LOI SUR LE MARIAGE MARRIAGE REGULATIONS RÈGLEMENT SUR LE MARIAGE The Commissioner, on the recommendation of the Minister, under

section 49 of the Marriage Act and every enabling power, orders as follows: Le commissaire, sur la recommandation du ministre, en vertu de l'article 49 de la

Loi sur le mariage et de tout pouvoir habilitant, décrète : 1. For the purposes of subsection 7(3) of the Act, the following eligibility criteria are prescribed: (

a) the person must be an adult; (

b) the person must be a Canadian citizen or permanent resident. 1. Aux fins du paragraphe 7(3) de la loi, la personne doit répondre aux critères d'admissibilité suivants qui sont établis :

a) être un adulte;

b) être un citoyen canadien ou un résident permanent. 2.

(1) A statutory declaration of an intention to marry referred to in subsections 14(1) and 23(1) of the Act must contain the following information: (

a) the full name of the party making the declaration; (

b) the full name of the other party to the intended marriage; (

c) the community in which the party resides; (

d) the age of the party; (

e) an affirmation of the party’s belief that there is no legal impediment to the intended marriage. 2.

(1) La déclaration solennelle de l'intention de mariage visée aux paragraphes 14(1) et 23(1) de la loi doit contenir les renseignements suivants :

a) le nom au complet du futur époux qui fait la déclaration;

b) le nom au complet de l’autre futur époux;

c) la collectivité dans laquelle le futur époux réside;

d) l’âge du futur époux;

e) l’affirmation du futur époux qu’à sa connaissance, il n’existe aucun empêchement au projet de mariage.

(2) A statutory declaration of an intention to marry, by a party unable to swear personally before an issuer or registered cleric who is to effect publication of the banns, referred to in subsections 14(2) and 23(2) of the Act must contain the following information: (

a) the full name of the party making the declaration; (

b) the full name of the other party to the intended marriage; (

c) the community in which the party resides; (

d) the age of the party; (

e) an affirmation of the party’s belief that there is no legal impediment to the intended marriage; (

f) the reason why that party is unable to appear before the issuer or registered cleric.

(2) La déclaration solennelle de l'intention de mariage, visée aux paragraphes 14(2) et 23(2) de la loi, du futur époux qui ne peut la faire en personne devant le délivreur de license ou devant l’ecclésiastique inscrit qui effectuera la publication des bans doit contenir les renseignements suivants :

a) le nom au complet du futur époux qui fait la déclaration;

b) le nom au complet de l’autre futur époux;

c) la collectivité dans laquelle le futur époux réside;

d) l’âge du futur époux;

e) l’affirmation du futur époux qu’à sa connaissance, il n’existe aucun empêchement au projet de mariage;

f) la raison pour laquelle le futur époux ne peut se présenter devant le délivreur de license ou l’ecclésiastique inscrit.

(3) A statutory declaration respecting the death of the previous spouse of a party to an intended marriage referred to in subsections 15(5) and 23(2) of the Act must contain the following information: (

a) the full name of the person making the declaration;

(3) La déclaration solennelle concernant le décès de l’ancien conjoint du futur époux, visée aux paragraphes 15(5) et 23(2) de la loi, doit contenir les renseignements suivants :

a) le nom au complet de la personne qui fait la déclaration; 1

b) the community in which the person resides; (

c) the name of the deceased spouse; (

d) the date of the death of the deceased spouse; (

e) the circumstances by which the death of the deceased spouse came to the person’s attention.

(4) A consent to the intended marriage of a minor referred to in paragraph 16(

a) and subsection 23(2) of the Act must contain the following information: (

a) the full name of the person(

s) making the consent; (

b) the community in which the person(

s) resides; (

c) the full name of the minor; (

d) the age of the minor; (

e) the relationship of the person(

s) to the minor; (

f) the full name of the other party to the intended marriage; (

g) an affirmation of consent to the intended marriage.

(4) Le consentement au mariage du futur époux qui est mineur, visé à l’alinéa 16a) et au paragraphe 23(2) de la loi, doit contenir les renseignements suivants :

a) le nom au complet de la personne ou des personnes qui donnent leur consentement;

b) la collectivité dans laquelle la personne ou les personnes habitent;

c) le nom au complet du mineur;

d) l’âge du mineur;

e) le lien de parenté ou la relation de la personne ou des personnes avec le mineur;

f) le nom au complet de l'autre futur époux;

g) l’affirmation du consentement au projet de mariage.

