PARTIE II REGULATIONS RÈGLEMENTS FILED O.I.C. 2015/164 4 August, 2015

AN ACT APPROVING YUKON LAND CLAIM FINAL AGREEMENTS

Whereas The Exchange Agreement set out as

section 1 of the attachment to this Order between the Government of Yukon and the Tr'ondëk Hwëch'in respecting the exchange of certain Crown Land and Settlement Land, was signed by the Chief on behalf of the Tr'ondëk Hwëch'in on December 4, 2012 (the "Exchange Agreement"); An Amendment Agreement Pertaining to the Tr'ondëk Hwëch'in Final Agreement is set out as

section 2 of the attachment to this Order (the "Amendment Agreement"); The amendment to the Tr'ondëk Hwëch'in Final Agreement set out in Appendix A of the attachment to this Order was consented to by the Tr'ondëk Hwëch'in by Resolution 10-27-2012-01 of its General Assembly dated October 27, 2012, in accordance with clause 2.3.5.3 of the Tr'ondëk Hwëch'in Final Agreement, (the "Amendment to the Tr'ondëk Hwëch'in Final Agreement"); The Government of Yukon has received

a) a copy of the attachment to this Order with an original signature of the Exchange Agreement by the Chief, and

b) a certified true copy of Resolution 10-27-2012-01 of the Tr'ondëk Hwëch'in General Assembly dated October 27, 2012 consenting to the Amendment to the Tr'ondëk Hwëch'in Final Agreement; and Following the entering into of the Exchange Agreement by the Premier in his capacity as Minister of the Executive Council Office and the consent to the Amendment to the Tr'ondëk Hwëch'in Final Agreement by the Government of Yukon, the Amendment to the Tr'ondëk Hwëch'in Final Agreement will take effect on the date it is consented to by the Minister of Indian Affairs and Northern Development in accordance with the Amendment Agreement; Therefore, pursuant to clause 2.3.5.2, clause 2.11.8 and clause 9.6.1 of the Tr'ondëk Hwëch'in Final Agreement and subsection 3(1) and

section 7 of

An Act Approving Yukon Land Claim Final Agreements, the Commissioner in Executive Council orders as follows 1. The Premier, in his capacity as Minister of the Executive Council Office, is authorized to enter into the Exchange Agreement on behalf of the Government of Yukon.

DÉPOSÉ DÉCRET 2015/164 4 août 2015 LOI APPROUVANT LES ENTENTES DÉFINITIVES AVEC LES PREMIÈRES NATIONS DU YUKON Attendu que : L'Entente d'échange constituant l'article 1 de l'annexe du présent décret, conclue entre le gouvernement du Yukon et les Tr'ondëk Hwëch'in et portant sur l'échange de certaines terres de la Couronne et sur certaines terres visées par le règlement, a été signée par le chef au nom des Tr'ondëk Hwëch'in le 4 décembre 2012 ( « Entente d'échange » ).

Une Entente de modification se rapportant à l'Entente définitive des Tr'ondëk Hwëch'in constitue l'article 2 de l'annexe au présent décret ( « Entente de modification » ). La modification à l'Entente définitive des Tr'ondëk Hwëch'in figurant à l'appendice A de l'annexe au présent décret a fait l'objet de l'assentiment des Tr'ondëk Hwëch'in suite à la résolution 10-27-2012-01 adoptée lors de l'assemblée générale du 27 octobre 2012, conformément à l'article 2.3.5.3 de l'Entente définitive des Tr'ondëk Hwëch'in (« Modification à l'Entente définitive des Tr'ondëk Hwëch'in » ). Le gouvernement du Yukon a reçu :

a) une copie de l'annexe au présent décret, ainsi que la signature originale du chef à l'Entente d'échange;

b) une copie certifiée conforme de la résolution 10-27-2012-01 adoptée lors de l'assemblée générale des Tr'ondëk Hwëch'in du 27 octobre 2012, donnant ainsi leur consentement à la Modification à l'Entente définitive des Tr'ondëk Hwëch'in.

Suite à la conclusion de l'Entente d'échange par le premier ministre, en sa qualité de ministre du ministère du Conseil exécutif, et le consentement du gouvernement du Yukon à la Modification à l'Entente définitive des Tr'ondëk Hwëch'in, cette dernière entre en vigueur à la date acceptée par le ministre des Affaires indiennes et du Nord canadien, conformément à l'Entente de modification.

À ces causes, conformément aux articles 2.3.5.2, 2.11.8 et 9.6.1 de l'Entente définitive des Tr'ondëk Hwëch'in et au paragraphe 3(1) et à l'article 7 de la Loi approuvant les ententes définitives avec les Premières nations du Yukon, le commissaire en conseil exécutif décrète : 1. Le premier ministre, à

titre de ministre du Conseil exécutif, est autorisé à conclure l'Entente d'échange au nom du gouvernement du Yukon. 11
