LOI SUR LES BIBLIOTHÈQUES PUBLIQUES The Commissioner of the Northwest Territories, by and with the advice and consent of the Legislative Assembly, enacts as follows: Le commissaire des Territoires du Nord-Ouest, sur l’avis et avec le consentement de l’Assemblée législative, édicte :

Definitions 1.

(1) In this Act, "library authority" means the council of a municipal corporation or a body that the Minister recognizes as a representative body of a community or region for the purposes of this Act; ( autorité régissant les bibliothèques) "public library" means a library designated by the Minister under

section 3; (bibliothèque publique) "Public Library Services" means the Public Library Services of the Northwest Territories continued by the Minister under

(2) This Act applies to public libraries designated by the Minister under

section 3.

Application PUBLIC LIBRARIES BIBLIOTHÈQUES PUBLIQUES Public Library Services of the Northwest Territories 2. The Minister shall continue a system of free public libraries called the Public Library Services of the Northwest Territories. 2. a) under which (

i) the Minister agrees to provide staff and books, periodicals, films, records, materials and other objects or articles of educational or cultural value for a public library in the community, and (ii) the library authority agrees to provide and maintain adequate premises for use as a public library in the community, or (

a) reserve or borrow circulating library materials without the payment of a fee; and (

b) use library reference materials and services, and information services without the payment of a fee.

(1) Subject to the regulations, a library authority may charge such fees as it considers appropriate for (

a) services not referred to in

section 5; (

b) the use of parts of a building that are not being used for public library purposes; and (

c) the use of library materials or services by persons who do not reside in the Northwest Territories. 6.

(1) Sous réserve des règlements, l’autorité régissant les bibliothèques peut imposer les droits qu’elle estime appropriés pour :

a) les services non visés à l’article 5;

b) l’utilisation des parties d’un bâtiment qui ne sont pas utilisées aux fins de la bibliothèque publique;

c) l’utilisation des documents ou des services de bibliothèque par des personnes qui ne résident pas aux Territoires du Nord-Ouest. Droits Library fines

(2) Subject to the regulations, a library authority may charge such fines as it considers appropriate for a breach of its rules.

(2) Sous réserve des règlements, l’autorité régissant les bibliothèques peut imposer les amendes, qu’elle estime appropriées, en cas de violation des règles. Amendes Library rules 7.

(1) Subject to the regulations, a library authority may make rules (

a) respecting the use of library services; (

b) respecting the admission of the public to the library; (

c) for the exclusion from the library of persons who behave in a disruptive manner or cause damage to library property; (

d) respecting fines for breaches of the rules; (

e) respecting the suspension of library privileges of persons in breach of the rules; and (

f) respecting all other matters connected with the management of the library and library property. 7.

(1) Sous réserve des règlements, l’autorité régissant les bibliothèques peut établir des règles portant sur :

a) l’utilisation des services de bibliothèque;

b) l’admission du public à la bibliothèque;

c) l’exclusion de la bibliothèque des perturbateurs ou des personnes qui endommagent les biens de la bibliothèque;

d) l’imposition d’amendes en cas de violation des règles;

e) la suspension des privilèges des usagers en cas de violation des règles;

f) toutes les autres questions liées à la gestion de la bibliothèque et de ses biens. Règles

(2) Rules made under subsection (1) are not statutory instruments within the meaning of the Statutory Instruments Act.

a) by purchase, gift or bequest, acquire for the Public Library Services books, periodicals, films, records, materials or any other objects or articles of educational or cultural value; (

b) by gift, bequest or otherwise, acquire money, securities or other property; and (

c) expend, administer or dispose of property acquired under paragraph (

b) for public library purposes, subject to the terms on which the property was acquired. 8. Le ministre peut, à la fois :

a) acquérir, par achat, don ou legs, pour le compte des services des bibliothèques publiques, des livres, des périodiques, des films, des disques, des documents ou autres objets ou articles ayant une valeur éducative ou culturelle;

b) acquérir, notamment par don ou legs, des sommes d’argent, des valeurs mobilières ou d’autres biens;

c) utiliser, gérer ou aliéner des biens acquis en conformité avec l’alinéa b) pour les besoins d’une bibliothèque publique, sous réserve des conditions auxquelles était soumise l’acquisition des biens. Pouvoirs du ministre REGULATIONS RÈGLEMENTS Regulations 9. The Commissioner, on the recommendation of the Minister, may make regulations (

a) respecting the operation, maintenance and inspection of the Public Library Services, including library services by mail; (

b) prescribing the maximum fees that a library authority may charge public library users; (

c) prescribing the maximum fines that a library authority may impose on public library users; and (

d) for those matters respecting the Public Library Services that the Commissioner considers necessary. 9. Sur la recommandation du ministre, le Commissaire peut, par règlement :

a) régir le fonctionnement, l’entretien et l’inspection des services des bibliothèques publiques, y compris les services de bibliothèque par la poste;

b) fixer le montant maximum des droits qui peuvent être exigés des usagers des bibliothèques publiques par une autorité régissant les bibliothèques;

c) fixer le montant maximum des amendes qui peuvent être imposées aux usagers des bibliothèques publiques par une autorité régissant les bibliothèques;
