CHAPITRE 1

AN ACT TO AMEND THE ASSESSMENT AND TAXATION ACT (Assented to April 29, 1999) The Commissioner of the Yukon Territory, by and with the advice and consent of the Legislative Assembly, enacts as follows: 1. This Act amends the Assessment and Taxation Act. 2. The follow ing subsections are added immediately after subsection 56(1.1) of the Act: "

(1.2) A regulation imposing a local im provement tax for electrical utility services, telephone utility services or other telecom munication services may include provisions for non-renewable agreements deferring the imposition of the local improvement tax for a period of not more than ten years without interest provided that the agreement shall be terminated on its expiry, or on (

a) the disposition of the property subject to the tax, unless the agreement otherwise provides, or (

b) the connection of the utility service to the property subject to the tax if these occur before the end of the term of the agreement.

(1.3) An agreement deferring local im provement taxes made under the authority of a regulation referred to in subsection (1.2) may be registered in the Land Titles Office as if it were LOI MODIFIANT LA

(1.2) Un règlement imposant une taxe d'am élioration locale pour les services d'électricité, de téléphone ou autre service de télécommunication peut comporter des dis positions portant sur des ententes non re nouvelables reportant l'imposition de la taxe pour au plus dix ans, libre d'intérêts, pourvu que l'entente cesse ses effets à sa date d'expiration ou avant cette date parce qu'il y a eu :

a) soit aliénation du bien assujetti à la taxe, à moins d'indication contraire dans l'entente;

b) soit raccordement du service public au bien assujetti à la taxe.

CHAPITRE 2 FIRST APPROPRIATION ACT, 1999-2000 (Assented to April 19, 1999)

Whereas it appears by message from the Commissioner and in the estimates accompanying the message that the sums mentioned in

Schedule A of this Act are required for the purpose of defraying certain expenses of the public service of the Yukon and for related purposes for the period of 12 months ending March 31, 2000; The Commissioner of the Yukon Territory, by and with the advice and consent of the Legislative Assembly, enacts as follows: 1. From and out of the Yukon Consolidated Revenue Fund there may be paid and applied a sum not exceeding in the whole $484,051,000 for defraying the several charges and expenses of the public service of the Yukon payable in the period of 12 months ending on March 31, 2000, as set forth in

Schedule A of this Act and which includes all sums previously appropriated for any part of the same period, and that sum shall not be paid or applied except in accordance with Schedules A , B and C, the Financial Administration Act and, subject to that Act, the estimates accompanying the message from the Commissioner. 2. Not included in the sum of $484,051,000 referred to in

section 1 is the sum of $450,000 representing the foregone incom e from non-interest bearing com pensating balances held on deposit with the government's banker for purposes of paying for the banking services provided to the government by the bank. 3. The due application of all monies paid or applied pursuant to

section 1 shall be accounted for. SCHEDULE C YUKON LEGISLATIVE ASSEMBLY: The Yukon Legislative Assembly is the parliament of the Yukon, consisting of Members who are elected by the people of the Yukon. Through them Yukon people make territorial laws and provide money needed by the Government of the Yukon for the present and future good of the people of the Territory. OFFICE OF THE OMBUDSMAN: To enhance public confidence and promote fairness and integrity in public administration of Yukon.

DEPARTMENTAL OBJECTIVES EXECUTIVE COUNCIL OFFICE: To facilitate the Cabinet decision-making process by providing advice, analysis and other services to Cabinet and its committees and by coordinating policy development work and other projects of an interdepartmental nature. To coordinate corporate management issues by managing internal review bodies, including Deputy Ministers' Review Committee and its subcommittees; by coordinating corporate work on government priorities, strategies, organization and renewal; and by providing corporate programs.

To build strong government-to-government relationships between the Yukon and First Nation governments and to foster effective relations with the governments of Canada, the provinces, the northern territories, the state of Alaska and other jurisdictions. To conclude outstanding Final and Self-Government Agreements and ensure effective implementation of the agreements. To complete the transfer of federal responsibilities to the Yukon Government in conjunction with other departments.

DEPARTMENT OF COMMUNITY AND TRANSPORTATION SERVICES: To promote local government, to provide support to ASSEMBLÉE LÉGISLATIVE DU YUKON : L'Assemblée législative du Yukon est le parlement du Yukon où siègent les députés élus par la population du Yukon. Par l'intermédiaire des députés, les gens du Yukon décident des lois territoriales et versent les sommes nécessaires au gouvernement du Yukon pour assurer le bien-être des gens du territoire. BUREAU DE L'OMBUDSMAN: Il tend à accroître la confiance chez le public et à promouvoir l’im partialité et l'intégrité de l'administration publique du Yukon.

