AN ACT TO AMEND THE EMPLOYMENT STANDARDS ACT (Assented to May 9, 2001) The Commissioner of the Yukon Territory, by and with the advice and consent of the Legislative Assembly, enacts as follows: 1 This Act amends the Employment Standards Act. 2 Subsection 37.1(1) of the Act is amended by repealing the expression "12 weeks" and substituting the expression "37 weeks" for it. 3 Paragraph 37.1(6)(

b) of the Act is amended by repealing the expression "12 weeks" and substituting the expression "37 weeks" for it. 4 This Act shall be deemed to have come into force on December 31, 2000. LOI MODIFIANT LA

Whereas it appears by message from the Commissioner and in the estimates accompanying the message that the sums mentioned in

Schedule A of this Act are required for the purpose of defraying certain expenses of the public service of the Yukon and for related purposes for the period of 12 months ending March 31, 2002; The Commissioner of the Yukon Territory, by and with the advice and consent of the Legislative Assembly, enacts as follows: 1 From and out of the Yukon Consolidated Revenue Fund there may be paid and applied a sum not exceeding in the whole $540,600,000, for defraying the several charges and expenses of the public service of the Yukon payable in the period of 12 months ending on March 31, 2002, as set forth in

Schedule A of this Act and which includes all sums previously appropriated for any part of the same period, and that sum shall not be paid or applied except in accordance with Schedules A, B and C, the Financial Administration Act and, subject to that Act, the estimates accompanying the message from the Commissioner. 2 Not included in the sum of $540,600,000 referred to in

section 1 is the sum of $510,000 representing the foregone income from non- interest bearing compensating balances held on deposit with the government's banker for purposes of paying for the banking services provided to the government by the bank.

LOI D'AFFECTATION N°l POUR L'EXERCICE 2001-2002 (sanctionnée le 9 mai 2001) Considérant qu'il appert du message du commissaire et du budget de dépenses qui l'accompagne que les sommes à l'annexe A de la présente loi sont requises pour couvrir certaines dépenses de la fonction publique du Yukon, et pour d'autres fins s'y rattachant, durant la période de douze mois se terminant le 31 mars 2002, le commissaire du territoire du Yukon, sur l'avis et avec le consentement de l'Assemblée législative, décrète ce qui suit : 1 Peut être prélevée sur le Trésor du Yukon et payée ou affectée pour subvenir aux diverses dépenses et frais de la fonction publique du Yukon exigibles durant la période de douze mois se terminant le 31 mars 2002 et inscrits à l'annexe A de la présente loi, une somme n'excédant pas un total de 540 600 000 $, lequel total inclut toutes les sommes affectées pour toute

partie de cette même période. Cette somme ne doit être payée ou affectée qu'en conformité avec les annexes A, B et C, la

SCHEDULE C YUKON LEGISLATIVE ASSEMBLY The Yukon Legislative Assembly is the parliament of the Yukon, consisting of Members who are elected by the people of the Yukon. Through them Yukon people make territorial laws and provide money needed by the Government of the Yukon for the present and future good of the people of the Territory. OFFICE OF THE OMBUDSMAN To enhance public confidence and promote fairness and integrity in public administration of Yukon. ELECTIONS OFFICE To manage and conduct elections of members of the Legislative Assembly and school- governing groups.

To provide administrative support for electoral district boundaries commissions. DEPARTMENTAL OBJECTIVES EXECUTIVE COUNCIL OFFICE To conclude, as the Government's top priority, outstanding land claims and self-government agreements with Yukon First Nations. To ensure effective implementation of land claim agreements in areas of Yukon responsibility. To build strong "government-to-government" relationships between the Yukon and Yukon First Nation governments.

