LOI SUR L’ASSURANCE-MALADIE MEDICAL CARE REGULATIONS RÈGLEMENT SUR LES SOINS MÉDICAUX The Commissioner, on the recommendation of the Minister, under

section of the Medical Care Act and every enabling power, makes the Medical Care Regulations. Le commissaire, sur la recommandation du ministre, en vertu de l’article de la

Loi sur l’assurance-maladie et de tout pouvoir habilitant, prend le Règlement sur les soins médicaux. 1. In these regulations, "tariff", in respect of a claim for benefits payable in respect of insured services, means a tariff that has, under

section 3.1 of the Act, been approved as having effect at the time the services were rendered. 1. Dans le présent règlement, «tarif» s’entend, dans le cas d’une réclamation de prestations payables à l’égard des services assurés, du tarif autorisé à être en vigueur, en application de l’article 3.1 de la Loi, au moment où les services ont été rendus. 2. The Director shall designate a medical practitioner as a medical adviser to review and make recommendations (

a) in respect of the amounts that should be allowed on claims for benefits; and (

b) in respect of such other professional matters as may be referred to him or her by the Director.

titre de conseiller médical afin que celui-ci examine les questions suivantes et formule des recommandations relativement à celles-ci :

a) les montants qui devraient être alloués à l’égard de réclamations de prestations;

(1) A medical practitioner may, within six months after rendering insured services, submit to the Director a claim for benefits in respect of those services. 3.

(1) Un médecin peut, dans les six mois après avoir rendu des services assurés, présenter au directeur une réclamation de prestations à l’égard de ces services.

(2) If a medical practitioner fails to submit a claim for benefits within the six-month period referred to in subsection (1), no benefits are payable in respect of the services rendered and no person is liable for any payment to the medical practitioner in respect of the services rendered.

(2) Si un médecin omet de présenter sa réclamation de prestations dans le délai de six mois mentionné au paragraphe (1), aucune prestation n’est payable à l’égard des services rendus et nul n’est tenu d’effectuer quelque paiement que ce soit au médecin à l’égard des services rendus.

(3) Notwithstanding subsection (2), the Director may, if he or she considers it proper, authorize the payment of benefits in respect of a claim submitted after the expiration of the six-month period referred to in subsection (1).

(3) Malgré le paragraphe (2), le directeur peut autoriser le paiement de prestations relatives à une réclamation faite après le délai de six mois mentionné au paragraphe (1) s’il considère ce paiement justifié. 4. Every claim for benefits must be made in the form established by the Director for that purpose and must include the following information: (

a) the name of the medical practitioner making the claim and the billing number assigned to the medical practitioner by the Director; (

b) the name, health care plan registration number and address of the patient who received the insured services; (

c) a diagnosis and an applicable diagnostic 4. Les réclamations de prestations sont présentées en la forme établie à cet effet par le directeur et comprennent les renseignements suivants :

a) le nom du médecin qui présente la réclamation et le numéro de facturation attribué par le directeur au médecin;

b) le nom, le numéro d’assurance-maladie et l’adresse du patient ayant reçu les services assurés;

c) un diagnostic et un code diagnostique qui s’y applique; 2 code; (

d) the benefit code number indicated in the tariff and, except in the case of a claim for benefits payable by assessment, the corresponding amount claimed; (

e) the signature of the medical practitioner who rendered the insured services; (

f) if applicable, the name of the referring medical practitioner or the medical practitioner to whom the patient was referred; (

g) if applicable, an indication whether there may be third party liability arising from an automobile accident or other cause related to the services; (

h) such other information as the Director may require.

h) tout autre renseignement exigé par le directeur. 5. If a benefit is itemized in the tariff as being payable by assessment, the amount of the benefit that is payable shall be such amount as is assessed by the Director to be fair and equitable in the circumstances of the case. 5. Si une prestation est énumérée au tarif comme une prestation payable suite à une évaluation, le montant de la prestation payable est celui que le directeur déclare être juste et équitable dans les circonstances. 6.

A claim for a procedure that is not listed in the tariff shall be assessed by the Director upon submission and receipt of as much clinical description as is, in the opinion of the Director, practicable under the circumstances. 6. Toute réclamation relative à une intervention n’apparaissant pas au tarif est évaluée par le directeur suite au dépôt et à la réception d’une description clinique qui est, de l’avis de ce dernier, aussi complète que possible dans les circonstances. 7.

No payment for insured services may be made to a person on behalf of a medical practitioner under subparagraph 5(c)(ii) of the Act unless the medical practitioner has authorized the Director, in a form acceptable to the Director, to make such a payment. 7. Les paiements relatifs aux services assurés ne sont versés par le directeur à un tiers pour le compte du médecin, en conformité avec le sous-alinéa 5c)(ii) de la Loi, qu’à condition que ce médecin ait autorisé le directeur, d’une manière convenant à ce dernier, à effectuer un tel paiement. 8.

These regulations come into force on the later of May 1, 2006 and the day on which they are registered under the Statutory Instruments Act. 9.