ANNEXE C OBJECTIFS POURSUIVIS PAR LES MINISTÈRES MINISTÈRE DU CONSEIL EXÉCUTIF : Il facilite le processus décisionnel du Cabinet et de ses comités en lui fournissant des avis, des analyses et autres services. Il coordonne le travail de développement de politiques et autres projets interministériels. Il coordonne les questions de gestion corporative en gérant les comités de révision incluant le comité de révision des sous-ministres et ses sous-comités. Il coordonne la priorisation du travail du gouvernement, ses stratégies, son organisation et son renouvellement. Il fournit des programmes corporatifs.

Il voit à bâtir de bonnes relations intergouvem em entales entre le Yukon et les gouvernements des Premières nations et il encourage de bonnes relations avec les gouvernements du Canada, des provinces, des territoires du Nord, de l'état de l'Alaska et de toute autre juridiction. Il voit à conclure les ententes définitives ainsi que les ententes sur l'autonom ie gouvernem entale des Premières nations et à s'assurer de la mise en oeuvre efficace de celles-ci. Il voit aussi à mener à bonne fin le transfert des pouvoirs fédéraux au gouvernem ent du Yukon, conjointement avec les autres ministères.

CHAPTER 2 FIRST APPROPRIATION ACT, 1999-2000 m unicipalities, to provide municipal services and facilities in unincorporated communities and to participate in the efficient implementation of land claim settlements. To plan, develop, maintain and regulate safe and efficient transportation systems and services for the Yukon. To provide property assessment, and general property taxation services. To plan, develop and dispose of Yukon lands and to manage land use activity. To support the development of sport and community recreation throughout the Yukon.

To foster the development and provision of communications systems and services to enhance the economic and social opportunities of Yukon people. To promote the improvement and cost-effectiveness of infrastructure through undertaking applied research into northern infrastructure development. To support, administer and enforce building, electrical and m echanical safety standards, emergency preparedness and fire protection programs for the public safety of all Yukon people. To promote and undertake environmentally sound and cost effective activities and programs.

DEPARTMENT OF ECONOMIC DEVELOPMENT: To contribute to the creation of a strong and prosperous Yukon economy by: - working with First Nation governments, the Federal Government and Yukon people to support and encourage the management and development of Yukon's resources in an environmentally sound and socially sensitive manner;

Il voit à la planification, à l'élaboration, au maintien et à la réglementation de systèmes et de services de transport efficaces et sécuritaires au Yukon. YUKON HOUSING CORPORATION: To achieve its mission, the Corporation will: - facilitate community development to enable communities to address their housing needs; - play a lead role in dispensing information and transferring technology to the Yukon housing industry; - respond to the limitations of the housing marketplace with direct programming.

This programming will include: provision of affordable, suitable and adequate accommodation to Yukon households in need; assistance to Yukon residents to construct, purchase or repair their homes; and, provision of adequate and suitable accommodation to Yukon Government employees living in rural communities, and administration of the Employee Housing Buyback Program; - stimulate and encourage the marketplace to fulfil long-term housing needs; - stimulate and encourage the housing sector to strengthen Yukon's economy; and - deliver the federally funded Industrial Research Assistance Program as a means to provide Yukon industry with access to resources for research, development and marketing of new technology.

To encourage social responsibility in the sale and consumption of alcoholic beverages in the Yukon.

To provide for the return and, where possible, recycling of beverage containers. Whereas it appears by message from the Commissioner and in the estimates accompanying the message that, in addition to the sums previously appropriated, the sums not appearing in parenthesis in

Schedule A of this Act are required for the purpose of defraying certain expenses of the public service of the Yukon and for related purposes for the period of 12 months ending March 31, 1999; The Commissioner of the Yukon Territory, by and with the advice and consent of the Legislative Assembly, enacts as follows: 1.

(1) In addition to the net sum of $498,243,000 provided for in the First Appropriation Act, 1998-99 and the Second Appropriation Act, 1998-99 and the Third Appropriation Act, 1998-99 from and out of the Yukon Consolidated Revenue Fund there may be paid and applied a sum not exceeding in the whole $4,056,000, for defraying the several charges and expenses of the public service of the Yukon payable in the period of 12 months ending on March 31, 1999, as set forth in

Schedule A of this Act, and that sum shall not be paid or applied except in accordance with Schedules A and B, the Financial Administration Act and, subject to that Act, the estimates accompanying the message from the Commissioner.

(2) The sums previously appropriated to a vote or item that is listed in

Schedule A or in

Schedule B and that have sums appearing in parenthesis after them are reduced by the amount of the sum appearing in parenthesis, thereby reducing the net Total Voted (current spending authority) to $502,299,000. 2. Not included in the sum of $502,299,000 referred to in

AN ACT TO AMEND THE INCOME TAX ACT (Assented to April 29, 1999) The Commissioner of the Yukon Territory, by and with the advice and consent of the Legislative Assembly, enacts as follows: P a rt 1 1.

(1) The Income Tax Act is amended by adding the following sections immediately after

section 2: "Ordering of provisions applicable to individuals 2.1 In computing an individual's tax payable under this Act for a taxation year, the provisions of this Division must be applied in the following order: sections 3, 3.1, 3.2, 5 and 5.2. Ordering of provisions applicable to corporations 2.2 In computing a corporation's tax payable under this Act for a taxation year, the provisions of this Division must be applied in the following order: sections 4, 5 and 5.2."

