AN ACT TO AMEND THE COMPENSATION FOR VICTIMS OF CRIME ACT (Assented to June 2, 1992) The Commissioner of the Yukon Territory, by and with the advice and consent of the Legislative Assembly, enacts as follows: 1. This Act amends the Compensation for Victims of Crime Act. LOI MODIFIANT LA

Section 1 of the said Act is amended by insertion of the following definition: " "Victim Services Officer" means a Victim Services Officer appointed under this Act," 4. The heading immediately preceding

section 2 of the said Act and

section 2 of the Act are repealed and the following heading and

section substituted therefor: "Victims Compensation Board 2.

(1) There is hereby established a board, to be known as the Victims Compensation Board, which shall consist of a chair and two other members appointed by the Commissioner in Executive Council.

(2) Members of the board other than the chair shall hold office at pleasure for such term, not exceeding three years, as may be designated by the Commissioner in Executive Council upon their appointment, and may be reappointed upon the expiration of such term.

(3) The chair of the board shall hold office at pleasure for a term of three years, and may be reappointed upon the expiration of such term.

(5) Two members of the board constitutes a quorum and is sufficient for the exercise of all the jurisdiction and powers of the board." 5. The following heading and

section are added immediately after

section 2 of the said Act: "Powers of the Board 2.1(1) The Commissioner in Executive Council may prescribe general directives respecting the circumstances and criteria the board must consider and give effect to when exercising its powers under this Act.

(2) Notwithstanding any other provision of this Act, the board shall comply with any general directive given by the Commissioner in Executive Council under subsection (1).

(3) The board may make bylaws regulating its own proceedings and generally for the conduct of its affairs.

(4) The board shall sit at such times as the performance of its duties and the exercise of its powers under this Act may require.

(5) The board may appoint one or more persons having special technical or other knowledge to enquire into and report on any matter before the board or in respect of which the board deems it necessary to have information." 6. Subsection 3(5) of the said Act is repealed and replaced with the following subsection (5) substituted therefor: "A victim, or a person to whom paragraph 3(l)(

e) or (

f) applies may make a claim for compensation under this Act by filing a claim in the prescribed form with the Victim Services Officer." 7. Subsection 3(7) of the said Act is amended by substituting the words "Victim Services Officer" for the words "Executive Council Member". 8. Subsection 3(8) of the said Act is repealed. 9. The following subsection is added to

section 6 of

(5) La Commission peut nommer un ou plusieurs experts en vue de faire enquête et rapport sur tout aspect relatif aux activités de la Commission dont la Commission juge nécessaire.» 6. Le paragraphe 3(5) de la même loi est abrogé et remplacé par le paragraphe qui suit: «Une victime, ou une personne visée à l'alinéa 3(l)(

e) ou 3(l)(

f) présente une demande d'indemnisation selon la formule prévue en la déposant avec l'agent de services aux victimes.» 7. Le paragraphe 3(7) de la même loi est modifiée par substitution aux mots "Executive Council Member" des mots "agent de services aux victimes". 8. Le paragraphe 3(8) de la même loi est abrogé.

(4) The board may decline to make an order for compensation if the victim fails to report the offence within a reasonable time to, or refuses reasonable cooperation with, a law enforcement agency." 10. The following heading and

section are added immediately after

section 7 of the said Act: "Victim Services Officer 7.1(1) The Executive Council Member may designate a member of the public service as a Victim Services Officer.

(2) Notwithstanding subsection 3(7) or

section 7, a Victim Services Officer may award compensation for loss of or damage to prescribed property without the need for a hearing in cases where it would be possible for the board to make such an award.

(3) The Commissioner in Executive Council may make regulations prescri-bing the property to which (2) applies." 11. Subsection 16(3) of the said Act is repealed and the following subsection substituted therefor: "

(3) The board shall cause a copy of the decision, including the reasons, to be served on the Victim Services Officer and the parties by registered mail."

Section 20 of the said Act is repealed and the following

section substituted therefor: "The board may, with respect to any hearing or other proceeding under this Act, make such order as to costs as it thinks fit, but the fees to be allowed to counsel shall not exceed such fees as may be prescribed by the Commissioner in Executive Council." 13. This Act comes into force on a day to be fixed by the Commissioner in Executive Council. adjonction du paragraphe qui suit: «

(2) Par dérogation au paragraphe 3(7) et à l'article 7, un agent de services aux victimes peut rendre une ordonnance d'idemnisation pour la perte ou le dommage matériel prévu dans un cas où la Commission pourrait rendre une telle ordonnance.

