LOI SUR L’ÉDUCATION PRIVATE SCHOOL REGULATIONS RÈGLEMENT SUR LES ÉCOLES PRIVÉES The Minister, under

section 151 of the Education Act, S.N.W.T. 1995, c.28, and every enabling power, makes the Private School Regulations. Le ministre, en vertu de l’article 151 de la

Loi sur l’éducation. 2. A person who applies to the Minister to register a private school under

section 21 of the Act, shall provide to the Minister the following information: (

a) the goals and objectives of the private school; (

b) a copy of the program of education to be used in the private school, where it is different from the education program; (

c) a statement that the private school would not, in theory or in practice, promote or foster the doctrines of (

i) racial or ethnic superiority or persecution, (ii) religious intolerance or persecution, (iii) social change through violent action, or (iv) sedition; (

d) grades to be taught; (

e) projected enrolment for the private school; (

f) proposed hours of instruction for the private school; (

g) proposed opening date of the private school; (

h) proposed facilities for the private school; (

i) proposed budget for the private school; (

j) proposed governance structure for the private school; (

k) plans for staffing the private school; (

l) name and address of the applicant and a telephone number at which the applicant may be reached; (

m) a $200 application fee. 2. Quiconque demande au ministre d’enregister une école privée en vertu de l’article 21 de la Loi lui soumet les renseignements suivants :

a) l'énoncé des buts de l’école;

b) une copie du programme d’études de l’école lorsque celui-ci est différent du programme d'enseignement;

i) la supériorité ou la persécution raciale ou ethnique, ii) l'intolérance ou la persécution religieuse, iii) le changement social par le biais de la violence, iv) la sédition;

d) les niveaux scolaires qui seront enseignés;

e) une prévision du nombre d’inscriptions pour l’école;

f) les heures d’enseignement prévues pour l’école;

g) la date d’ouverture prévue de l’école;

h) les installations prévues;

i) le budget prévu;

j) la structure de gestion prévue;

k) les plans d’embauche;

l) ses nom et adresse ainsi qu'un numéro de téléphone auquel le demandeur peut être joint;

m) des droits de demande de 200 $. 3.

(1) Within 90 days of the receipt of an application made in accordance with

section 2, the Minister shall, in writing, advise the applicant (

a) whether the private school has been registered; (

b) whether further information is required and what that information is; and (

c) where the application has been refused, 3.

(2) Where the Minister registers a private school, he or she may issue directives to the person in charge of the private school concerning (

a) the enrolment of students; (

b) the qualifications of teachers; (

c) the administration of the private school; (

d) the reports required by the Minister; (

e) the funding that may be available for the private school; and (

f) any other matters concerning the operation of the private school.

(2) Lorsque le ministre enregistre une école privée, il peut donner des directives à la personne qui la dirige, relativement :

c) à la gestion de l’école;

(1) The Minister may direct a person to monitor a private school and may direct that person to report at specific times and in a specific manner. 4.

(1) Le ministre peut demander à une personne de surveiller une école privée et de lui faire rapport à des moments précis et d’une manière précise.

(2) The person directed to monitor a private school under subsection (1) may, in accordance with the directions of the Minister, delegate to a person, by contract or otherwise, the powers and duties related to the monitoring of a private school and the delegate shall prepare such reports regarding the facilities used for the private school or relating to the program of education provided by the private school as are required by the Minister.

(2) La personne à qui il est demandé de surveiller l’école privée en vertu du paragraphe (1) peut, en conformité avec les directives du ministre, déléguer, notamment par contrat, les pouvoirs et fonctions reliées à l'inspection de l'école. (3) The person in charge of a private school shall allow the person responsible under subsection (1) or (2), to monitor that private school to (

a) enter facilities used for private school activities for the purpose of conducting evaluations and inspections; (

b) inspect any records relating to the operation or administration of the private school; (

c) examine any reports relating to the achievement of the students; (

d) observe students and teachers during instruction; and (

e) obtain any information required to allow that person to interview students, parents of students and teachers.

(3) La personne qui dirige l’école privée autorise la personne responsable de la surveillance, en vertu du paragraphe (1) ou (2), à :

a) pénétrer dans les lieux afin de procéder à des évaluations et des inspections;

b) inspecter tout dossier relatif au fonctionnement ou à la gestion de l’école;

c) examiner tout rapport relativement aux résultats des élèves;

d) observer des élèves et des enseignants en classe;

e) obtenir tous les renseignements nécessaires pour lui permettre d’interroger les élèves, les parents et les enseignants.

(4) The person in charge of a private school shall cooperate with the person responsible to monitor the private school under subsection (1) or (2) and shall provide that person with any information he or she requires.

(4) La personne qui dirige une école privée coopère avec la personne chargée de la surveiller en vertu du paragraphe (1) ou (2) et lui fournit tous les renseignements qu’elle demande. 2

(1) Within a reasonable time after the completion of an evaluation or inspection of a private school, the Minister shall advise the person in charge of the private school (

a) of the result of the evaluation or inspection; (

b) of any changes that must be made to the operation of the private school; and (

c) of the time within which the changes must be made and whether the private school may continue to operate while the changes are being made. 5.

(1) Dans un délai raisonnable suivant l’évaluation ou l’inspection d’une école privée, le ministre avise la personne qui dirige l'école :

a) du résultat de l’évaluation ou de l’inspection;

b) de toute modification qui doit être apportée au fonctionnement de l’école;

c) du délai accordé pour réaliser ces modifications et de la possibilité pour l'école de continuer à fonctionner durant la réalisation de celles-ci.

(2) The Minister may direct the person in charge of the private school to report to the Minister concerning the changes to be made and may specify the time for the completion of the report.

(2) Le ministre peut ordonner à la personne qui dirige l’école privée de lui présenter, dans le délai qu'il peut fixer, un rapport relativement aux modifications à effectuer.

(3) The person in charge of a private school shall make the changes as required by the Minister under subsection (2) and shall report as specified by the Minister.

(3) La personne qui dirige l’école privée effectue les modifications exigées par le ministre en vertu du paragraphe (2) et lui fait rapport de la façon précisée par le ministre.

(4) Where the person in charge of a private school does not make the changes as required by the Minister under subsection (2), the Minister may (

a) suspend the registration of the private school until the changes have been made; or (

b) if in the opinion of the Minister it is in the best interests of the students attending the private school, cancel the registration of the private school.

(4) Si la personne qui dirige l’école privée n’effectue pas les modifications exigées par le ministre en vertu du paragraphe (2), le ministre peut :

a) soit suspendre l’enregistrement de l’école jusqu’à ce que les modifications aient été effectuées;

b) soit annuler l’enregistrement de l’école, s’il est d’avis qu’il en est du meilleur intérêt des élèves.

(5) Where the person in charge of a private school continues to operate the private school where the registration of the private school has been suspended, the Minister may, if in the opinion of the Minister it is in the best interests of the students attending the private school, cancel the registration of the private school.

(5) Si la personne qui dirige l’école privée en poursuit le fonctionnement alors que son enregistrement est suspendu, le ministre peut, s’il est d’avis qu’il en est du meilleur intérêt des élèves, annuler l’enregistrement de l’école.

(6) Where the Minister cancels the registration of a private school under paragraph (4)(

b) or subsection (5), the Minister shall give notice of the cancellation of the registration of the private school to (

a) the District Education Authority within whose area of jurisdiction the private school operated; and (

b) the students and parents of the students who attended the private school.
