CITATION: This regulation may be cited as the Destruction Bay Country Residential Development Area Regulation. 1.

TITRE : Règlement sur la région d’aménagement résidentielle semi-rurale de Destruction Bay. [Amended by O.I.C. 1991/165] [Section 1 amended by O.I.C. 2016/17] 2. This regulation applies to the Destruction Bay Country Residential Development Area which is hereby declared to be all t hat area of streets and lots bounded by a thick line as shown on

Schedule 1 to this Regulation. 2. Le présent règlement s'applique à la zone résidentielle semi -rurale de Destruction Bay comprenant la zone réservée aux voies de circulation et les lots déli mités par une ligne en charactère gras à l'Annexe 1 ci-jointe. PERMITTED USES: Land, buildings and structures which are subject to the provisions of this regulation shall only be used for residential purposes and such businesses or professions that, in the opinion of a Development Officer, do not impair the residential quality of the property or the subdivision. 3.

The erection or placement of only one single family dwelling, mobile home or manufactured home, provided such a dwelling unit meets all the standards required for new construction, and has a floor area of not less than 37m2. 1. construction ou installation d’une habitation unifamiliale, d’une maison mobile ou d’une maison préfabriquée pourvu que l’unité d’habitation respecte les normes applicables aux nouvelles constructions et ait une surface de plancher d’au moins 37 m2; 2.

APPEAL: Any person who is aggrieved by a decision of a Development Officer may appeal in writing within thirty (30) days of the decision to the Zoning Appeal Board. 5. (1) In this

section 6.

(1) Les définitions suivantes s’appliquent au présent

article : “ministerial rezoning” means a ministerial rezoning as defined in the Ministerial Rezoning Regulation ; « rezonage par voie ministérielle » “zoned property” means a zoned property, as defined in the Ministerial Rezoning Regulation , to which this Regulation applies. « bien zoné » « bien zoné » S’entend au sens du Règlement portant sur le rezonage par voie ministérielle, auquel s’applique le présent règlement; “zoned property” « rezonage par voie ministérielle » S’entend au sens du Règlement portant sur le rezonage par voie ministérielle. “ministerial rezoning” [Subsection 6(1) added by O.I.C. 2013/198] [Paragraphe 6(1) ajouté par Décret 2013/198]

(2) If the Minister carries out the ministerial rezoning of a zoned property

a) the ministerial rezoning prevails, to the extent of the inconsistency, over any provision of th is Regulation with which it is inconsistent; and

b) the Minister may authorize the revision of any map, whether included in a Regulation under the Act or published elsewhere, to include the effect of the ministerial rezoning.