(3) Le Commissaire en conseil exécutif peut, par règlement, prévoir les pertes et les dommages matériels visés par le paragraphe (2).» 11. Le paragraphe 16(3) de la même loi est abrogé et remplacé par ce qui suit: «

(3) La Commission fait signifier une copie de leur décision et les motifs par courrier recommandé aux parties et à l'agent de services aux victimes.»

L'article 20 de la même loi est abrogé et remplacé par ce qui suit: «La Commission peut rendre l'ordonnance qu'elle estime indiquée concernant les dépens occasionnés lors d'une audience ou d'une autre procédure visée dans la présente loi. Toutefois, les honoraires alloués à un avocat ne doivent pas dépasser les honoraires prévusl par le Commissaire en conseil exécutif.» 13. La présente loi entre en vigueur à la date fixée par le Commissaire en conseil exécutif. CHAPTER 2 'O o ECONOMIC DEVELOPMENT ACT (Assented to May 14, 1992) Recognizing that the continued development of a vigourous and sustainable economy is essential to enable the people of the Yukon to achieve their personal and combined economic and social goals; and Recognizing that the people of the Yukon expressed strong support for the sustainable development goals and objectives of the Yukon Economic Strategy and the Yukon Conservation Strategy; and Recognizing that in the Yukon Economic Strategy and the Yukon Conservation Strategy the Government of the Yukon has expressed its commitment to sustainable economic development; and Recognizing that the Yukon economy is a mixed economy comprising the contributions of government, the private sector, working people, and the traditional economy of the aboriginal people, both individually and in co-operation with one another; and Recognizing that one important role of government is to provide essential services and capital in support of the economic activities of the private sector and in support of the traditional aboriginal economy; and Recognizing that the Government of the Yukon is committed to providing services and capital in support of private sector efforts that offer new or expanded economic activity, more Yukon employment, greater economic stability, and greater equality of economic opportunity; The Commissioner of the Yukon Territory, by and with the advice and consent of the Legislative Assembly, enacts as follows:

Interpretation 1. In this Act, "Department" means the Department of Economic Development; ministère

LOI SUR LE DÉVELOPPEMENT ÉCONOMIQUE "Deputy Minister" means the Deputy Minister of Economic Development; sous-ministre "development" means any human project, industry, undertaking, enterprise or operation, or any alteration or expansion of any human project, industry, undertaking, enterprise or operation; développement "Minister" means the member of the Executive Council to whom the administration of this Act is assigned and who shall be known as the Minister of Economic Development; ministre "sustainable development" means development that meets present needs without compromising the ability to meet the needs of future generations, développement durable Department established 2.

There is hereby established a Department of the Government of the Yukon to be known as the Department of Economic Development. Minister to have charge 3.

(1) The Minister shall preside over and have charge of the Department and has power to act for and on behalf of the Department.

(2) The Department shall consist of such branches, units, and positions as may be established for it under the Public Service Act and the Financial Administration Act. Deputy minister and staff 4.

(1) In accordance with the Public Service Act there shall be appointed a Deputy Minister of Economic Development who shall be the deputy head of the Depart ment.

(2) Under the direction of the Minister and in accordance with the Public Service Act, the Deputy Minister shall perform such duties as the Minister may assign or delegate.

(3) In accordance with the Public Service Act, there may be appointed other employees required to conduct the business of the Department. Goals of the Department 5. The goals of the Department are (

(1) Est nommé, conformément à la loi intitulée Public Service Act un sousministre de l'Expansion économique qui exerce les fonctions d'administrateur général du ministère.

(2) Sous l'autorité du ministre et en conformité avec la loi intitulée Public Service Act, le sous-ministre exerce les fonctions que le ministre lui confie ou lui délègue.

(3) Les employés jugés nécessaires au bon fonctionnement du ministère sont nommés en conformité avec la loi intitulée Public Service Act. Objets du ministère 5. Le ministère a pour objets:

c) to preserve and enhance the quality of life in the Yukon by encouraging business opportunities and services to the public as nearly comparable as practicable with the rest of Canada, but consistently with the principles of sustainable development and the social and environmental values and interests of the people of the Yukon; (

d) to provide the people of the Yukon with the option to stay in the Yukon. Work of the Department 6.