ANNEXE C ASSEMBLÉE LÉGISLATIVE DU YUKON L'Assemblée législative du Yukon est le parlement du Yukon où siègent les députés élus par la population du Yukon. Par l'intermédiaire des députés, les gens du Yukon décident des lois territoriales et versent les sommes nécessaires au gouvernement du Yukon pour assurer le bien- être des gens du territoire. BUREAU DE L'OMBUDSMAN Il tend à accroître la confiance chez le public et à promouvoir l'impartialité et l'intégrité de l'administration publique du Yukon.

BUREAU DES ÉLECTIONS Il dirige et gère les opérations électorales pour l'élection des députés à l'Assemblée législative et des représentants auprès des organismes scolaires. Il assure des services de soutien administratif aux commissions de délimitation des circonscriptions électorales. OBJECTIFS POURSUIVIS PAR LES MINISTÈRES MINISTÈRE DU CONSEIL EXÉCUTIF Il voit à conclure, à

titre prioritaire, les accords en matière de revendication territoriale et d'autodétermination avec les Premières nations du Yukon. Il s'assure de la mise en œuvre des accords en matière de revendication territoriale dans les domaines qui sont de la compétence du Yukon. To advance the constitutional status of the Yukon through legislative amendments and transfer of provincal-type programs from Canada to the Yukon. To negotiate, pursuant to land claims agreements, implementation of the Yukon's portion of . the Development Assessment Process.

To facilitate the Cabinet decision-making process by providing advice, analysis and other services to Cabinet and its committees and by coordinating policy development and other projects of an interdepartmental nature. To ensure effective communications with the Yukon public. To coordinate corporate management issues, strategies and priority setting through provision of corporate programs. To foster the maintenance, revitalization and protection of Yukon aboriginal languages and support Yukon aboriginal communities in their related activities.

To work with program departments to review and redesign programs to improve performance and accountability. To provide management audit services to government. To provide statistical information to government to support its decision-making capacity. Il coordonne les questions de gestion corporative, de priorisation et de stratégie par l'établissement de programmes corporatifs.

I) encourage le maintien, la revitalisation et la protection des langues autochtones au Yukon et donne son appui aux initiatives des communautés autochtones dans ces domaines. Il travaille de concert avec les ministères afin de revoir et d'adapter les programmes dans le but d'améliorer le rendement et l'imputabilité. CHAPITRE 2 LOI D'AFFECTATION N°1 POUR L'EXERCICE 2001-2002 DEPARTMENT OF COMMUNITY AND TRANSPORTATION SERVICES To promote local government, to provide support to municipalities, to provide municipal services and facilities in unincorporated communities and to participate in the efficient implementation of land claim settlements. To plan, develop, maintain and regulate safe and efficient transportation systems and services for the Yukon. To provide property assessment and general property taxation services. To plan, develop and dispose of public lands and to manage land use activity.

To support the development of Yukon people and communities through sport, recreation and active living. To provide, operate, and maintain community radio/television transmitters and the multidepartmental mobile radio system; and to participate in related policy developments. To develop transportation, Connect Yukon, telecommunication and community infrastructure to improve the quality of life for all Yukoners. To promote the improvement and cost- effectiveness of infrastructure through undertaking applied research into northern infrastructure development.

To support, administer and enforce building, electrical and mechanical safety standards, MINISTÈRE DES SERVICES AUX AGGLOMÉRATIONS ET DU TRANSPORT Il fait connaître les administration locales; il vient en aide aux municipalités et assure l'approvisionnement de services et d'aménagements municipaux dans les communautés non constituées et il participe à la mise en œuvre du règlement des revendications territoriales.

