Definitions 1.

(1) In this Act, "applicant" means a person referred to in subsection 2(1) (

a) who applies for an emergency protection order or a protection order, (

b) on whose behalf an application is made for an emergency protection order or a protection order, or (

c) who is granted an emergency protection order or a protection order; (requérant) "child" means a person under the age of 19 years; (enfant) "court" means the Supreme Court; (tribunal) "designated justice" means a justice of the peace designated under subsection 12(1) and a judge of the Territorial Court referred to in subsection 12(2); (juge désigné) "emergency protection order" means an order made under subsection 4(1); (ordonnance de protection d’urgence) "protection order" means an order made under subsection 7(1); (ordonnance de protection) "residence" means a place where an applicant normally resides and includes a residence that an applicant has vacated due to family violence; (résidence) "respondent" means a person against whom an emergency protection order or a protection order is sought or granted; (intimé) "weapon" means a weapon as defined in the Criminal Code. Definition: "family violence"

(2) In this Act "family violence" means any of the following acts or omissions committed against an applicant, any child of the applicant or any child who is in the care of the applicant: (

a) an intentional or reckless act or omission that causes bodily harm or damage to property; (

b) an intentional, reckless or threatened act or omission that (

i) causes the applicant to fear for his or her safety, (ii) causes the applicant to fear for the safety of any child of the applicant or any child who is in the care of the applicant, or (iii) causes any child of the applicant or any child who is in the care of the applicant to fear for his or her safety; (

c) sexual abuse; (

d) forcible confinement; (

e) psychological abuse, emotional abuse or financial abuse that causes harm or the fear of harm to the applicant, any child of the applicant or any child who is in the care of the applicant.

(2) Dans la présente loi, «violence familiale» s’entend des actes ou omissions commis à l’endroit du requérant, d’un enfant du requérant ou d’un enfant dont le requérant a la garde, dans les cas suivants :

a) les actes ou omissions commis intentionnellement ou par insouciance et qui entraînent des préjudices corporels ou des dommages matériels;

b) les actes ou omissions commis intentionnellement ou par insouciance ou la menace de commettre des actes ou omissions qui : (

i) amènent le requérant à craindre pour sa sécurité, (ii) amènent le requérant à craindre pour la sécurité d’un de ses enfants ou d’un enfant dont il a la garde, (iii) amènent tout enfant du requérant ou tout enfant dont le requérant a la garde à craindre pour sa sécurité;

c) abus sexuel;

d) séquestration;

e) le harcèlement psychologique ou affectif, l’exploitation financière causant un préjudice ou la crainte du requérant, de tout enfant du requérant ou de tout enfant dont le requérant a la garde de subir un préjudice. Définition : «violence familiale» Application Requête Applicants 2.

(1) The following persons may apply for an emergency protection order or a protection order: (

a) a spouse or former spouse of the respondent; (

b) a person who resides with, or has resided with, the respondent in an intimate or family relationship; (

c) a person who is, together with the respondent, a parent of a child; (

d) a parent or grandparent of (

i) the respondent, or (ii) a person referred to in paragraph (a), (

b) or (c). 2.

(4) An application for an emergency protection order (

a) must be made in accordance with the regulations; and (

b) subject to the regulations, may be made and heard by a method of telecommunication.

(1) A clerk of the court, a designated justice and any person who exercises a duty to carry out the provisions of an order made under this Act must keep confidential any information relating to the location of an applicant unless the applicant or a person applying on his or her behalf consents to the giving of the information. 3.

(2) The court may order that members of the public, other than the parties, may be excluded from a hearing.

(3) On the request of the applicant or the respondent, or on the initiative of the court, the court may make an order prohibiting the publication of a report of a hearing or any part of a hearing if the court believes that the publication of the report would have an adverse effect on, or cause undue hardship to, the applicant, the respondent, any child of the applicant or respondent, or any child in the care of the applicant or respondent.

(1) On an application that may be made ex parte, a designated justice may make an emergency protection order if he or she is satisfied on a balance of probabilities that (

a) family violence has occurred; and (

b) by reason of seriousness or urgency the order should be made without delay to ensure the protection of the person who is 4.

(2) In determining whether an emergency protection order should be made, the designated justice shall consider, but is not limited to considering, the following factors: (

a) the nature of the family violence; (

b) the history of family violence by the respondent towards the applicant or other person at risk of harm; (

c) the existence of immediate danger to persons or property; (

d) the best interests of the applicant and any child of the applicant or any child who is in the care of the applicant.

