(2) Section 246, subsection 252(1) and Division 3 do not apply in respect of a local improvement constructed under the retrofitting buildings program.

(2) If the effect of subsection (1) is that a municipality is considered to have levied a tax, the municipality must collect the tax as though it had imposed the tax by bylaw.

(3) A municipality’s obligation under subsection (2) to collect an amount is affected neither by the expiry or termination of the relevant retrofitting buildings program agreement nor by any measure the Government takes under paragraph 271.12(2)(b).