(1) The work of the Department extends to and includes all matters relating to the economic development of the Territory that are not assigned to another Minister, department, branch, or agency of the Government of the Yukon.

a) encourage the development of the Yukon economy in an environmentally and socially sensitive manner;

e) participate actively in the sustainable development of Yukon natural resources;

h) promote the role of subsistence economic activities in the Yukon economy; (

i) promote the role of non-wage economic activities in the Yukon economy; (

j) maintain and implement the Yukon Economic Strategy as the comprehensive economic planning process and framework of economic development; (

k) fulfil the Department's commitments under any land claims agreements to which the Yukon Government is a signatory; (

I) work with other departments to collect information about the state of the Yukon economy, to identify appropriate indicators of economic development, and to create and publish comprehensive economic accounts; (

m) administer any economic development program established and assigned to the Minister under this or any other Act.

(3) The Commissioner in Executive Council may assign to the Minister the administration of part or all of any other Act or program under any other Act. Delegation by Minister 7.

(1) The Minister may in writing delegate to the Deputy Minister or any other officer or employee of the department any power vested in the Minister under this or any other Act; the delegation may be made subject to such limitations, conditions, and requirements as the Minister thinks necessary.

(2) An act done or a contract or other agreement made by a person in accordance with a delegation under subsection (1) has the same effect as if done or made by the Minister.

(3) Despite subsection (1), the Minister may not delegate the following powers: (

a) the power to make regulations;

m) administre tout programme de développement économique mis sur pied et dont l'administration est confiée au ministre par la présente loi ou une autre loi.

(3) Le Commissaire en conseil exécutif peut confier au ministre l'administration de tout ou

partie d'une autre loi ou d'un programme créé en vertu d'une autre loi. Délégation par le ministre 7.

(1) Le ministre peut déléguer au sous-ministre ou à tout employé du ministère tout pouvoir que lui confère la présente loi ou une autre loi.La délégation est écrite et peut être assortie des limites, restrictions, conditions et exigences que le ministre juge utiles.

(2) Un acte, un contrat ou tout autre accord conclu par une personne habilitée à ce faire en vertu d'une délégation du ministre faite aux termes du paragraphe (1) a le même effet que s'il était fait ou conclu par le ministre.

(3) Malgré le paragraphe (1), le ministre ne peut déléguer les pouvoirs suivants:

b) the power to establish committees or to appoint their members. Agreements 8.

(1) The Minister may make contracts or other agreements in respect of any matter under the Minister's administration under this or any other Act; the contracts or other agreements may be with the Government of Canada or the government of a province or territory or of another country or political subdivision of another country, or with a Yukon First Nation, a municipality, an individual, a corporation, or any other person or group.

(2) Despite subsection (1), the Commissioner in Executive Council may prescribe agreements that the Minister may not make without the Commissioner in Executive Council's approval. Committees 9.

(1) The Minister may establish one or more committees to act in an advisory, investigative, or administrative capacity, in connection with any matter related to the administration of this Act.

(2) The Minister may, with respect to any committee established under this section: (

a) establish the committee's name and functions; (

b) establish the organization and composition of the committee and appoint or provide for the appointment or election of the members and designate its chair; (

c) prescribe the term of office of the members; (

d) make rules governing the conduct of meetings and work of the committee.

(3) A committee may make rules governing the conduct of its meetings and work, but its rules are subject to rules made by the Minister.

(4) A committee established under this

section may exercise the powers and shall perform the duties and functions that the Minister approves, confers, or imposes on it.

(5) The Minister may supply a committee established under this

section with the services of members of .the public service or of consultants, experts, or professional advisers from outside the public service and with facilities

(6) The Commissioner in Executive Council may, by regulation, prescribe honorarium and travel and living expenses to be paid to members of committees established under this section, but if no other expenses are prescribed, the travel and living expenses to be paid to the members when absent from their ordinary place of residence in the performance of their work shall be the same as would be paid if they were employed in the public service. Yukon Council on the Economy and the Environment 10.