(2) Su bsection (1) applies to the 1999 and subsequent taxation years. 2.

(1) The said Act is amended by adding the following

section immediately after

section 3.1: "Low Income Family Tax Credit 3.2(1) There may be deducted from the tax otherwise payable under this Act by an eligible individual for a taxation year the lesser of LOI MODIFIANT LA LOI DE L’IMPÔT SUR LE REVENU (sanctionnée le 29 avril 1999) Le Commissaire du territoire du Yukon, sur l'avis et avec le consentement de l'Assemblée législative, édicte ce qui suit : P a rtie 1 1.

AN ACT TO AMEND THE INCOME TAX ACT (

a) the amount, if any, by which (i) $300 exceeds (ii) 3% of the amount, if any, by which the individual’s income for the year exceeds $15,000, and (b) 80% of the tax otherwise payable under this Act by the individual for the year.

(2) For the purpose of subsection (1) an eligible individual for a taxation year means an individual who is resident in the Yukon on the last day of the year, other than (

a) an individual who has a cohabiting spouse at the end of the year whose income for the year exceeds the individual's income for the year, and who has filed a return of income under this Act for the year (other than a return of income filed pursuant to subsection 70(2), paragraph 104(23)(

d) or 128(2)(1) or subsection 150(4) of the Federal Act, (

b) an individual who has a cohabiting spouse at the end of the year where the individual and the spouse have elected under subsection (3) to treat the spouse as having an income for the year that exceeds the individual’s income for the year, and (

c) a trust.

(3) Where an individual's income for a taxation year is equal to the income for the year of a person who is the individual's cohabiting spouse at the end of the year, no amount is deductible under this

section from the tax otherwise payable under this Act for the year by the individual or the person unless they jointly elect to treat one of them as having an income for the year that exceeds the income of the other for the year.

(4) In this section, 'cohabiting spouse' means a cohabiting spouse as defined in

section 122.6 of the Federal Act.

(5) For the purposes of this section, where at any time in a taxation year an individual becomes bankrupt the individual's income for the year includes the individual's income for the individual's taxation year that began on January 1 of the calendar year that includes that time."

CHAPITRE 4 LOI MODIFIANT LA LOI DE L'IMPÔT SUR LE REVENU

(2) Pour l'application du paragraphe (1), l'expression « particulier admissible » s'entend d'un particulier qui réside au Yukon le dernier jour de l'année à l'exception des personnes suivantes :

a) le particulier qui, à la fin de l'année, a un conjoint visé dont le revenu pour l'année est supérieur au sien et qui a produit une déclaration de revenu conformément à la présente loi pour l'année (autre qu'une déclaration produite au

titre du paragraphe 70(2), de l'alinéa 104(23)

d) ou 128(2)1) ou du paragraphe 150(4) de la loi fédérale);

b) le particulier qui a un conjoint visé à la fin de l'année et qui, de pair avec son conjoint, a choisi en vertu du paragraphe (3) de considérer le revenu du conjoint visé pour l'année comme étant supérieur à celui du particulier pour l'année;

c) une fiducie.

(3) Lorsque le revenu d'un particulier qui est marié pour une année d'imposition est égal à celui de son conjoint, aucune déduction n'est permise, ni par l'un ni par l'autre, au

titre du présent article, de l'impôt par ailleurs payable en vertu de la présente loi pour l'année, à moins qu'ils aient tous deux choisi de considérer le revenu de l'un d'eux seulement comme étant supérieur à celui de l'autre pour l'année.

(4) Pour l'application du présent article, l'expression « conjoint visé » s'entend au sens de l'article 122.6 de la loi fédérale.

section 5: "First Nation Income Tax Credit 5.1(1) In this

section 'final agreem ent' means an agreement and a subsequent agreement as defined in

An Act Approving Yukon Land Claims Final Agreements; « entente finale » 'Yukon First Nation' means a Yukon First Nation as defined in

An Act Approving Yukon Land Claims Final Agreements; « Première nation du Yukon » and 'tax otherwise payable' by an individual for a taxation year means the amount that would be the tax, including the surtax, payable under this Act by the individual for the taxation year, computed as if the individual were not entitled to a deduction under

section 5 or this section. « impôt par ailleur payable »

(2) An individual may deduct from their tax otherwise payable for a taxation year the prescribed percentage of their tax otherwise payable for that year if, (

a) they were a resident on settlement land of a Yukon First Nation on the last day of that year, or (

b) having ceased to be a resident of Canada at any time in that year, they were a resident on settlem ent land on the last day of their residency in Canada, and the Yukon First Nation has made a final agreement and enacted or adopted an income tax Act as one of its laws, and made a tax sharing agreement that is in effect with the Government of the Yukon. Small Business Investment Tax Credit 5.2(1) In this section, 'cooperative corporation' has the same meaning as

a) le dernier jour de l'année en question;