(3) An emergency protection order may contain any or all of the following provisions: (

a) a provision restraining the respondent from communicating with or contacting the applicant or other specified person; (

b) a provision granting the applicant exclusive occupation of a residence; (

c) a provision directing a peace officer, immediately or within a specified period of time, to remove the respondent from a residence; (

d) a provision directing a peace officer, within a specified period of time, to accompany the applicant, respondent or other specified person to a residence or other location and to supervise the removal of personal belongings; (

e) a provision granting the applicant or respondent temporary possession and exclusive use of specified personal property; (

f) a provision restraining the respondent from taking, converting, damaging or otherwise dealing with property in which the applicant has an interest; (

g) a provision requiring a respondent to surrender to a peace officer, for a period not to exceed 90 days, (

i) a weapon, if he or she has used or threatened to use a weapon to commit family violence, and (ii) any document that authorizes the respondent to own, possess or control a weapon referred to in subparagraph (i);

e) accordent au requérant ou à l’intimé la possession temporaire et la jouissance exclusive de biens meubles déterminés;

f) empêchent l’intimé de prendre, de transformer ou d’endommager un bien dans lequel le requérant détient un intérêt ou d’agir de toute autre façon à l’égard de ce bien;

g) obligent l’intimé à remettre à un agent de la paix pour une période ne dépassant pas 90 jours : (

i) toute arme qu’il a utilisée ou menacé d’utiliser pour commettre un acte de violence familiale, (ii) tout document qui autorise l’intimé à être propriétaire d’une arme visée au sous-alinéa (

i) ou à en avoir la possession ou le contrôle; Contenu de l’ordonnance 7

(

h) any other provision that the designated justice considers necessary for the immediate protection of the applicant or other person at risk of harm.

(4) If a designated justice finds that the respondent used or threatened to use a firearm in committing family violence, the designated justice shall include a provision in the emergency protection order requiring the respondent to surrender to a peace officer, for a period not to exceed 90 days, (

a) any firearm owned, possessed or controlled by the respondent; and (

b) any document that authorizes the respondent to own, possess or control a firearm.

(5) An emergency protection order or any provision of the order may be made subject to any terms or conditions that the designated justice considers appropriate, but the duration of the order must not exceed 90 days.

(6) A provision made under paragraph (3)(

g) or subsection (4) ceases to be in force in respect of a firearm or other weapon that is subject to the provision, if an order or final determination with respect to the respondent’s ownership, possession or control of the firearm or other weapon is made under the Criminal Code in respect of the events on which the emergency protection order is based.

(1) Upon making an emergency protection order, a designated justice shall promptly forward to the court the order and all supporting records, including his or her notes. 5.

(2) The court shall review the emergency protection order, without holding a hearing, within three working days after the court receives the order and supporting records, or if a judge is not available during that period, as soon as a judge can be made available.

Decision on review

(3) The court, upon review of the emergency protection order, (

a) shall confirm the order if satisfied that there was evidence before the designated justice to support the granting of the order; or (

b) shall direct a hearing of the matter if the court is not satisfied that there was evidence before the designated justice to support the granting of the order or any provision of the order.

(3.1) In confirming an emergency protection order pursuant to paragraph (3)(a), the court may vary the order to correct minor defects, and discrepancies that are apparent on the face of the order.

(4) An emergency protection order that is confirmed by the court under paragraph (3)(

a) is deemed for all purposes to be an order of the court.

(1) Where the court directs a hearing under paragraph 5(3)(

b) in respect of an emergency protection order, the Clerk of the Supreme Court shall provide notice of the hearing to the applicant and the respondent. 6.

(3) The court may, in addition to other evidence that may be adduced at the hearing, consider the evidence that was before the designated justice on the application in respect of the emergency protection order.

(4) At the hearing the court may (

a) confirm the order; (

b) vary the order, or any provision of the order, including the duration of the order or provision; (

c) add provisions to the order;

d) revoke any provision of the order; or (

e) revoke the order.

f) a provision restraining the respondent from taking, converting, damaging or otherwise dealing with property in which the applicant has an interest; (

g) a provision requiring the respondent to pay the applicant compensation for monetary losses suffered by the applicant or any child of the applicant or any child who is in the care of the applicant as a direct result of the family violence, including loss of earnings or support, medical and dental expenses, out-of- pocket losses for injuries sustained, moving and accommodation expenses, legal expenses and costs of an application under this Act; (

h) a provision requiring a respondent to surrender to a peace officer (

i) a weapon, if he or she has used or threatened to use a weapon to commit family violence, and

(1) At any time after a respondent has notice of an emergency protection order or a protection order, the court, on application by the applicant or respondent named in the order, may (

a) vary the order, or any provision of the order, including the duration of the order or provision; (

b) add provisions to the order; (

c) revoke any provision of the order; or (

d) revoke the order. 9.

The Minister or his or her delegate may, with the consent of the court, access court files and review transcripts of emergency protection order applications for research, evaluation, or training purposes where appropriate, provided there is no public disclosure of (

a) any information that could identify an applicant, respondent, or any child of or in the care of an applicant or respondent; or (

(1) A designated justice may issue a warrant if, on an ex parte application by a person or a member of a category of persons designated in the regulations, the designated justice is satisfied by information on oath that there are reasonable grounds to believe that (

a) the person who provided the information on oath has been refused access to a person who may be the subject of family violence; and (

b) a person who may be the subject of family violence will be found at the place to be searched. 17.

d) publishes any information in contravention of this Act or contrary to an order made under this Act, is guilty of an offence and liable on

i) requiring the Clerk of the Supreme Court or other person to provide documentation to the respondent in respect of a hearing under

section 6; (

j) respecting the form and manner of providing any notice required under this Act; (

k) designating persons or categories of persons who may apply for a warrant under

section 17; and (

l) respecting any other matter or thing that the Commissioner considers necessary to carry out the intent and purposes of this Act. et l’audition d ’une demande d’ordonnance de protection d’urgence par un moyen de télécommunication;