(1) The Yukon Council on the Economy and the Environment established under the Environment Act has, in addition to the powers and duties set out in that Act, the following functions, under this Act for matters related to the economy: (

a) review policy, strategic, legislative, and program initiatives and provide advice about them to the Executive Council; (

b) monitor progress on the implementation of the Yukon Economic Strategy, and evaluate the success of the actions taken in guiding environmentally sound economic development and diversification in the Yukon; (

c) encourage the development by industry, government, labour, and aboriginal and non governmental organizations of projects that demonstrate environmentally sound economic development; (

d) at the call of the Minister, arrange public symposiums on major economic issues; (

e) promote public awareness and understanding of the links between the environment and economy, and the importance of integrating economic and environmental policies and sustainable development; (

f) recommend research on the economy or links between the economy and the environment; (

g) carry out or supervise projects assigned by the Commissioner in Executive Council; au bon fonctionnement du comité.

f) recommander des études sur l'économie ou sur les rapports entre l'économie et l'environnement;

(2) Notwithstanding subsection 40(3) of the Environment Act, the nominations referred to in that subsection must be from democratically constituted organizations. Economic development programs 11.

(1) The Commissioner in Executive Council may, by regulation, establish economic development programs, prescribe their objectives, prescribe criteria for determining who is eligible to participate in them or receive benefits under them, and provide for their administration.

(2) The administration of an economic program established under subsection (1) may be assigned to another Minister and Department instead of to the Minister and Department of Economic Development and, if it is so assigned, then that Minister and the officials and employees of that department shall administer it according to the provisions of this Act.

(3) An economic development program under subsection (1) may establish incentives or preferences for individuals who are already residents of the Yukon or for businesses that already have a prescribed level of investment or other economic involvement in the Yukon. Financial assistance of programs 12.

(1) An economic development program established under

section 11 may authorize the Minister to give financial assistance if there is authority in a supply vote for the purpose for which the financial assistance is to be given.The financial assistance may be a loan, a grant, a contribution, a guarantee of principal and interest or of principal or interest, or an agreement to indemnify.

(2) In respect of financial assistance referred to in subsection (1), the Commissioner in Executive Council may make regulations (

a) prescribing the purposes for which financial assistance may be given;

e) prescribing conditions on which financial assistance is given and requiring the repayment or discontinuance of the financial assistance if the conditions are not met; (

f) providing for the payment of a loan, grant, or contribution by a lump sum or by instalments and prescribing the time or times at which the lump sum or instalments may be made; (

g) providing for the method by which a guarantee or agreement to indemnify may be given and the form the guarantee or agreement must take; (

h) governing the repayment of loans to the Minister and the indemnification of the Minister for amounts the Minister has paid under a guarantee or agreement to indemnify; (

i) prescribing what security must be given to the Minister for financial assistance given by the Minister; (

j) limiting the amount of financial assistance that may be given to a person or organization or for a purpose; and

i) prévoir le cautionnement à être donné au ministre pour recevoir l'aide financière;

j) fixer le montant maximum de l'aide financière qui peut être versée à une personne, à une organisation ou pour une fin;

k) prévoir les modalités à l'égard du bénéficiaire de l'aide pour rendre compte de l'affectation du prêt, de la subvention, de la participation ou de la somme qui fait l'objet d'une garantie ou d'une entente d'indemnisation. (

k) prescribing how a person or organization to whom financial assistance is given to account for how the loan, grant or contribution is spent or how the sum in respect of which a guarantee or agreement to indemnify was given is spent. Recourse in Case of Misrepresentation 13.

(1) The Minister is entitled to recover from any person or organization any money or other property received by the person under this Act where the delivery of the money or property was induced by a misrepresentation made by that person. Recours en cas de fausses représentations 13.

(1) The Minister may, on request, inspect any document or record relating to financial assistance given by the Department and may require the recipient of financial assistance to produce such documents and records in the recipient's possession or control and to prepare and submit a financial statement setting out details of the disposition of the assistance.

(2) No person shall obstruct the Minister or a person acting under the Minister's authority in an inspection under subsection (1).

(3) Every person who knowingly contravenes subsection (2) and every director or officer of a corporation who knowingly concurs in a contravention of subsection (2) commits an offence and is liable to a fine of up to $5,000.

(4) Despite subsection (3), where a corporation is convicted of an offence under subsection (3), the fine that may be imposed on the corporation may be up to $50,000. Facsimile signature 15.

