Section 23 of the Financial Administration Act, Management Board Directive #55/26 is issued as per MBM#26-010-04 as follows: AUTHORITY 1. This Directive is issued pursuant to

Section 23 of the Financial Administration Act and may only be amended with the approval of Management Board.

DEFINITIONS 2. In this Directive: a) “Minister” means the Minister of Energy, Mines and Resources or their delegate; b) “Property” means titled real property. c) “Nominal Purchase Pricer” means a purchase price of $1.

d) the “Department” means the Department of Energy, Mines and Resources e) “Due Diligence” means the investigations, reviews and assessments required to evaluate risk, liabilities and suitability of the property prior to transfer. SCOPE OF LAND TRANSACTIONS 3. This Directive applies to the transfer of Property to the Government of Yukon from municipalities and Yukon Crown Corporations for a nominal purchase price, for the following purposes:

a) residential development, including housing initiatives, and community development purposes;

b) commercial, mixed commercial residential or industrial development;

c) institutional or public use, including schools, health facilities or community infrastructure;

d) future development purposes aligned with public objectives; or

e) transportation, utilities or public works infrastructure. 4. For directives outside of these purposes, the Department will seek Management Board approval. AUTHORIZATION TO ACCEPT TRANSFER OF REAL PROPERTY 5. The Minister may enter into agreements with municipalities and Yukon Crown Corporations for the transfer of Property to the Commissioner for a nominal purchase price. 6. For clarity, the Minister may execute all documents, including contracts, required for the purpose of acquiring the Property.

a) Environmental Assessment

b) Geotechnical Assessment

c) Heritage and Archaeological Assessment

d) Title Review

e) Assessment of liabilities, chattels and encumbrances. 8. The extent and scope of due diligence shall be determined by the Department based on risk, complexity and intended use of the property.
