LOI SUR L’ORGANISATION JUDICIAIRE RULES OF THE SUPREME COURT OF THE NORTHWEST RÈGLES DE LA COUR SUPRÊME DES TERRITOIRES DU NORD-OUEST The judges of the Supreme Court of the Northwest Territories, with the approval of the Commissioner, under subsection 60(2) of the Judicature Act and every enabling power, make the Rules of the Supreme Court of the Northwest Territories. Definitions 1.

In these rules, "action" includes any issue directed to be tried; (action) "address for service" means the street and mailing address of a residence or of an office or other place of business in the Northwest Territories; (domicile élu) "conduct money" means, subject to rule 652, the actual costs of attendance for the person to be examined, including transportation and accommodation costs, but not including a fee; (frais de déplacement) "counterclaim" means a pleading by which a defendant makes against the plaintiff or against the plaintiff and others such claim as he or she may have made by statement of claim in an independent action; (demande reconventionnelle) "Court" means the Supreme Court and includes a judge; (tribunal) "defence to counterclaim" means a pleading by which a plaintiff answers a counterclaim; (défense reconventionnelle) "deliver", in respect of a pleading, means file and serve; (remettre) "facsimile machine" means a machine or device that electronically transmits a copy of a document, picture or other printed material by means of a telecommunications system; (télécopieur) 1.

"garnishee summons" means a garnishee summons issued before judgement under rule 523 or a garnishee summons issued after judgement under rule 524; (bref de saisie-arrêt) "joinder of issue" means a pleading by which a party joins issue on the previous pleading of an opposite party other than a statement of claim, a counterclaim or a third party notice; (contestation liée) "judge" means a judge of the Supreme Court; (juge) "judgment creditor" means a party that is entitled to receive payment under or enforce a judgment or an order; (créancier judiciaire) "judgment debtor" means a party that is required to make payment under a judgment or an order or against whom a judgment or an order is enforced; (débiteur judiciaire) "liquidated demand" means (

a) a claim for a specific sum payable under an express or implied contract for the payment of a sum of money that is not in the nature of a penalty or unliquidated damages and the amount of which is fixed by the terms of the contract or can be ascertained by calculation only or on the taking of an account between the plaintiff and the defendant, or (

b) a claim for a specific sum of money, whether or not in the nature of a penalty or damages recoverable under a statute that contains an express provision that the sum sued for may be recovered as a liquidated demand or as liquidated damages; (demande d’une somme déterminée) "mandatory order" means mandamus as used in

"pleading" means a written statement delivered by a party to another party; (acte de procédure) "procedure book" includes any form of record author- ized by the Court for use by the Clerk; (registre des procédures) "Public Trustee" means the Public Trustee appointed under the Public Trustee Act; (curateur public) "receiver" includes a manager appointed by or under an order of the Court; (séquestre) "registered mail" means a prepaid delivery system effected by courier, including a post office or other person, where the courier (

a) records and documents custody of an item to be delivered, (

b) requires a recipient of the item to sign for the item as a condition of delivery, (

c) records and retains an image of the signature of the recipient to whom the item is delivered, and (

d) provides a certificate of delivery to a sender, attesting to the date and time that the courier (

i) received the item from the sender, and (ii) delivered the item to the recipient; (courrier recommandé) "reply" means a pleading by which a plaintiff answers a statement of defence; (réponse) "reply to defence to counterclaim" means a pleading by which a defendant answers a defence to counterclaim; (réponse reconventionnelle) "solicitor" means a barrister and solicitor who is an active member of the Law Society of the Northwest Territories as defined in

section 1 of the Legal Profession Act; (avocat) "statement of claim" means a pleading by which a plaintiff commences an action; (déclaration) "statement of defence" means a pleading by which a defendant answers a statement of claim; (défense) R-066-2012,s.2. demandée peut être recouvrée à

«tribunal» La Cour suprême, y compris les juges de ce tribunal. (Court) R-066-2012, art. 2. Application 2. These rules apply to actions commenced and proceedings taken in the Court. 2. Where a judge concludes that the application of a provision in these rules would be inconsistent with rule 3 or with a provision of another enactment of the Northwest Territories or of Canada, the judge may order that the provision in these rules be applied with such modifications as are necessary to achieve consistency with rule 3 or with the provision of the other enactment. Where provision for exercising a certain right is not included in these rules, the Clerk, on the advice of a judge, or the Court may specify a procedure not inconsistent with these rules or any statute that shall be adopted for exercising the right. 4. Schedule B shall be used with such modifications as the circumstances require. 6.