AN ACT TO AMEND THE INCOME TAX ACT in

section 136 of the Federal Act; « société coopérative » 'eligible investor' for a taxation year means an individual (other than a trust or estate) who is resident in the Yukon on the last day of the year and who attained 19 years of age on or before that day; « investisseur admissible » 'eligible small business corporation' at any time means a corporation where, (

a) throughout the taxation year that includes that time, the corporation is a private corporation or a cooperative corporation, (

b) at the end of the year, the corporation maintains a permanent establishment in the Yukon through which it carries on an active business, other than the professional practice of an accountant, chiropractor, dentist, lawyer, medical doctor or veterinarian, (

c) throughout the year, the total of all amounts each of which is the cost amount to the corporation of a tangible property located in the Yukon is not less than 50% of the total of all amounts each of which is the cost amount to the corporation of a tangible property, (d) 50% or more of the wages and salaries paid by the corporation in the year to its employees is reasonably attributable to duties performed by the employees in the Yukon, (

e) immediately after that time the total of the cost amounts to the corporation of all of its properties (other than money) plus the amount of money owned by the corporation does not exceed $25,000,000, and (

f) any conditions prescribed in respect of the corporation are satisfied; « corporation exploitant une petite entreprise admissible » 'qualified investment' of an individual means a security issued by an eligible small business corporation to the individual that is (

a) a common share of the capital stock of the corporation that is not a taxable preferred share and that gives the shareholder the right to vote under all circumstances at an annual meeting of shareholders of the corporation,

b) à la fin de l'année, la corporation possède un établissement permanent au Yukon, autre qu'un bureau professionnel d'avocat, de chiropraticien, de comptable, de dentiste, de médecin ou de vétérinaire, à partir duquel elle exploite son entreprise;

c) durant l'année, le total de tous les montants représentant chacun les coûts engagés par la corporation au

titre d’un bien matériel au Yukon correspond à au moins 50 % de tous les montants engagés par la société au

titre d’un bien matériel;

d) au moins 50 % de la rémunération ou des salaires versés par la corporation durant l'année à ses employés est raisonnablement attribuable à des tâches exécutées par ces employés au Yukon;

b) a share of a cooperative corporation, or (

c) a debt obligation of the corporation, if (

i) in the event of the liquidation or winding-up of the corporation, the obligation would be subordinate in right of payment to all other debt obligations of the corporation, except obligations held by shareholders of the corporation and obligations that rank equally with the debt obligation, (ii) the terms of the obligation or of any agreement relating to the obligation do not restrict the corporation from incurring other indebtedness, (iii) the obligation is unsecured or secured only by a floating charge on the property of the corporation, and (iv) at the time that is immediately after the time at which the obligation is issued the total of amounts outstanding on account of the principal amount of all debt obligations issued by the corporation that are qualified investments of the individual does not exceed the total cost to the individual of all shares issued by the corporation that are qualified investments of the individual, where (

d) all the consideration received by the corporation for the issuance of the security is money, (

e) the corporation does not provide any form of financial assistance to the individual to enable the individual to acquire, or to assist the individual in acquiring, the security, (

f) during the period that began one year before the particular time at which the security was issued and that ends one year after the particular time, (

i) the corporation does not redeem, acquire or cancel a share of its capital stock that was owned at any time in the period by the individual or pay an amount on a

g) immediately after the acquisition of the security by the individual, the individual is dealing at arm's length with the corporation, (

h) the corporation uses the amount it receives from the issuance of the security to carry on an active business in the Yukon, and not to (

i) pay a dividend, (ii) redeem, acquire or cancel a share of its capital stock, (iii) pay an amount on the reduction of the paid-up capital in respect of a share of its capital stock, (iv) pay or settle an amount owed by the corporation to a shareholder or director of the corporation or to another corporation, (

v) make a loan or acquire indebtedness, or (vi) make a payment of any kind to a person with whom the corporation does not deal at arm’s length, and (

i) any conditions prescribed in respect of the security are satisfied; « placement admissible » 'qualifying trust' of an individual in respect of a security means (

a) a trust governed by a registered retirement savings plan, under which the individual is the annuitant, that is not a spousal plan (in this definition having the meaning assigned by subsection 146(1) of the Federal Act) in relation to another individual, or (

b) a trust governed by a registered retirement savings plan, under which the individual or the individual's spouse is the annuitant, that is a spousal plan in relation to the individual or the individual's spouse, if the individual and no (iv) immédiatement après le moment de l'émission du

(2) Where, within 36 months after the end of a taxation year, an individual who is an eligible investor for the year files a return of income under this Act for the year, there may be deducted from the tax otherwise payable under this Act by the individual for the year the lesser of (a) $25,000, and (

b) the total of (

i) the individual's small business investment tax credit for the year, and (ii) such part as the individual claims of the individual's unused small business investment tax credits for the individual's seven immediately preceding taxation years and three immediately following taxation years.