a) an individual who is resident in the Yukon on the last day of the year, or (

b) a corporation that maintains a permanent establishment in the Yukon at any time in the year, other than a corporation (

i) that is exempt from tax payable under this Act by reason of

section 7; « contribuable admissible » 'eligible expenditure' incurred by an eligible taxpayer in a taxation year means a qualified expenditure (within the meaning assigned by subsection 127(9) of the Federal Act) incurred by the taxpayer in the year and after December 31, 2000 in respect of scientific research and experimental development carried on in the Yukon; « dépense admissible » 'R&D tax credit' of an eligible taxpayer for a taxation year means the aggregate of (a) 15% of the aggregate of all amounts each of which is an amount that would be an eligible expenditure incurred by the eligible taxpayer in the year if any amount deemed by subsection (2) to have been paid on account of the eligible taxpayer's tax payable under this Act for any taxation year were not assistance for purposes of the Federal Act, (b) 5% of the aggregate of all amounts each of which is an amount that is included in the aggregate determined under paragraph (

a) in respect of the eligible taxpayer for the year and that is an amount paid or payable by the eligible taxpayer to the Yukon College, and (

(2) Where, within 12 months after the eligible taxpayer's filing-due date for the particular year, an eligible taxpayer for the year claims an amount under this subsection for the year by filing, with the eligible taxpayer's return of income under this Act for the year, a prescribed form containing prescribed information with the Minister, the eligible taxpayer shall be deemed to have paid an amount, on account of the eligible taxpayer's tax payable under this Act for the year, equal to the eligible taxpayer's R&D tax credit for the year.

(3) The amount deemed by subsection (2) to have been paid on account of an eligible taxpayer's tax payable under this Act for a taxation year is deemed to have been so paid, an to have been received by the Minister, on the eligible taxpayer's balance- due day for he year.

(4) Where an eligible taxpayer for a particular taxation year is a beneficiary under a trust in the trust's taxation year that ends in the particular year, the amount that would, if the trust were an eligible taxpayer, be the trust's R&D tax credit for that taxation year of the trust shall be added in computing the eligible taxpayer's R&D tax credit for the particular year, to the extent of the portion of that amount that may, having regard to all the circumstances including the terms and conditions of the trust, reasonably be considered to be the eligible taxpayer's share of that amount.

(5) Where an eligible taxpayer for a particular taxation year is a member of a partnership in its fiscal period that ends in

partie du montant, en tenant compte de toutes les circonstances, y compris les conditions de la fiducie, qu'il peut être raisonnable de considérer comme étant la part du contribuable admissible.

(2) Section 5.4 of the Act, as enacted by subsection (1), applies to the 2001 and subsequent taxation years. 4(1) Paragraphs 15(l)(

a) and (

b) are amended by repealing the expression "deemed by subsection 9.1(1)" and substituting for it the expression "deemed by subsection 5.4(1) or 9.1(1)".

(2) The amendment made by subsection (1) applies to the 2001 and subsequent taxation years. 5(1) Subparagraph 25(2)(a)(iv) of the Act is repealed and the following subparagraph is substituted for it "(iv) an amount deemed by subsection 5.4(2) or 9.1(1) to have been paid on account of the individual's tax payable under this Act for a taxation year,"

Whereas it appears by message from the Commissioner and in the estimates accompanying the message that the sums mentioned in

Schedule A of this Act are required for the purpose of defraying certain expenses of the public service of the Yukon and for related purposes for the period from April 1, 2001 to May 31, 2001; The Commissioner of the Yukon Territory, by and with the advice and consent of the Legislative Assembly, enacts as follows: 1 From and out of the Yukon Consolidated Revenue Fund there may be paid and applied a sum not exceeding in the whole $229,593,000 for defraying the several charges and expenses of the public service of the Yukon payable in the period from April 1, 2001 to May 31, 2001, as set forth in

Schedule A of this Act, and that sum shall not be paid or applied except in accordance with Schedules A and B, the Financial Administration Act and, subject to that Act, the estimates accompanying the message from the Commissioner. 2 The due application of all monies paid or applied pursuant to

section 1 shall be accounted for.