PART 2

PARTIE 2 AUDIENCE BEFORE THE COURT AUDIENCE DEVANT LE TRIBUNAL Representation in Court 7.

(1) A party to a proceeding who is under disability or acts in a representative capacity shall be represented by a solicitor. 7.

(2) An obligation of a solicitor with respect to any step in a proceeding also applies to a party acting in person unless expressly stated otherwise in these rules. R-066-2012,s.4.

(1) If a party acting in person or a solicitor retains a solicitor to appear before the Court for a particular or limited purpose, the solicitor so appearing must inform the Court of the nature of the appearance, either orally or by filing the pertinent terms of the retainer before the appearance. 7.2.

PART 3

PARTIE 3 FORM AND COMMENCEMENT OF CIVIL PROCEEDINGS FORME ET INTRODUCTION DES INSTANCES CIVILES Commencement Introduction Commence- ment of proceeding 8.

(1) Except as otherwise provided, an action shall be commenced by statement of claim in Form 1. 8.

(4) Where a petition is required to be served, the plaintiff shall serve it together with a copy of each affidavit in support of it 10 days before the day named for the hearing of the petition.

a) bear the date of the day on which it is issued; (

b) be numbered by the Clerk with a court file number; and (

c) show that it is issued from the office of the Court at Yellowknife or such other office as may be designated by the Court as a process issuing office. 10.

(1) Notwithstanding rule 720, an action may be commenced as follows: (

a) the solicitor may, by telephone or facsimile machine, notify the Clerk at Yellowknife of the full names of the parties to the action and the type of claim to be made and the Clerk shall record the information in the appropriate procedure book and inform the solicitor of the court file number; (

b) the solicitor shall, on the day the court file number is assigned, endorse the number on the originating document and certify, on the originating document, that it was issued by telephone or facsimile machine by the Clerk; (

c) the solicitor shall, not later than the day after the day the court file number is assigned, file with the Clerk or mail to the Clerk by registered mail the original pleading together with any fees payable. 11.

(2) When the requirements of subrule (1) are met, the day the court file number is assigned is deemed to be the day on which the originating document was issued.

(3) When the Clerk receives the original document, he or she shall compare it to the information recorded in the procedure book and, (

a) if it is in conformity with the information in the procedure book and was filed or mailed as required by subrule (1), the Clerk shall sign it and seal it with the seal of the Court; or (

b) if it does not conform to the information recorded in the procedure book or was not filed or mailed as required by subrule (1), the Clerk shall attach to the pleading a memorandum to that effect and shall without delay notify the solicitor who filed the pleading and no further step in the proceeding may be taken by the party commencing the action without leave of the Court.

(4) The Clerk may refuse to issue an originating document under this rule for a solicitor who is in default of payment of any fee or charge payable to the Clerk.

(5) A judge may at any time instruct the Clerk to refuse to issue originating documents by telephone or facsimile machine for a solicitor designated by the judge

(1) A statement of claim is in force for 12 months beginning on the date of its issue, but if for any sufficient reason a defendant has not been served, the statement of claim may, before or after its expiration, be renewed by order for six months and may, before or after the expiration of the renewed statement of claim, be further renewed from time to time as the Court may order. 13.

(3) A statement of claim renewed under this rule remains in force and may be relied on to prevent the operation of any statute limiting the time for commencement of an action and for all other purposes from the date the original statement of claim was issued.

