An Act to Amend the Université de Moncton Act

WHEREAS the Université de Moncton prays that it be enacted as hereinafter set forth; THEREFORE, Her Majesty, by and with the advice and consent of the Legislative Assembly of New Bruns- wick, enacts as follows: 1

Section 6 of the Université de Moncton Act,

chapter 94 of the Acts of New Brunswick, 1986, is amended (

a) by repealing subsection (2) and substituting the following: 6(2) The Board of Governors, which shall have the ex- ecutive power of the University, shall consist of the fol- lowing twenty-seven members: (

a) the Chancellor, ex officio; (

b) the President and Vice-Chancellor, who is the chief executive officer of the University, ex officio; (

c) three members of the teaching staff of the Univer- sity, one from each campus, elected by the said staff of each of the three campuses of the University; PROJET DE LOI 69 Loi modifiant la

chapitre 94 des Lois du Nouveau-Brunswick de 1986, est modifié

a) par l’abrogation du paragraphe (2) et son rem- placement par ce qui suit : 6(2) Le Conseil des gouverneurs est investi des pou- voirs de direction de l’Université. Il se compose des vingt- sept membres suivants :

a) le chancelier, membre d’office;

b) le recteur et vice-chancelier, premier dirigeant de l’Université, membre d’office;

c) trois membres du personnel enseignant de l’Uni- versité, soit un membre représentant chaque consti- tuante, élu par le personnel enseignant de chacune des trois constituantes de l’Université;

d) three students of the University, one from each campus, to be elected by the student body of his cam- pus; (

e) three members, one for each of the three regions, that is the North West, the North East and the South East, to be elected by the association of alumni and friends of each of the three campuses; (

f) three members, one from each of the three regions that is a resident of the North West, the North East and the South East, to be appointed by the Lieutenant- Governor in Council; (

g) three members residing in New Brunswick, but outside the North West, the North East and the South East regions, one of whom to be appointed by the Lieutenant-Governor in Council and the other two by the Board of Governors; (

h) six members, two from each of the three regions, that is two residents of the North West, the North East and the South East, to be appointed by the Board of Governors; (

i) four members from outside New Brunswick, two of whom reside in the Atlantic area, to be appointed by the Board of Governors. (

b) by adding after subsection (3) the following: 6(3.1) The Secretary General shall attend the meetings of the Board of Governors, but without voting power. 2

Section 7 of the Act is amended (

a) by repealing subsection (1) and substituting the following: 7(1) The University shall have an Academic Senate composed of the following members: (

a) the President and Vice-Chancellor of the Univer- sity, ex officio; (

b) the Vice-President (academic), ex officio; (

c) the Dean of Studies of the Edmundston campus, ex officio;

d) trois étudiants de l’Université, soit un étudiant de chaque constituante, élu par l’ensemble des étudiants de sa constituante;

e) trois membres, soit un membre pour chacune des trois régions suivantes : le Nord-Ouest, le Nord-Est et le Sud-Est, élu par l’association des anciens et amis de chacune des trois constituantes;

f) trois membres, soit un membre pour chacune des trois régions suivantes et y résidant : le Nord-Ouest, le Nord-Est et le Sud-Est, nommés par le lieutenant- gouverneur en conseil;

g) trois membres résidant au Nouveau-Brunswick, mais à l’extérieur des régions du Nord-Ouest, du Nord- Est et du Sud-Est, dont l’un est nommé par le lieutenant-gouverneur en conseil et les deux autres par le Conseil des gouverneurs;

h) six membres, soit deux pour chacune des trois ré- gions suivantes et y résidant : le Nord-Ouest, le Nord- Est et le Sud-Est, nommés par le Conseil des gouver- neurs;

i) quatre membres de l’extérieur du Nouveau- Brunswick, dont deux résidant dans la région de l’Atlantique, nommés par le Conseil des gouverneurs.

b) par l’adjonction après le paragraphe (3) de ce qui suit : 6(3.1) Le secrétaire général assiste aux réunions du Conseil des gouverneurs, mais sans y avoir voix délibéra- tive. 2 L’article 7 de la Loi est modifié

a) par l’abrogation du paragraphe (1) et son rem- placement par ce qui suit : 7(1) L’Université a un Sénat académique composé comme suit :

a) le recteur et vice-chancelier de l’Université, mem- bre d’office;

b) le vice-recteur à l’enseignement et à la recherche, membre d’office;

c) le doyen des études de la constituante d’Edmundston, membre d’office;

d) the Dean of Studies of the Shippagan campus, ex officio; (

e) the dean of each faculty of the University, ex offi- cio; (

f) fourteen members elected by the teaching staff of the Moncton campus; (

g) four members elected by the teaching staff of the Edmundston campus; (

h) two members elected by the teaching staff of the Shippagan campus; (

i) two school directors elected by the school direc- tors collectively; (

j) the Chief Librarian, ex officio; (

k) the Director General of Extension Services, ex of- ficio; (

l) five students as follows: one graduate student and two undergraduate students to be elected by the gradu- ate students and the undergraduate students respec- tively of the Moncton campus, one student to be elected by the student body of the Edmundston campus, and one student to be elected by the student body of the Shippagan campus. (

b) by adding after subsection (2) the following: 7(3) The Secretary General shall attend the meetings of the Academic Senate, but without voting power. 3

Section 9 of the Act is amended by striking out “sec- tion 8” and substituting “subsections 8(2) and (3)”.

l) cinq étudiants, dont un étudiant de deuxième ou troisième cycle et deux étudiants de premier cycle élus respectivement par l’ensemble des étudiants de deuxième ou troisième cycle et de premier cycle de la constituante de Moncton, un étudiant élu par l’ensem- ble des étudiants de la constituante d’Edmundston et un étudiant élu par l’ensemble des étudiants de la consti- tuante de Shippagan.

b) par l’adjonction après le paragraphe (2) de ce qui suit : 7(3) Le secrétaire général assiste aux réunions du Sénat académique, mais sans y avoir voix délibérative. 3 L’article 9 de la Loi est modifié par la suppression des mots « l’article 8 » et leur remplacement par les mots « les paragraphes 8(2) et (3) ».
