section 23 of the Financial Administration Act, Management Board Directive #54/25 is issued as per MBM#25-030-01 as follows: AUTHORITY 1. This Directive is issued pursuant to sections 4 and 23 of the Act and may only be amended by Management Board. TITLE 2. This Directive may be referred to as the “Directive To Set Signing Authorities During the 2025 Election Period”.

DEFINITIONS 3. In this Directive: a.

"Act” means the Financial Administration Act, SY 2002, c. 87, as amended from time to time; b. “Commissioner” means the Commissioner of Yukon; c. “Contract” includes any agreement by which the Government of Yukon will be spending or disbursing money through a Transfer Payment Agreement or through a contract to acquire goods, services, real property, or public works; d. “DM ECO” means, from time to time, the person appointed as the deputy head of the Executive Council Office; e. “DM FIN” means, from time to time, the person appointed as the deputy head of the Department of Finance; f. “Election Period” means the period of time in 2025 beginning on the day that the chief electoral officer issues a writ of election pursuant to an order of the Commissioner and ending on the day on which a person is sworn in as Premier of Yukon; g. “Procurement Directive” means the standing directive entitled “Procurement Policy” that is reproduced at GAM 2.6; h. “PSC” means, from time to time, the person appointed as the Public Service Commissioner; i. “Signing Authorities Directive” means the standing directive respecting signing authorities that is reproduced at FAM 5.5; and j. “Travel Authorization” means an approval by which a public officer may travel for work related purposes at government expense.

SIGNING AUTHORITIES DURING THE ELECTION PERIOD - CONTRACTS 4. During the Election Period, and notwithstanding the Signing Authorities Directive, either of the DM ECO or the DM FIN may sign a Contract or a change order on a Contract on behalf of the Government of Yukon for any amount under s. 23 of the Act. 5. During the Election Period, and notwithstanding the Signing Authorities Directive, the PSC may sign a Contract or a change order on a Contract on behalf of the Government of Yukon for any amount under s. 23 of the Act – but only if neither of the DM ECO or the DM FIN is available.

Nothing in this Directive shall be read so as to prohibit a Minister from signing a Contract or a change order on a Contract on behalf of the Government of Yukon under s. 23 of the Act in accordance with the Signing Authorities Directive during the Election Period. 7.

For greater certainty, during the Election Period, all other signatures required in respect of Contracts under the Act will be handled as per usual, such that: a. the certification required under s. 24 of the Act will be made by the deputy head responsible for the vote from which the funds will be paid, or by a public officer designated in writing by that deputy head; b. the record of commitment required under s. 28 of the Act will be kept by the normally assigned public officer; c. the certificate of performance required under s. 29 of the Act will be kept by the normally authorized public officer; and d. any requisitions for payment required under s. 30 of the Act will be made by the normally authorized public officer.

APPROVING TRAVEL DURING THE ELECTION PERIOD 8. During the Election Period, and notwithstanding the Signing Authorities Directive or the Government Travel Directive, either of the DM ECO or the DM FIN may approve a Travel Authorization for any amount and to any place. 9. During the Election Period, and notwithstanding the Signing Authorities Directive, the PSC may approve a Travel Authorization for any amount – but only if neither of the DM ECO or the DM FIN is available. 10. Nothing in this Directive shall be read so as to prohibit a Minister from signing a Travel Authorization during the Election Period.

APPROVING A CONTRACT WITH A LENGTH GREATER THAN THREE YEARS AND UP TO FIVE YEARS 11. During the Election Period, and despite s. 2(3)(a)(ii) of the Procurement Directive, either of the DM ECO or the DM FIN may approve a Contract for a period of time greater than three years and up to and including five years. 12. During the Election Period, and despite s. 2(3)(a)(ii) of the Procurement Directive, the PSC may approve a Contract for a period of time greater than three years and up to and including five years – but only if neither of the DM ECO or the DM FIN is available. 13.

Nothing in this Directive shall be read so as to prohibit the Minister of Highways and Public Works, or another Minister acting in the place of that Minister, from approving a Contract for a period of time greater than three years and up to and including five years during the Election Period. LIMITATIONS ON AUTHORITIES GRANTED UNDER THIS DIRECTIVE 14. All powers exercised under the authority of this Directive must be exercised only for the purpose of dealing with an emergency, or for the purpose of enabling the routine and normal operation of the government. NO AUTHORITY TO DELEGATE 15.

None of the special authorities granted under this Directive may be delegated by any of the DM ECO, the DM FIN, or the PSC. 16. For greater certainty, persons acting from time to time in the place of the appointed DM ECO, the DM FIN, or the PSC may not exercise the special authorities granted under this Directive.
