LOI SUR LES TERRES DES TERRITOIRES DU NORD-OUEST LAND WITHDRAWAL ORDER (SOUTH SLAVE REGION) DÉCRET D’INALIÉNABILITÉ DES TERRES (RÉGION DE SOUTH SLAVE)

WHEREAS the Government of the Northwest Territories is required by the Northwest Territories Lands and Resources Devolution Agreement to substantially mirror a regulation made by the Governor General in Council, the Withdrawal from Disposal of Certain Tracts of Territorial Lands in the Northwest Territories (South Slave Region) Order, SI/2013-6, that withdraws from disposal certain tracts of territorial lands in order to facilitate the conclusion of Aboriginal land agreements; R-090-2022,s.2.

Attendu que le gouvernement des Territoires du Nord-Ouest est tenu en vertu de L’Entente sur le transfert des responsabilités liées aux terres et aux ressources des Territoires du Nord-Ouest de dupliquer en substance le règlement pris par le gouverneur général en conseil, le Décret déclarant inaliénables certaines parcelles territoriales dans les Territoires du Nord-Ouest (région de South Slave), TR/2013-6, déclarant inaliénables certaines parcelles territoriales en vue de faciliter la conclusion d’ententes relatives aux terres autochtones; R-090-2022, art. 2.

The Commissioner in Executive Council, under paragraph 19(

a) of the Northwest Territories Lands Act and every enabling power, orders as follows: le commissaire en Conseil exécutif, en vertu de l’alinéa 19a) de la

Loi sur les terres des Territoires du Nord-Ouest et de tout pouvoir habilitant, décrète : 1. Subject to sections 2 and 3, the surface and subsurface rights to the tracts of land set out in the

Schedule that are under the administration and control of the Commissioner are withdrawn from disposal. R-112-2014,s.2.

Sous réserve des articles 2 et 3, sont déclarés inaliénables les droits de surface et les droits d’exploitation du sous-sol des parcelles décrites à l’annexe dont la gestion et la maîtrise sont confiées au commissaire. R-112-2014, art. 2.

Section 1 does not apply to the disposition of substances or materials under the Quarrying Regulations. 2. L’article 1 ne s’applique pas à l’aliénation des matières ou matériaux prévue par le Règlement sur l’exploitation de carrières. EXISTING RIGHTS AND INTERESTS DROITS ET TITRES EXISTANTS 3. For greater certainty,

section 1 does not apply to (

a) the locating of a mineral claim by the holder of a prospecting permit granted before February 13, 2013; (

b) the recording of a mineral claim that is referred to in paragraph (

a) or that was located before February 13, 2013; (

c) the granting of a lease under the Mining Regulations to a person with a recorded claim, if the lease covers an area in the recorded claim; (

d) the issuance of a significant discovery licence under the Petroleum Resources Act to a holder of an exploration licence that was issued before February 13, 2013, if the significant discovery licence covers an area that is subject to the exploration licence; 3. Il est entendu que l’article 1 ne s’applique pas à ce qui suit :

a) la localisation d’un claim minier par le titulaire d’un permis de prospection délivré avant le 13 février 2013;

b) l’enregistrement d’un claim minier visé à l’alinéa a) ou localisé avant le 13 février 2013;

c) l’octroi, en vertu du Règlement sur l’exploitation minière, d’un bail au détenteur d’un claim enregistré, si le bail vise un périmètre situé à l’intérieur du claim;

d) l’octroi, en vertu de la

Loi sur les hydrocarbures, d’une attestation de découverte importante au titulaire d’un permis de prospection délivré avant le 13 février 2013, si le périmètre visé par 1

(

e) the issuance of a production licence under the Petroleum Resources Act to a holder of a significant discovery licence referred to in paragraph (d), if the production licence covers an area that is subject to the significant discovery licence; (

f) the issuance of a production licence under the Petroleum Resources Act to a holder of an exploration licence or a significant discovery licence that was issued before February 13, 2013, if the production licence covers an area that is subject to the exploration licence or the significant discovery licence; (

g) the issuance of a surface lease under the Northwest Territories Lands Act to a holder of a recorded claim under the Mining Regulations or of an interest under the Petroleum Resources Act, if the surface lease is required to allow the holder to exercise rights under the claim or interest; or (

h) the renewal of an interest. l’attestation est également visé par le permis;

g) l’octroi, en vertu de la

Loi sur les terres des Territoires du Nord-Ouest, d’un bail pour la surface au détenteur d’un claim enregistré visé par le Règlement sur l’exploitation minière ou au titulaire d’un

titre visé par la

Loi sur les hydrocarbures, si ce bail est exigé pour l’exercice des droits qui sont conférés par le claim ou par le titre;

All those parcels of land that are shown as Surface-Subsurface Lands on the following 1:250,000 reference maps held by the Lands Administration Division, Department of Lands, Government of the Northwest Territories, at Yellowknife in the Northwest Territories as of November 24, 2022: TERRITORIAL RESOURCE BASE MAPS 75F 85B 85H 2.

All those parcels of land that are shown as Surface-Subsurface Lands on the following 1:250,000 reference maps held by the Lands Administration Division, Department of Lands, Government of the Northwest Territories, at Yellowknife in the Northwest Territories as of February 24, 2022: TERRITORIAL RESOURCE BASE MAPS 75C 75D 75E 75J 75K 75L 75N 85A 85C 85G 85I 3.

All those parcels of land that are shown as Surface-Subsurface Lands on the five maps identifying certain parcels in and around the community of Fort Resolution held by the Lands Administration Division, Department of Lands, Government of the Northwest Territories, at Yellowknife in the Northwest Territories as of February 24, 2022. R-090-2022,s.4. 4

ANNEXE (article 1) 1.
