LOI SUR LES QUESTIONS TOUCHANT L’ACCORD DE PERCEPTION DE L’IMPÔT SUR LE REVENU Reference to Court of Appeal 1.

(1) The Commissioner may refer to the Court of Appeal for hearing and consideration any matter that relates to questions arising out of the collection agreement between the Government of Canada and the Government of the Northwest Territories entered into under the Income Tax Act. 1.

(1) Le commissaire peut référer à la Cour d’appel pour audition et examen toute affaire qui porte sur des questions découlant de l’accord de perception conclu entre le gouvernement du Canada et celui des Territoires du Nord-Ouest sous le régime de la Loi de l’impôt sur le revenu. (2) The Attorney General of Canada and the Attorney General of any province or territory that has entered into an agreement with the Government of Canada respecting the collection of income tax in that province or territory may appear before the Court of Appeal and be heard as a party in respect of any matter referred under this Act. S.N.W.T. 2002,c.20, s.5.

(2) Le procureur général du Canada et le procureur général d’une province ou d’un territoire qui a conclu avec le gouvernement du Canada un accord concernant la perception de l’impôt sur le revenu dans cette province ou ce territoire peuvent comparaître devant la Cour d’appel et être entendus en qualité de parties relativement à toute question référée en conformité avec la présente loi. The Court of Appeal shall certify to the Commissioner its opinion on the matter referred and the reasons for its opinion, which shall be given in the same manner as in the case of a judgment in an ordinary action, and a judge who differs from the opinion of the majority may in the same manner certify his or her opinion and the reasons for the opinion. 2. La Cour d’appel communique au commissaire son opinion motivée sur la question qui lui a été référée. Cette opinion est donnée de la même manière que dans le cas d’un arrêt rendu dans une action ordinaire.

a) any person interested, or (

b) where there is a class of persons interested, any one or more persons as representatives of that class, shall be notified of the hearing, and those persons shall be entitled to be heard. 3. La Cour d’appel peut ordonner que soient avisés de l’audition et aient le droit d’être entendus :

The opinion of the Court of Appeal shall be deemed to be a judgment of the Court of Appeal and an appeal lies from the opinion as in the case of a judgment in an action. 4. L’opinion de la Cour d’appel est réputée un jugement de la Cour d’appel dont il peut être interjeté appel tout comme s’il s’agissait d’un jugement rendu dans une action.
