the results of a referendum conducted under this

section must have been announced by the Chief Electoral Officer.

(2) The Lieutenant Governor in Council may order the holding of a referendum that relates to a declaration that

an Act or a provision of

an Act operates notwithstanding a provision included in

section or sections to of the C anadian C harter of R ights and F reedom s. (3) This

section does not apply to a Bill or a provision of a Bill within the jurisdiction of the Legislature that relates to who may marry. 1 Explanatory Notes Amends