(3) For the purposes of this section, (

a) no amount may be claimed under subsection (2) in computing an individual's tax payable under this Act for a particular taxation year in respect of the individual's unused small business investment tax credit for another taxation year until the individual's unused small business investment tax credits, if any, for taxation years preceding the other year that capital-action, (iv) payer ou régler l'une de ses dettes envers un actionnaire ou un dirigeant de la corporation ou d'une autre corporation, (

b) an amount may be claimed under subsection (2) in computing an individual's tax payable under this Act for a particular taxation year in respect of the individual's unused small business investment tax credit for another taxation year only to the extent that it exceeds the total of all amounts claimed in respect of that unused small business investment tax credit in computing the individual's tax payable under this Act for the taxation years preceding the particular year.

(4) An individual's small business investment tax credit for a taxation year is 25% of the total of all amounts each of which is the cost to the individual of a qualified investment, where (

a) the investment is acquired by the individual in the year or within 60 days after the end of the year, (

b) the individual files with the individual's return of income under this Act for the year a copy of the small business investment tax credit certificate certifying that in the opinion of the Minister of Economic Development the investment is intended to be a qualified investment of the individual and that the cost of the investment is intended to be included in determining the individual's small business investment tax credit for the year, and (

c) the individual is an eligible investor for the year.

(5) An individual's unused small business investment tax credit for a taxation year is the amount, if any, by which (

a) the individual's small business investment

(4) Le crédit d'impôt relatif aux placements dans des petites entreprises d'un particulier pour une année d'imposition correspond à 25 % du total de tous les montants représentant chacun les coûts engagés par le particulier au

titre d'un placement admissible lorsque les conditions suivantes sont réunies :

a) le placement a été fait par le particulier pendant l'année ou dans les soixante jours suivant la fin de l'année;

b) le particulier produit avec sa déclaration de revenu en vertu de la présente loi pour l'année une copie du certificat de crédit d'impôt relatif aux placements dans des petites entreprises attestant que de l'avis du m inistre de l'Expansion économique le placement se veut un placement admissible du particulier et que les coûts engagés à l'égard de ce placement doivent être compris dans le calcul du crédit d'impôt en question pour l'année;

c) le particulier est un investisseur admissible pour l’année.

(5) La

partie inutilisée du crédit d'impôt relatif aux placements dans des petites entreprises d'un particulier pour une année d’imposition correspond à l'excédent éventuel du montant visé à l'alinéa a) sur le moindre des montants visés aux alinéas

b) the amount that, but for this section, would be the individual's tax payable under this Act for the year, and (c) $25,000.

(6) Where an individual disposes of a security (otherwise that as a consequence of the individual's death) within four years after the time at which the individual acquired it, the individual shall be deemed for the purpose of subsection (4) never to have acquired the security and the Commissioner may at any time before the day that is 4 years after the end of the normal reassessment period for the individual in respect of a taxation year make an assessment, reassessment or additional assessment of tax payable under this Act for the year, and any interest or penalties in respect thereof, in order to give effect to the application of this subsection.

(7) For the purpose of this section, (

a) an individual is deemed at any time to acquire, own or dispose of a security where at that time a qualifying trust of the individual in respect of the security acquires, owns or disposes of the security, and (

b) a corporation is deemed at any time to issue a security to an individual where at that time the corporation issues the security to a qualifying trust of the individual in respect of the security.

(8) A corporation may, on behalf of an individual, make an application on or after July 1, 1999 to the Minister of Economic Development for a small business investment tax credit certificate in respect of a security to be issued by the corporation.

(9) An application under subsection (8) shall be made in a form authorized by the Minister of Economic Development and shall be accompanied by (

a) a copy of the corporation's financial

(7) Pour l'application du présent article, les règles suivantes s'appliquent :

a) un particulier est réputé avoir acquis ou disposé d'une valeur mobilière, ou en être le propriétaire si au même moment une fiducie admissible du particulier à l'égard de la valeur mobilière acquiert ou dispose de la valeur mobilière ou en est propriétaire;

b) une corporation est réputée avoir émis une valeur mobilière à un particulier à moment donné si, au même moment la société émet la valeur mobilière à une fiducie admissible du particulier à l'égard de la valeur mobilière.

(8) À compter du 1" juillet 1999, il est permis à une corporation de présenter au ministre de l'Expansion économique, au nom d'un particulier, une demande de certificat de crédit d'impôt relatif aux placements dans des petites entreprises à l'égard d'une valeur mobilière émise par la corporation.