LOI SUR LA COUR TERRITORIALE (Assented to May 09, 2001) The Commissioner of the Yukon Territory, by and with the advice and consent of the Legislative Assembly, enacts as follows: 1 This Act amends the Territorial Court Act. 2

Section 1 of the Act is amended by repealing the expression "full-time" in the definition of "deputy judge" and substituting the expression "permanent" for it. 3

Section 11 of the Act is amended by adding the following subsection immediately after subsection (4) "

(5) Notwithstanding subsection (4), a judge holding office on the coming into force of this Act ceases to hold office on attaining the age specified by law in effect on the date of his or her appointment." 4

Section 13 of the Act is amended by repealing the expressions "year 2003" and "fifth year" and by substituting the expressions "year 2001" and "third year" for them. 5

Section 21 of the Act is amended by adding the expression "Subject to

section is added immediately after

section 21 of the Act "21.1 For the purposes of the commission to be held in the year 2001, (

a) the expression "July 1" shall be substituted for the expression "February 1" in paragraph 21(

b) of the Act; (

b) the expression "August 1" shall be substituted for the expression "March 1" in paragraph 21(

c) of the Act; and (

c) the expression "September 1" shall be substituted for the expression "April 1" in paragraph 21(

d) of the Act." 7 Subsections 26(4) and (5) of the Act are repealed and the following subsections are substituted for them "

(4) The commission may identify those representatives of the court participating in an inquiry of the commission to whom costs shall be paid in accordance with subsections (5) to (7).

(5) A representative of the court identified under subsection (4) who participates in an inquiry of the commission is entitled to be paid, out of the consolidated revenue fund, 65% of the costs determined under subsection (6).

(6) A registrar of the Supreme Court shall determine the amount of costs, on a solicitor-and-client basis, as if the assessment of costs were an assessment of costs under Subrule 57(29) of the Rules of Court, with any modifications that the circumstances require. (7) Subsections (4) to (6) apply to costs incurred in relation to participation in any inquiry of the commission conducted after January 1, 2001.

Definitions 1 In this Act, "active member" means a member who is a judge at the relevant time; « participant actif » "actuarial equivalent" means a benefit of equivalent value when computed on the basis of interest and mortality rates adopted by the public service commissioner for this purpose on the advice of an actuary; « équivalent actuariel » "actuary" means a Fellow of the Canadian Institute of Actuaries; « actuaire » "beneficiary" means the person last designated by a member to receive any benefit payable in the event of the death of the member.

(3) A judge who makes an election under subsection (1) shall be deemed to have never been a member of the plan, and the Act shall be considered to have never applied to the judge. Integration with PSSA and SRAA 3 Judges are members of the pension plan under the PSSA and of the retirement compensation arrangement under the SRAA. The benefits provided under this plan are supplemental to benefits provided under the PSSA and the SRAA. Funding 4(1) Every amount payable under the plan and all expenses incurred in the administration of the plan shall be a charge upon and be paid out of the Yukon Consolidated Revenue Fund as they fall due.

(2) No contributions shall be made to the plan, and no fund shall be maintained for this plan. Pension commencement dates 5(1) An active or former member who has completed two years of credited service may elect to commence receiving an immediate unreduced pension on the first day of any month after he or she has terminated service as a judge and has attained the age of 60 years or has completed 20 years of continuous service. For the purposes of this Act, the date so elected shall be the member's normal pension commencement date.

(2) An active member or former member who has completed two years of credited service but who has not completed 20 years of continuous service and has not attained age 60 may elect to begin receiving an immediate pension on the first day of any month after he or she has terminated service as a judge and has attained the age of 50 years. For the purposes of

(3) An active member who continues to serve as a judge beyond the earliest date that could have been his or her normal pension commencement date had he or she terminated service as a judge may elect to begin receiving his or her pension on the first day of any month after the above date, but no later than the day on which the member begins receiving a pension under the PSSA. This date shall be the member's postponed pension commencement date.

(4) The dates set out in subsections (1), (2) and (3) above are for the purposes of benefit calculations as required to suit the case. A member's actual date of pension commencement under this Act may not precede his or her actual date of pension commencement under the PSSA and, unless otherwise stated, the member's date of pension commencement under the plan shall be the member's . date of • pension commencement under the PSSA.

