LOI SUR LA TUTELLE HEALTH CARE REGULATIONS RÈGLEMENT SUR LES SOINS MÉDICAUX The Commissioner, on the recommendation of the Minister responsible for the Department of Health and Social Services, under subsection 64(1) of the Guardianship and Trusteeship Act , S.N.W.T. 1994, c.29 and every enabling power, makes the Health Care Regulations. The following types of health care are designated as types of health care to which a guardian may not consent, on behalf of a represented person, unless specifically authorized to do so in a guardianship order: (

a) sterilization that is not medically necessary to prevent or cure disease; (

b) non-therapeutic abortion; (

c) experimental treatment; (

d) removal of tissue from a represented person for implantation in another human being or for the purposes of medical education or medical research; (

e) psychosurgery; (

f) a procedure or therapy involving the use of aversive stimuli including non- prescription drugs for the purpose of behaviour control or behaviour change. 1. Les soins médicaux suivants sont désignés soins médicaux que le tuteur ne peut approuver au nom d’une personne représentée, à moins d’une autorisation spécifique dans l’ordonnance de tutelle :

a) la stérilisation qui n’est pas médicalement nécessaire à la prévention ou à la guérison d’une maladie;

b) l’avortement non thérapeutique;

c) les traitements expérimentaux;

d) le prélèvement de tissus sur une personne représentée pour implantation sur un autre être humain ou pour des fins d’enseignement ou de recherches médicaux;

e) la psychochirurgie;

f) tout traitement ou thérapie nécessitant un stimulus aversif, y compris les produits grand public destinés à contrôler ou à modifier le comportement. 2.