(9) La demande visée au paragraphe (8) est présentée selon le formulaire autorisé par le ministre de l'Expansion économique et accompagnée des pièces suivantes :

b) a copy of the corporation’s returns of income under this Act and

Part I of the Federal Act for its last taxation year, if any, that ended more than six months before the day on which the application is made and a copy of any return of income of the corporation under this Act and

Part I of the Federal Act for any subsequent taxation year that was filed under

section 150 of the Federal Act before that day, (

c) a copy of the corporation's articles or other constating documents, (

d) a list containing the names of each director and officer of the corporation and each individual who controls, or who is a member of a related group that controls, the corporation and the social insurance number, occupation and residential address of each such person, (

e) a list containing the names of each individual to whom the corporation intends to issue a security and the social insurance number, occupation and residential address of each such individual, (

f) statements, signed by each person named in a list referred to in paragraph (

d) or (e), that the information contained in the list in respect of the person is accurate, (

g) a business plan of the corporation containing (

i) a description of the corporation's activities that is complete in all material respects, (ii) an estimate of the amount that the corporation intends to receive from the issuance of qualified investments, (iii) an estimate of the amount that the corporation intends to receive from the issuance of shares, indebtedness or other securities that are not qualified investments, and pour sa dernière année d'imposition, le cas échéant, qui s'est terminée plus de six mois avant la date de la demande, ainsi qu'une copie des états financiers de la corporation pour chaque année d'imposition subséquente qui ont été préparé avant cette même date;

d) la liste des noms de tous les dirigeants et officiers de la corporation et de tout particulier qui contrôle ou fait

partie d'un groupe lié qui contrôle la société, ainsi que le numéro d'assurance sociale, l'occupation et l'adresse domiciliaire de chacun de ces personnes;

e) la liste de tous les particuliers à qui la corporation prévoit émettre un placement admissible ainsi que le numéro d'assurance sociale, l'occupation et l'adresse domiciliaire de chacun de ces particuliers;

f) une déclaration de chacune des personnes dont le nom figure sur la liste visée à l'alinéa d) ou

e) attestant que les renseignements fournis à son égard sont exacts;

g) plan d'entreprise contenant les renseignements suivants : (

i) une description complète des activités de la corporation, (ii) une estimation des montants que la corporation prévoit recevoir au

AN ACT TO AMEND THE INCOME TAX ACT (iv) a description of the intended use by the corporation of the amounts referred to in subparagraphs (ii) and (iii), (

h) any other information that, in the opinion of the Minister, is necessary to determine whether the security in respect of which the application is made, if issued, would be a qualified investment of an eligible investor or whether the issuance of the certificate would be in accordance with the object and spirit of this Act, and (

i) any prescribed documents or information.

(10) The Minister of Economic Development shall examine each application made in accordance with subsections (8) and (9) by a corporation on behalf of an individual and, subject to subsections (11) and (12), may issue to the corporation a certificate, in a form authorized by the Minister, in respect of the security in respect of which the application was made certifying that, in the opinion of the Minister, the security is intended to be a qualified investment of the individual and the cost of the security is intended to be included in determ ining the individual's small business investment tax credit for a particular taxation year where, in the opinion of the Minister, (

a) the inform ation accompanying the application is complete and accurate in all material respects, (

b) if the inform ation accompanying the application were compete and accurate in all material respects, the security, if issued, would be a qualified investment of the individual and the cost of the security would be included in determining the individual's small business investment credit for the year, and (

c) the issuance of the security would be in accordance with the object and spirit of this Act, and, if the certificate is so issued, the corporation shall deliver a copy of the certificate to the individual after the corporation has received from the individual all consideration for the issuance of the security.

(10) Le ministre de l'Expansion économique étudie chaque demande présentée conformément aux paragraphes (8) et (9) par une corporation au nom d'un particulier et, sous réserve des paragraphes (11) et (12), il peut délivrer à la corporation un certificat, selon le formulaire qu'il a autorisé, à l’égard de la valeur mobilière visée par la demande attestant que de l'avis du ministre, la valeur mobilière se veut un placement admissible par le particulier et les coûts y afférents devraient être compris dans le calcul du crédit d’impôt relatif aux placements dans des petites entreprises du particulier pour une année d'im position, si de l'avis du ministre, les exigences suivantes sont rencontrées :

a) les renseignements fournis avec la demande sont à la fois complets et exacts;

b) si les renseignements fournis avec la demande sont à la fois complets et exacts, la valeur mobilière, si elle était émise, serait un placement admissible par le particulier et les coûts y afférents seraient compris dans le calcul du crédit d'impôt relatif aux placements dans des petites entreprises du particulier pour l'année;

c) l’émission de la valeur mobilière créerait un avantage net important pour l'économie du Yukon. Sur réception de toute la contrepartie demandée à l'égard d'une valeur mobilière, la corporation est tenue de remettre au particulier une copie de tout certificat de crédit d’impôt relatif aux placements dans des petites entreprises qu'elle a obtenu à l'égard de cette valeur. (11) The Minister of Economic Development may not at any particular time issue a certificate under subsection (10) where, if the certificate were issued, the total of all amounts received or intended to be received by the corporation that applied for the certificate, or by another corporation with which that corporation is associated, from the issuance of a security in respect of which a certificate was issued under that subsection in the calendar year that includes the particular time would be greater than $800,000.