Benefit on normal pension commencement 6 The annual amount of pension payable to a member on his or her normal pension commencement date or postponed pension commencement date shall equal (a) 3% of best average earnings multiplied by credited service, subject to a maximum of 70% of best average earnings; minus (

a) calculated at the member's early pension commencement date and based on his or her credited service and best average earnings at this early pension commencement date with payments reduced so that the member's pension benefit is actuarially equivalent to the pension benefit he or she would have received had the payments commenced on the earlier of (

a) the first day of the month after the member would have attained the age of 60, or; (

b) the first day of the month after the member would have completed 20 years of continuous service.

Payment of pensions 8(1) The normal form of pension benefit payable to a member who has begun receiving a pension and who has a spouse on the date that the member begins receiving a pension under this plan will be a monthly pension, calculated before any offset for benefits payable under the PSSA and SRAA, payable during the lifetime of the member on the last day of each month commencing in the month in which the member elects to begin his or her pension under this Act.

If on the member's death, the individual who was the member's spouse on the date the member began receiving a pension under the Act remains alive, 60% of the

LOI SUR LE RÉGIME DE PENSION DES IUGES DE LA COUR TERRITORIALE member's pension, calculated before any offset for benefits payable under the PSSA and SRAA, will continue to be paid to the spouse throughout the spouse's remaining lifetime. If on the member's death, there are two individuals meeting the definition of the member's spouse on the date of the member's death, the pension payable under this subsection to a spouse will be divided between the two individuals in the same proportions as similar benefits under the PSSA and SRAA as a consequence of the member's death are divided between the same two individuals.

(2) Where a member who has commenced receiving a pension does not have a spouse on the date that the member began receiving a pension under this plan, the normal form of benefit payable will be a monthly pension, calculated before any offset for benefits payable under the PSSA and SRAA, during the lifetime of the member on the last day of each month commencing in the month in which the member elects to begin his or her pension under this Act.

Should the member die after commencement of pension payments but before 60 monthly payments have been made, the payments will be continued to the member's beneficiary until 60 monthly payments have been made. The member's beneficiary may request in writing that the remaining payments be paid in a lump sum that is actuarially equivalent to the remaining pension payments.

(3) The annual amount of the normal form of pension payable under subsection (2) shall equal the actuarial increase factor of 1.12 multiplied by the annual pension otherwise payable in accordance with subsection (1).

(4) Pension benefits payable to the member, the member's surviving spouse or beneficiary under this plan according to subsection (1) or 60 % du montant de la pension du participant, calculée avant toute déduction du montant de celle-ci pour les prestations versées en vertu de la LPFP et de la LRRP, continuera à être versé au conjoint durant la vie de ce dernier.

Le bénéficiaire du participant peut alors demander par écrit que les versements restants soient faits sous forme d'un montant forfaitaire qui sera l'équivalent actuariel des versements de prestations de pension restant à échoir.

(3) Le montant annuel de la prestation payable en vertu du paragraphe (2) est égal au produit du facteur de hausse actuarielle de 1,12 multiplié par la pension annuelle payable en vertu du paragraphe (1).

LOI SUR LE RÉGIME DE PENSION DES JUGES DE LA COUR TERRITORIALE (2) shall be reduced by the actual benefits payable under the PSSA and SRAA in respect of the same period of credited service as under this plan, excluding actual benefits payable under

Part II of the PSSA (Supplementary Death Benefit plan) and actual benefits payable to each child of the member, if applicable.

(5) Elections or waivers made by or in respect of a member which affect entitlements of a spouse under the PSSA shall be considered to apply in the same manner and subject to the same terms and conditions to the spouse's entitlements under subsections (1) and (2). Indexation 9(1) Pensions payable under the plan to members, surviving spouses and beneficiaries in the course of payment shall be adjusted on January 1 of each year.