(1) The Minister may authorize the use. of a facsimile of his or her signature and the Deputy Minister may authorize the use of a facsimile of his or her signature on any document other than an affidavit or statutory declaration.

(2) A facsimile of the signature of the Minister or the Deputy Minister affixed to a document pursuant to the Minister's or Deputy Minister's authorization under subsection (1) shall be deemed to be the signature of the Minister or Deputy Minister, respectively. Certified copies of documents 16.

The Minister or Deputy Minister or an officer or employee of the Department may certify a copy of a document that is made or issued under any Act administered by the Minister; such a certified copy of the document is admissible in evidence in any court or adjudicative tribunal and, in the absence of evidence showing the contrary, it is proof of the document and its contents without proof of the signature or official position of the person who appears to have certified it. Protection from personal liability 17.

(1) Neither the Minister, the Deputy Minister, nor any officer or employee of the Department nor anyone acting under the authority of the Minister or Deputy Examen des registres financiers 14.

an act or omission that would be a tort for which the Government would be liable in the absence of subsection (1). Special advisers 18. The Minister may engage the services of consultants, experts, or persons having special professional, technical, or other knowledge to advise the Minister or to inquire into and report to the Minister on matters under the Minister's administration. Repeals 19.

(1) The following Acts are hereby repealed: (

a) the Business Development Assistance Act; (

section 90.1 2. The said Act is amended by adding the following

section immediately after

section 90: "90.1 Every enumerator visiting a house shall advise every person present whose name they enter on the list of electors of the right to vote by special ballot and, if requested, shall leave an application in the prescribed form to vote by special ballot for each person who requests it or for whom it is requested." New

section 100.1 3. The said Act is amended by adding the following

section immediately after

section 100: "Special ballot 100.1(1) The following electors whose names appear on the list of electors in the electoral district in which they are qualified to vote may apply in the prescribed form to the returning officer to vote by special ballot: (

a) electors who are housebound; (

b) electors who are unable to vote at an advance or regular poll by reason of their employment, business, or profession; (

c) electors who are students in an educational institution which is in the Yukon but outside the electoral district in which the student is qualified to vote. LOI MODIFIANT LA

(2) Beginning on the fourteenth day after the day the writ for the election is issued, a returning officer, upon receiving an application for a special ballot, may issue a special ballot to a person whose name appears on the list of electors and who qualifies to vote by special ballot.

(3) In order to be counted, a special ballot must be returned before two o'clock in the afternoon of polling day to the returning officer of the electoral district where the elector is qualified to vote.

(4) In order to assure that the administration of voting by special ballot accords with the principles of this Act and to meet the exigencies of different situations, the chief electoral officer shall direct returning officers on how to distribute special ballot papers, how to receive and record receiving them, how to count them, and how to record that they have not been received." Amendment to

section 138 4. In

section 138 of the said Act, the expression "six o'clock to nine o'clock in the afternoon" is repealed and the expression "nine o'clock in the forenoon to nine o'clock in the afternoon" is substituted for it. New sections 156.1 to 156.3 5. The said Act is amended by adding the following sections immediately after

section 156: "Special revision 156.1 In addition to the revision of lists of qualified electors referred to in sections 138 to 156, there shall be a special revision which shall be conducted by the returning officer or assistant returning officer of each electoral district between the hours of four o'clock and eight o'clock in the afternoon of the twenty-eighth day after the writ is issued for the election. Addition of name at special revision 156.2(1) At a special revision the only change that may be made to the list of electors is the addition of a name of a qualified elector.

(2) The returning officer or assistant returning officer shall add to the list of electors the name of any person who attends the special revision and verifies by statutory declaration in the prescribed form that they are qualified to vote ; the officer shall initial the addition.

L'article 138 de la même loi est modifié par substitution, au passage "six o'clock to nine o'clock in the afternoon", du passage "nine o'clock in the forenoon to nine o'clock in the afternoon". Ajout des articles 156.1, 156.2 et 156.3 5.

La même loi est modifiée par adjonction, après l'article 156, des articles suivants: «Révision spéciale 156.1 Outre la révision de la liste des électeurs habiles à voter prévue aux articles 138 à 156, le directeur du scrutin de la circonscription électorale ou son adjoint effectue une révision spéciale entre seize heures et vingt heures le vingt-huitième jour après l'émission du décret de convocation des électeurs. Ajout d'un nom suite à la révision spéciale 156.2(1) L'ajout du nom d'un électeur habile à voter est la seule modification permise à la liste électorale lors de la révision spéciale.

