Definitions 1 Définitions In this Act Les définitions qui suivent s’appliquent à la présente loi. “approved form ” means a form approved by the director under subsection 93(1); « formule approuvée » “common area” means any part of residential property the use of which is shared by tenants, or by a landlord and one or more tenants; « aires communes » “deputy minister ” means the deputy of the Minister responsible for the administration of this Act; « sous- ministre » “director” means the director appointed under

section 89 and in relation to a power, duty or funct ion of the director given to an employee referred to in subsection 91(1) or delegated to a person retained under

section 92, includes that employee or person; « directeur » “fixed term tenancy” means a tenancy agreement that specifies the date on which the tenancy ends; « location à durée déterminée » “housing agency” means (

a) the Yukon Housing Corporation, or (

b) any other person or organization prescribed in « aires communes »

titre de sécurité pour toute responsabilité ou obligation du locataire à l’égard de la propriété résidentielle. La présente définition ne vise pas :

a) les chèques de loyer postdatés;

a) the owner of the rental unit, the owner’s agent or another person who, on behalf of the landlord (

i) permits occupation of the rental unit under a tenancy agreement, or (ii) exercises powers and performs duties under this Act or the tenancy agreement, (

b) the heirs, assigns, personal representatives and successors in title to a person referred to in paragraph (a), (

c) a person, other than a tenant occupying the rental unit, who (

i) is entitled to possession of the rental unit, and (ii) exercises any of the rights of a landlord under a tenancy agreement, this Act or the regulations in relation to the rental unit, and (

d) a former landlord, when the context requires this; « locateur » “mobile home ” means a structure, whether ordinarily equipped with wheels or not, that is (

a) designed, constructed or manufactured to be moved from one place to another by being towed or carried, and (

b) is used or intended to be used as living accommodation; « maison mobile » “mobile home park ” means the parcel or parcels on which the following are located (

a) one or more mobile home sites that the same landlord rents or intends to rent, and (

f) laundry facilities, (

g) storage facilities, (

h) elevators, (

i) common recreational facilities, (

j) intercom systems, (

k) garbage facilities and related services, (

l) heating facilities or services, (

m) housekeeping services, or (

(3) Every new landlord is deemed to have notice of all existing tenancy agreements in respect of which they become the landlord.

(4) For the purpose of paragraph (3)(b), a term of a tenancy agreement is “ unconscionable” if the term is oppressive or grossly unfair to one party.

(4) Both the landlord and tenant must sign the condition inspection report and the landlord must give the tenant a copy of the report within 14 days after the condition inspection is completed.

a) at the end of the tenancy, the tenant agrees in writing that the landlord may retain the amount to pay a liability or obligation of the tenant; or

(6) If a landlord does not comply with subsection (1), the landlord may not make a claim against the security deposit.

(1) If a landlord fails to comply with a material term of a tenancy agreement, the tenant may end the tenancy by giving the landlord notice to end the tenancy effective on a date that is not earlier than 14 days after the date the landlord receives the notice.