(2) A former member who is entitled to a deferred pension under this plan which has not begun to be paid, shall have the amount of the deferred pension adjusted on January 1 of each year between the date the person ceases to be an active member and the date payment of the pension begins.

(3) Subject to subsections (4) and (5), the adjustment in subsections (1) and (2) on January 1 of each year shall equal the percentage increase in the average annual consumer price index for Canada for the twelve consecutive months ending with September of the previous calendar year.

(4) If the pension in respect of which an adjustment is to be made in accordance with subsection 9(1) has been in payment for less than 12 months, the percentage adjustment présent régime et du paragraphe (1) ou (2) est réduit par le montant réel des prestations payable en vertu de la LPFP et de la LRRP pour la même période de service validé que celle déterminée en application du présent régime, exclusion faite des prestations à être versées en vertu de la

(3) Sous réserve des paragraphes (4) et (5), les ajustements annuels du 1" janvier visés aux paragraphes (1) et (2) égalent l'augmentation en pourcentage de l'indice canadien des prix à la consommation pour les douze mois consécutifs se terminant en septembre de l'année précédente.

(5) On the first January 1 after a former member described in subsection (2) terminates service as a judge, the percentage adjustment shall be multiplied by the fraction N/l2 where N is the number of months "between the date of termination of service and January 1. Termination benefit 10(1) A member who terminates service as a judge other than by death and who has not completed two years of credited service shall not receive a benefit from the plan.

(2) A member who terminates service as a judge other than by death and who has completed two years or more of credited service prior to his or her termination of service but who has not attained age 50 shall be entitled to receive either (

a) a deferred pension commencing on the earlier of the first day of the month after the member has attained age 60, or the first day of the month after the member would have attained 20 years of service, calculated in accordance with paragraph 6(

a) based on his or her credited service and best average earnings at the date of termination of service; or (

b) a lump sum payment actuarially equivalent to the value of the deferred pension calculated in accordance with paragraph 10(2)(a), whereupon he or she shall have no further rights or entitlements under the plan and shall cease to be a member of the plan. les ajustements en pourcentage sont multipliés par la fraction N/,2où « N » représente le nombre de mois où il y a eu des versements.

a) une pension différée dont le premier versement se fait à la première des dates suivantes, soit le premier jour du mois suivant celui où il atteint l'âge de 60 ans, soit le premier jour du mois suivant la date à laquelle il aurait complété 20 ans de service, étant le produit de 3 % de son salaire maximal moyen multiplié par la durée de service validé jusqu'à concurrence de 70 % de son salaire maximal moyen;

(3) The termination benefit payable under subsection (2) shall be reduced by the actual benefits payable under the PSSA and SRAA in respect of the same period of credited service as under this plan.

(4) Former members are required to select the same option in respect of their termination benefit payable under (2) above as they select for their termination benefits under the SRAA. Disability benefit 11(1) A member who is totally disabled shall be entitled to an immediate pension calculated in accordance with paragraph 6(

a) based on his or her best average earnings and credited service at the date the member is considered to have been disabled for the purposes of the PSSA.

(2) Disability benefits payable under subsection (1) shall be reduced by the actual disability benefits payable under the PSSA and SRAA in respect of the same periods of credited service as under this plan. Death benefit 12(1) Where a member who has not completed two years of credited service dies before pension commencement, no benefit shall be payable from the plan in respect of the member.

(2) Where a member who has completed two years or more of credited service dies before pension commencement and has a spouse on his or her date of death, the spouse shall be entitled to receive a pension payable for his or her lifetime provided that if there are two individuals meeting the definition of the member's spouse on the date of the member's death, the pension payable under this

Part II of the PSSA (Supplementary Death Benefit Plan) and actual benefits payable to each child of the member.

(5) Elections made by or in respect of a member which affect the entitlements of a spouse under the PSSA shall be considered to apply in the same manner and subject to the same terms and conditions as the spouse's entitlements under subsections (2) and (3).