(2) Le directeur du scrutin ou son adjoint inscrit sur la liste électorale le nom de toute personne qui assiste à la révision spéciale et qui atteste par une déclaration solennelle en la forme réglementaire qu'elle est habile à voter.

Section 168 of the said Act is amended by adding the following subsection: "

(2) The returning officer shall appoint a deputy returning officer who shall take mail-in ballot papers to and collect them from electors who are on the list of electors in the electoral district where they are qualified to vote but who have become prisoners on remand in a corrections centre or patients in a hospital after the close of revision hearings."

AN ACT TO AMEND THE EMPLOYMENT STANDARDS ACT (Assented to June 2, 1992)

Whereas it is recognized that employees and employers have a mutual responsibility to create a fair and equitable working relationship; And it is recognized that the purpose of employment standards legislation is to ensure that an employment contract is fair to both employees and employers by setting out minimum standards which must be adhered to; And it is further recognized that employment standards legislation should provide the means to assist employees and employers to resolve disagreements with respect to the application of the legislation to their employment contracts and to enforce the legislation where agreement between the parties is not possible; And it is acknowledged that employers and employees are best able to deal with each other when they are aware of and understand their statutory rights and obligations under the Employment Standards Act; The Commissioner of the Yukon Territory, by and with the advice and consent of the Legislative Assembly, enacts as follows: 1.

This Act amends the Employment Standards Act. 2. The following is substituted for the definition of "employer" in

section 1 of the said Act: "employer" means a person having control or direction of, or responsible for the employment of or payment of wages to, an employee and includes a former employer; employeur 3. The following is added immediately after the definition of "pay period" in

AN ACT TO AMEND THE EMPLOYMENT STANDARDS ACT

a) to whom the employee is legally married, or (

b) with whom the employee has cohabited as a couple for at least 12 months, époux 4. The following is substituted for the definition of "wages" in

section 1 of the said Act: "wages" means any monetary remuneration payable by an employer to an employee under the terms of a contract of employment, any' payment to be made by an employer to an employee under this Act, and any allowance for travel as prescribed in the regulations, but does not include gratuities, money that is paid at the discretion of the employer and that is not related to hours of work, production or efficiency, damages awarded in a wrongful dismissal action, travelling expenses, or other expenses; salaire 5. The following is substituted for the definition of "week" in

section 1 of the said Act: "week" means a period of seven consecutive days established by the employer's payroll records or determined by an employment standards officer; semaine 6. Subsection 2(2) of the said Act is repealed and the following substituted therefor:

(2) This Act binds the Government of the Yukon and applies to every employee of the Government of the Yukon

Section 7 of the said Act is repealed and the following substituted therefor: 7. Subject to this Part, no employer shall cause or permit an employee to work in excess of the standard hours of work unless the employer complies with

section 8 or

section 8.1 or the employee's hours of work are permitted under sections 9 or 10. 8. The following subsections are added immediately after subsection 8(2) of the said Act: est:

CHAPTER 5

AN ACT TO AMEND THE EMPLOYMENT STANDARDS ACT

(3) Except in an emergency, an employee who is requested to work in excess of his or her regularly scheduled shift and who has not been given notice at least twenty-four hours before the hours of work are required may refuse to work the additional hours.

(4) An employee who has been given notice to work hours in excess of his or her regularly scheduled shift at least twenty-four hours before the work is required shall work the additional hours unless the employee has an emergency in which case the employee may refuse to work the additional hours.

(5) On application of an employer or employee, the director may determine what is an emergency for the purpose of this section.

(6) The Commissioner in Executive Council may make regulations prescribing what is an emergency for the purpose of this section. 9. The following

section is added immediately after

section 8 of the said Act: Time off with pay in lieu of overtime. 8.1(1) An employee or a majority of a group of employees may as part of a collective agreement or if there is no collective agreement, in a written agreement between the employee or group of employees and the employer agree that, wholly or partly in lieu of overtime pay, the employer will provide and the employee will take time off with pay in lieu of overtime pay.

