AREA DEVELOPMENT ACT Pursuant to

section of the Area Development Act , the Commissioner in Executive Council orders as follows 1.

Schedule B of the Carcross General Development Area Regulation (OIC 1976/231) is amended by rezoning an area, comprising of Yukon Land, Lot 1035, Plan and Lot 209, Plan 58702, Quad 105D/02 from Institutional (I), Industrial (M), and Parkland-Greenbelt (

P) to Tourist Commercial (C-4x1)as shown on the attached Appendix. 2. The said Regulation is hereby amended by adding the following

section after paragraph 34.3(f) “34.4 In addition to the uses permitted in

section 34.2, the following special provisions apply to the C-4x1 zone: (

a) The minimum distance between any building or structure and the boundary of a Lot, Site or Parcel, is zero. (

b) The minimum lot size is ft2 (371.7 m2). (

c) The minimum lot size stipulated in paragraph 34.2(

e) does not apply to areas of land the boundaries of which are the subject of a lease agreement within the C-4x1 zone.” Dated at Whitehorse, Yukon, this September 2008. ______________________________________________________ Commissioner of Yukon

LOI SUR L’AMÉNAGEMENT RÉGIONAL Le commissaire en conseil exécutif, conformément à l’article de la

Loi sur l’aménagement régional, décrète : 1. L’annexe B du Règlement sur la région d’aménagement de Carcross (Décret 1976/231) est modifiée par le rezonage de terres du Yukon, paraissant dans l’appendice en annexe, comprenant le lot 1035, plan et le lot 209, plan 58702, quadrilatère 105D/02. La désignation de ces terres passe de I (Institutionnel), M (Industriel) et P (Parcs et ceinture de verdure) à C-4x1 (Commercial tourisme). 2. Le même règlement est modifié par l’adjonction, après l’alinéa 34.3f), de l’article suivant: « 34.4 En plus des utilisations permises à l’article 34.2, les dispositions spéciales suivantes s’appliquent à la zone C-4x1 :

a) la distance minimale entre un bâtiment ou une structure et la limite d’un lot, d’un terrain ou d’une parcelle est de zéro.

b) La surface minimale d’un lot est de pi2 (371,7 m2).