(1) A solicitor whose name is endorsed on an originating document shall, on receipt of a written demand made by or on behalf of any person who has been served with the originating document, declare, without delay and in writing, whether the proceeding has been commenced by or with the authority of the solicitor. 14.

c) where the statement of claim is delivered by the plaintiff, a statement to that effect and the plaintiff’s address for service; (

e) the defendant’s residence in so far as it is known to the plaintiff. 16.

(1) A document required by these rules to be served need not be served personally unless personal service is expressly required by these rules or by order of the Court. 28.

b) in the case of a municipal corporation by leaving a true copy of the document at, or by sending it by registered mail addressed to, the principal office of the corporation or to the senior administrative officer of the corporation.

(1) Service of an originating document on a defendant out of the jurisdiction may be effected without order where (

a) the whole subject matter of the action is land situate in the jurisdiction (with or without rents or profits) or the perpetuation of testimony relating to lands so situate; (

b) an act, deed, will, contract, obligation or liability affecting land or hereditaments situate in the jurisdiction is sought to be construed, rectified, set aside or enforced in the action; (

c) relief is sought against a person domiciled or ordinarily resident in the jurisdiction; (

d) the proceeding is for the administration of the estate of a person who died domiciled in the jurisdiction or for any 47.

e) the proceeding is for the execution, with respect to property situate in the jurisdiction, of the trusts of a written instrument that ought to be executed according to the law of the Northwest Territories and of which the person to be served is a trustee or the proceeding is for any relief or remedy that might be obtained in such a proceeding; (

f) the proceeding is to enforce, rescind, resolve, annul or otherwise affect a contract or to recover damages or obtain any other relief in respect of a breach of contract, where (

i) the contract was made in the jurisdiction, (ii) the contract was made by or through an agent trading or residing in the jurisdiction on behalf of a principal trading or residing out of the jurisdiction, (iii) the contract, by its terms or by implication, is governed by the law of the Northwest Territories, or (iv) the parties to the contract agree that the courts of the Northwest Territories shall have jurisdiction to entertain any action in respect of the contract; (

g) the action is in respect of a breach committed in the jurisdiction of a contract made in or out of the jurisdic- tion, whether or not the breach was preceded or accompanied by a breach committed out of the jurisdiction that rendered impossible the performance of so much of the contract as ought to have been performed in the jurisdiction; (

h) the action is founded on a tort committed in the jurisdiction; (

i) in the action, an injunction is sought ordering a defendant to do or refrain from doing anything in the jurisdiction or a nuisance in the jurisdiction is sought to be prevented or removed, whether or not damages are also sought in respect of the action; (

j) a person out of the jurisdiction is a necessary or proper party to an action properly brought against some other person duly served in the jurisdiction; tribunal;

l) the action is brought by a mortgagor of property, other than land, situated in the jurisdiction, who seeks redemption of the mortgage, reconveyance of the property or delivery by the mortgagee of possession of the property and not a personal judgment; (

m) the proceeding is founded on a judgment of any court of the Northwest Territories; (

n) the proceeding is a matrimonial cause or is in respect of support for a spouse, child or other dependant or for custody of, access to or guardianship for a child; or (

(2) Where an action has been commenced in the name of the wrong person as plaintiff or where it is doubtful whether an action has been commenced in the name of the right plaintiff, the Court may order any other person to be added or substituted as plaintiff with or without terms in order to determine the real matter in dispute.

c) it appears to the Court, having regard to the circumstances including the amount of money or value of property involved and the degree of difficulty of the point to be determined, expedient to exercise the power for the purpose of saving expense, though the person or the class or the members of the class can be ascertained and found. 71.

c) communicate with all proper persons and parties, including the father, the mother and the guardian of the estate of the person who has been found incapable of managing his or her financial affairs or the minor if there is one, and the person with whom or under whose care the minor or person is. 84.Lorsque des dispositions pour la protection des droits de la personne déclarée incapable de gérer ses affaires ou du mineur sont nécessaires, le tuteur d’instance doit :

(1) Where a claim is made by or on behalf of a person under disability, no settlement or compromise, in respect of the person’s claim is binding on the person unless the settlement or compromise is approved by the Court. 88.