(2) An agreement referred to in subsection (1) shall be deemed to include at least the following provisions: (

a) that the employee shall receive time off calculated by multiplying the hours of overtime worked by the employee by time and a half; (

b) that the time off with pay in lieu of overtime pay shall be provided, taken and paid at the regular rate of pay at a time when the employee could have worked and received wages from his or her employer; (

c) that if time off with pay is not provided,

(3) Sauf dans les cas d'urgence, l'employé à qui il est demandé de travailler plus que son quart normal de travail et qui n'a pas été avisé au moins vingt- quatre heures avant d'effectuer des heures supplémentaires peut refuser de travailler ces heures supplémentaires.

(4) L'employé à qui il a été demandé de travailler des heures supplémentaires et qui a été avisé au moins vingt-quatre heures au préalable doit travailler ces heures à moins de se trouver dans une situation d'urgence; le cas échéant l'employé peut refuser de travailler ces heures supplémentaires.

(5) À la requête de l'employeur ou de l'employé, le directeur peut statuer sur ce qui constitue une urgence aux fins du présent article.

(6) Le Commissaire en conseil exécutif peut, par règlement, définir ce qui constitue une urgence aux fins du présent article. 9. La même loi est modifiée par adjonction, après l'article 8, de l'article suivant: Congé payé tenant lieu de temps supplémentaire 8.1(1) Un employé ou la majorité d'un groupe d'employés peut, dans le cadre d'une convention collective ou, à défaut de convention collective, dans une entente écrite avec l'employeur, convenir que l'employeur va accorder un congé payé tenant lieu, en tout ou en partie, de temps supplémentaire et que les employés prendront ce congé au même titre.

(2) L'entente prévue au paragraphe (1) est censée comprendre les dispositions minimales suivantes:

a) l'employé doit recevoir un congé tenant lieu de temps supplémentaire calculé en majorant de moitié les heures qu'il a travaillées;

b) le congé payé tenant lieu de supplémentaire est accordé, pris et payé au taux de salaire normal qui prévaut lorsque l'employé avait droit de travailler et de recevoir son salaire de son employeur;

c) dans le cas où le congé n'est pas accordé, pris et payé conformément à l'alinéa b), STATUTES OF THE YUKON 1992 3 LOIS DU YUKON 1992

d) le congé payé tenant lieu de temps supplémentaire doit être gagné par l'employé, lui être accordé, lui être payé et être pris par lui dans les douze mois qui suivent, selon ce que prévoit l'entente, ou, à défaut, avant la fin de l'année civile;

e) aucune modification à l'entente visée au paragraphe (1) ni la fin de cette entente ne prend effet sans un préavis écrit d'un mois par l'employeur ou l'employé, ou par un groupe d'employés, selon le cas, à l'autre partie.

(3) Aux fins de la présente loi:

a) un congé payé tenant lieu de salaire majoré pour du temps supplémentaire accordé par un employeur est réputé être des heures de travail;

AN ACT TO AMEND THE EMPLOYMENT STANDARDS ACT taken, and paid in accordance with paragraph (b), the employee shall be paid at the overtime rate for all the overtime hours with respect to which time off was not provided, taken or paid; (

d) that time off with pay in lieu of overtime pay shall be earned by the employee and provided, taken, and paid to the employee within a 12 month period as stated in the agreement or, where no 12 month period is stated, within a calendar year; and (

e) that no amendment or termination of the agreement referred to in subsection (1) shall be effective without at least 1 month's notice in writing by the employer or the employee or group of employees, as the case may be, to the other party to the agreement.

(3) For the purposes of this Act. (

a) time off with pay in lieu of overtime pay provided by an employer shall be treated as hours of work; and (

b) remuneration paid to an employee in respect of the time off with pay in lieu of overtime pay shall be treated as wages.

(4) For the purposes of

Part 10, time off with pay in lieu of overtime pay which is not provided, taken or paid to the employee in accordance with paragraphs 2(

c) or 2(

d) shall become wages owing to the employee at the time the employer is in breach of paragraph 2(

c) or 2(d).

(5) The employer shall provide a copy of the agreement referred to in subsection (1) to each employee affected by it.

Section 10 of the said Act is repealed and the following substituted therefor: 10.