(12) The Minister of Economic Development may not at any particular time issue a certificate under subsection (10) where, if the certificate were issued, the total of all amounts each of which is an amount received or intended to be received by a corporation from the issuance of a security in respect of which a certificate was issued under that subsection in the calendar year that includes the particular time would be greater than $4,000,000.

(13) A corporation that has issued a qualifying investment in a taxation year shall on or before its filing-due date for the year and for each taxation year ending within four calendar years after the end of the taxation year, file with the Minister of Economic Development a return that is in a form authorized by the Minister and that contains prescribed information.

(14) The Minister of Economic Development may at any time revoke a certificate issued under subsection (10) where (

a) in the opinion of the Minister, an omission or a misrepresentation was made in order to obtain the certificate, (

b) the corporation that applied for the certificate has failed to file a return as required by subsection (13), (

c) in the opinion of the Minister, the amount received by the corporation from the issuance of the security in respect of which the certificate was issued has not been used in accordance with the description of its intended use referred to in subparagraph (9)(g)(iv), or (

d) in the opinion of the Minister, an omission or misrepresentation was made in a return filed

(12) Il est interdit au ministre de l'Expansion économique de délivrer un certificat en vertu du paragraphe (10) si la délivrance du certificat faisait en sorte que pendant l'année civile où le certificat a été délivré, le total de tous les montants représentant chacun un montant que la société a reçu ou qu'elle s'attend recevoir en raison de l'émission de la valeur mobilière visée par le certificat dépasserait 4 000 000 $.

(13) La corporation qui a émis un placement admissible au cours d'une année d'imposition est tenue de déposer auprès du ministre de l'Expansion économique, au plus tard à sa date d'échéance de production pour l'année et pour chaque année d'imposition se terminant dans les quatre années civiles après la fin d'une année d'imposition, une déclaration sur le formulaire que le ministre autorise et qui contient les renseignements prescrits.

(14) Le ministre de l’Expansion économique peut révoquer un certificat délivré en application du paragraphe (10) dans les cas suivants :

a) il est d’avis que le certificat a été obtenu sur le fondement de renseignements incomplets ou une présentation erronée des faits;

b) la société qui a demandé le certificat n'a pas produit la déclaration de revenu exigée au paragraphe (13);

c) il est d'avis que le montant reçu par la société en raison de l'émission de la valeur mobilière visée par le certificat n'a pas été affecté en conformité avec l'utilisation projetée visée au sous-alinéas 9g)(iv);

d) il est d'avis que, dans le but de contourner l'application du présent paragraphe, qu'il y a eu présentation erronée des faits dans une STATUTES OF THE YUKON 1999 12 LOIS DU YUKON 1999

AN ACT TO AMEND THE INCOME TAX ACT under subsection (13) in order to avoid the application of this subsection, and, for the purpose of this section, where a certificate issued under subsection (10) has been revoked it is deemed never to have been issued.

(15) The Commissioner may at any time make an assessment, reassessment or additional assessment of tax payable under this Act by a taxpayer for any taxation year, and any interest or penalties in respect thereof, in order to give effect to the application of subsection (14).

(16) The Minister of Economic Development may authorize a person or a class of persons to exercise the powers or perform the duties of the Minister under this section." (2) Subsection (1) applies to the 1999 and subsequent taxation years. 4.

(1) Section 7 of the said Act is repealed and the following

section is substituted for it: "Exemptions 7. No tax is payable under this Act by a person for a period when (

a) the person was exempt from tax under

Part I of the Federal Act on the person's taxable income, or (

b) the person was a non-resident-owned investment corporation, and any definition or description in the Federal Act that applies to such a person applies, with such modifications as the circumstances require, for the purposes of this Act unless otherwise provided." (2) Subsection (1) applies to the 1999 and subsequent taxation years. 5.

(1) The said Act is amended by adding the following

section immediately after

section 9:

(15) Le Commissaire peut établir une cotisation, une nouvelle cotisation ou une cotisation supplémentaire concernant l'impôt pour une année d'imposition, ainsi que les intérêts ou les pénalités, qui sont payables par un contribuable en vertu de la présente loi, si cela est nécessaire à l'application du paragraphe (14).

(16) Le ministre de l'Expansion économique peut déléguer les attributions que lui confère le présent

article à toute personne ou catégorie de personnes. »

(2) Le paragraphe (1) s'applique aux années d'imposition 1999 et suivantes. 4 .

(1) L'article 7 de la même loi est abrogé et remplacé par ce qui suit : « Exemptions 7. Aucun impôt n'est exigible d'une personne, en vertu de la présente loi, pour la période pendant laquelle elle était :

a) soit exemptée de l'impôt sur son revenu imposable en vertu de la

partie I de la loi fédérale;

AN ACT TO AMEND THE INCOME TAX ACT "Mineral Exploration Tax Credit 9.1(1) Where, within 12 months after the end of a taxation year, a taxpayer who is an eligible taxpayer for the year claims a mineral exploration tax credit for the year by filing, with the taxpayer's return of income under this Act for the year, a prescribed form containing prescribed information with the Minister, the taxpayer shall be deemed to have paid an amount, on account of the taxpayer's tax payable under this Act for the year, equal to the taxpayer's mineral exploration tax credit for the year.