(5) A statutory declaration in place of consent referred to in

section 18 and subsection 23(2) of the Act must contain the following information: (

a) the full name of the party making the declaration; (

b) the community in which the party resides; (

c) an affirmation of the party having attained 18 years of age; (

d) the full name of the other party to the intended marriage; (

e) the community in which that other party resides; (

f) an affirmation of that other party having attained 19 years of age; (

g) the reason why otherwise requisite consent is not necessary.

(5) La déclaration solennelle en remplacement du consentement visée à l’article 18 et au paragraphe 23(2) de la loi doit contenir les renseignements suivants :

a) le nom au complet du futur époux qui fait la déclaration;

b) la collectivité dans laquelle le futur époux réside;

c) l’affirmation du futur époux qu’il a atteint l’âge de 18 ans;

d) le nom au complet de l'autre futur époux;

e) la collectivité dans laquelle l’autre futur époux réside;

f) l’affirmation que l’autre futur époux a atteint l'âge de 19 ans;

g) la raison pour laquelle le consentement qui serait autrement requis n’est pas nécessaire.

(6) A marriage license referred to in subsection 20(1) of the Act must contain the following information: (

a) the full name of each party to the intended marriage; (

b) the community in which each party resides; (

c) a notice that the license is subject to the absence of legal impediments to the intended marriage;

(6) La licence de mariage visée au pragraphe 20(1) de la loi doit contenir les renseignements suivants :

a) le nom au complet de chaque futur époux;

b) la collectivité dans laquelle réside chaque futur époux;

c) un avis portant que la licence est c o n d i t i o n n e l l e à l ’ a b s e n c e d’empêchements légaux au projet de mariage;

d) l’autorisation de célébrer le mariage. 2

d) an authorization to perform or solemnize the intended marriage.

(7) A certificate of the publication of banns referred to in subsection 25(2) of the Act must contain the following information: (

a) the name and address of the registered cleric who effected publication of the banns; (

b) the religious body to which that cleric belongs; (

c) an affirmation of the dates when and the location where the publication of banns took place; (

d) the full name of each party to the intended marriage; (

e) the community in which each party resides.

(7) Le certificat de publication des bans visé au paragraphe 25(2) de la loi doit contenir les renseignements suivants :

a) le nom et l’adresse de l'ecclésiastique inscrit qui a publié les bans;

b) le groupement religieux auquel appartient l'ecclésiastique;

c) l'affirmation des dates de la publication des bans et du lieu dans lequel elle a eu lieu;

d) le nom au complet de chaque futur époux;

e) la collectivité dans laquelle chaque futur époux réside. 3.

(1) A statutory declaration described in subsections 2(1) to (3) and (5) shall be signed by the person making the declaration and the person authorized to take affidavits or administer oaths before whom the declaration is made. 3.

(1) La déclaration solennelle mentionnée aux paragraphes 2(1) à (3) et (5) est signée par son auteur et par la personne autorisée à recevoir des affidavits ou à faire prêter serment devant laquelle la déclaration est faite.

(2) A consent described in subsection 2(4) shall be signed by (

a) the person or persons making the consent; and (

b) two adult witnesses to the making of the consent.

(2) Le consentement mentionné au paragraphe 2(4) est signé par :

b) deux témoins adultes du consentement.

(3) A marriage license described in subsection 2(6) shall be signed by the issuer.

(4) A certificate of the publication of banns described in subsection 2(7) shall be signed by the registered cleric who effected publication of the banns.

(5) After a marriage is performed by a marriage commissioner or solemnized by a registered cleric, the applicable marriage license shall also be signed by that commissioner or cleric.

(1) The application fee for a marriage license is $77. 4.

(2) The fee paid for a marriage license shall be distributed in the following manner: (

a) in the case of an issuer who is a member of the public service of the Northwest Territories, the issuer shall send $77 to the Registrar General;

b) in the case of an issuer who is not a member of the public service of the Northwest Territories, the issuer shall (

i) retain $38.50, and (ii) send $38.50 to the Registrar General. R-010-2025,s.2.

The fee that a marriage commissioner is entitled to receive for performing a marriage is $75. 5. Le droit auquel a droit le commissaire aux mariages pour la célébration d’un mariage est de 75 $. REPEAL ABROGATION 6.

(1) The Marriage Forms Regulations, established by regulation numbered R-050-91, are repealed. 6.

(2) The Fees Regulations, established by regulation numbered R-065-2003, are repealed.

(2) Le Règlement sur les droits payables, pris par le règlement nº R-065-2003, est abrogé. COMMENCEMENT ENTRÉE EN VIGUEUR 7.