(1) An employee or a majority of a group of employees may, as part of a collective agreement or if there is no collective agreement, in a written agreement between the employee or group of employees and the employer agree that the employee or group of employees may work a regular day of work in excess of eight hours but not in excess of 12 hours

b) toute rémunération versée à un employé à

CHAPTER 5

AN ACT TO AMEND THE EMPLOYMENT STANDARDS ACT

CHAPITRE S LOI MODIFIANT LA

LOI SUR LES NORMES D'EMPLOI provided that the total hours of work of each employee shall not exceed 80 hours in a two week period.

(2) Where under subsection (1) an employer requires or permits an employee to work in excess of 80 hours in a two week period, the employer shall pay the employee one and one-half times the employee's regular wages for all hours worked in excess of 80 hours. (3) Subsections 8(2) to (4) as modified to suit the case apply to this section. 11. Subsection 11(1) of the said Act is repealed and the following substituted therefor: 11.

(1) Except where otherwise prescribed by regulations, hours of work shall wherever practicable be so scheduled and actually worked so that each employee has at least two full days of rest in a week and wherever practicable Sunday shall be one of the normal days of rest in the week.

Section 14 of the said Act is repealed and the following substituted therefor: 14.

(1) Subject to subsection (2), where an employee works a split shift, the employer shall limit the employee's standard hours of work to the 12 hours immediately following commencement of the employee's shift.

(2) On application by the employer and on being satisfied the employee has consented to the application, the director may order a split shift which extends beyond 12 hours and which allows the employee to work standard hours at any time during the split shift in such a manner as may be prescribed in the order.

Section 15 of the said Act is repealed and the following substituted therefor: 15.

(1) An employee who considers that he or she is being required to work hours which are excessive or which are detrimental to his or her health or safety may file a complaint with the director.

(2) Where the director is satisfied after such inquiry as the director considers adequate that the maximum de 80 heures de travail de la part de chaque employé sur une période de deux semaines.

(2) Sur requête de l'employeur, ce dernier ayant l'assurance que l'employé y a consenti, le directeur peut ordonner un quart de travail discontinu qui dépasse 12 heures et qui permet à l'employé de travailler des heures régulières en tout temps durant le quart de travail discontinu, selon les modalités prévues dans l'ordonnance.

L'article 15 de la même loi est abrogé et remplacé par l'article suivant: 15.

(1) L'employé qui est d'avis que les heures qu'il lui est demandé de travailler sont excessives ou portent atteinte à sa santé ou à sa sécurité peut déposer une plainte auprès du directeur.

CHAPTER 5

AN ACT TO AMEND THE EMPLOYMENT STANDARDS ACT hours of work of an employee are excessive or are detrimental to the employee's health or safety, the director may, by order (

a) require an employer to limit the daily or weekly hours of work or both to not less than eight in a day or forty in a week; (

b) require the employer to post and keep posted a copy of the order in a conspicuous place to which all employees have ready access to read the order; and (

c) allow the employer to exceed the limit of hours of work of employees established under paragraph (

a) under such conditions and for such periods of time as the director considers appropriate.

Section 16 of the said Act is amended by substituting the expression "section 17" for the expression "section 18". 15. The following is substituted for the definition of "vacation pay" in

section 18 of the said Act: "vacation pay" means (

a) for an employee who has been employed by an employer for less than five years, four per cent of the wages of the employee during a year of employment in respect of which the employee is entitled to a vacation; or (

b) for an employee who has been employed by an employer for five or more years, six per cent of the wages of the employee during a year of employment in respect of which the employee is entitled to a vacation, congé payé 16. Subsection 19(2) of the said Act is repealed. 17. Subsection 20(1) of the said Act is repealed and the following substituted therefor: 20.

(1) Subject to this Part, an employer shall give to each employee (

a) after one year or more of employment but less than five years of employment with the employer, an annual vacation of at least

L'article 16 de la même loi est modifié par substitution, aux termes «section 18», des termes «section 17».

L'article 18 de la même loi est modifié par substitution, à la définition de «congé payé», de la définition suivante: «congé payé»

a) pour un employé au service d'un employeur depuis moins de cinq ans, quatre pour cent de son salaire durant une année d'emploi pour laquelle il a droit à un congé;

b) pour un employé au service d'un employeur depuis au moins cinq années, six pour cent de son salaire durant une année d'emploi pour laquelle il a droit à un congé, vacation pay 16. La même loi est modifiée par abrogation du paragraphe 19(2). 17. Le paragraphe 20(1) de la même loi est abrogé et remplacé par le paragraphe suivant: 20.