(2) The amount deemed by subsection (1) to have been paid on account of a taxpayer's tax payable under this Act for a taxation year is deemed to have been so paid, and to have been received by the Minister, on the taxpayer's balance-due day for the year.

(3) A taxpayer's mineral exploration tax credit for a taxation year is 22% of the amount, if any, by which (

a) the total eligible mineral exploration expenses incurred by the taxpayer in the year exceeds the total of (

b) the total amount of assistance that, as of the day on which the taxpayer claims the mineral exploration tax credit under subsection (1), (

i) the taxpayer has received, is entitled to receive, or can reasonably be expected to receive in respect of the total determined under paragraph (a), (ii) has not been repaid by the taxpayer pursuant to a legal obligation to do so, and (iii) has not otherwise reduced the total determined under paragraph (a), and (

c) where the taxpayer is a corporation, the amount, if any, by which (

i) the total of all amounts each of which is an amount received by the taxpayer before the end of the year as consideration for issuance of a security in respect of which a small business investm ent tax credit certificate, as defined in

section 5.2, has

b) et c) :

a) le total des frais relatifs à l'exploration minière engagés par le contribuable durant l'année;

b) le total des montants à

titre d'aide à compter de la date à laquelle le contribuable demande le crédit d'impôt relatif à l'exploration minière au

titre du paragraphe (1), (

i) qu'il a reçu, est en droit de recevoir ou peut raisonnablement s'attendre à recevoir au

titre du m ontant déterminé en application de l'alinéa a), (ii) qui n'a pas été payée de nouveau par le contribuable en vertu d'une obligation légale de le faire, (iii) qui n'a pas autrem ent réduit le montant déterminé selon l'alinéa a);

c) s'agissant d'une corporation, l'excédent éventuel du montant visé au sous-alinéa (

i) sur celui visé au sous-alinéa (ii) (

CHAPITRE 4 LOI MODIFIANT LA LOI DE L'IMPÔT SUR LE REVENU been issued to the extent that the business plan filed with the application for the certificate provided that the amount was intended to be used for a purpose described in the definition 'eligible mineral exploration expense' in subsection (4) or to the extent that the amount was so used exceeds (ii) 100/22 of the total amount of all amounts each of which is the amount, if any, by which (

A) the amount that would have been the taxpayer's mineral exploration tax credit for a preceding year if this Act were read without reference to this paragraph exceeds (

B) the taxpayer's mineral exploration credit for that preceding year.

(4) In this section, 'assistance' in relation to a taxpayer means an amount, other than an amount deemed under subsection (1) to have been paid by the taxpayer, that would be included under paragraph 12(l)(

x) of the Federal Act in computing the taxpayer's income for any taxation year if that paragraph were read without reference to subparagraphs (

v) to (vii); « montant à

titre d'aide » 'eligible mineral exploration expense' incurred by a taxpayer means an expense (other than an ineligible expense) incurred by the taxpayer after March 31, 1999 and before April 1, 2001, for the purpose of determining the existence, location, extent or quality of a mineral resource in the Yukon, including (

b) an expense described in this paragraph that is renounced by the taxpayer under

section 66 of the Federal Act; « frais d'exploration minière » 'eligible taxpayer' for a taxation year means (

a) an individual who is resident in the Yukon on the last day of the year, or (

b) a corporation that maintains a permanent establishment in the Yukon at any time in the year, other than a corporation (

i) that is exempt from tax payable under this Act by reason of

section 7, or (ii) that is controlled by one or more persons who are exempt from tax payable under this Act by reason of

section 7; « contribuable admissible » 'ineligible expense' of a taxpayer means (

a) an expense incurred by the taxpayer in drilling or completing an oil well or gas well or in building a temporary access road to, or preparing a site in respect of, any such well, (

b) a Canadian development expense of the taxpayer as defined in subsection 66.2(5) of the Federal Act, (

c) an expense incurred by the taxpayer that may reasonably be considered to be related to a mine that has come into production in reasonable commercial quantities or to be related to a potential or actual extension thereof, (

d) an expense incurred by the taxpayer that is described in any of paragraphs (g), (j), and (1) to (

o) of the definition "Canadian exploration expense" in subsection 66.1(6) of the Federal Act, (

e) a Canadian exploration and development overhead expense of the taxpayer as defined in

Part XII of the Federal Regulations, localisation, l'étendue ou la qualité d'une ressource minérale au Yukon, y compris

a) les frais suivants : (

(2) Su bsection (1) applies to the 1999 and subsequent taxation years. 7. (1) Subsection 15(1) of the said Act is repealed and the following subsection is substituted for it: "15.

(1) Subject to

section 16, every individual (other than one to whom

section 14 applies) shall pay to the Minister of Finance in respect of each taxation year (

a) on or before March 15, June 15, September IS, and December 15 in the year, 1/4 of
