Section L5 ol ttre RegulafToz is repealed. "Lots smaller than mlnimum size 28(1) In this section, "exempt lot" means a tot lhat is smaller than the minimum size permitted under

Schedule A fot the applicable zone and that (

a) existed immediately before May 12, 2OO6; ol (

b) was created under the Subdivision Act by enlarging, or by consolidating with another parcel of land, a 1ot that was itself an exempt 1ot.

(2) An exempt lot may (

a) be developed or used in accordance with the provisions of this regulation; and (

b) have its setbacks reduced by a Development Officer, without consultation, by the same percentage that it is less than the minimum size.

(3) If a lot is created under the Subtlivision Act by enlarging an exempt lot, ol bY consolidating an exempt lot with another palcel of land, the lot cleated may be smallû than the minimum size othetwise permitted." 2009/155

a) soit existait avaît le 1.2 mai 20O6;

b) soit a été créé sous le régime de Ia

Loi sur le Iotissement par agrandissement ou par sa consolidation avec une autre parcelle qui était déjà un terrain visé par une dispense.

(2) Les modalités suivantes s'appliquent à un terrain visé par une dispense :

a) il être aménagé ou utilisé conformément aux dispositions du présent règlement;

b) un agent d'aménagement Peut, sans consultation, réduire les marges de retrait selon le même rapport que celui entre sa superficie et la supedicie réglementaire.

(3) Lorsqu'un terrain est créé en vertu de la

Loi sur Ie lotissement par l'agrandissement du teûain existant ou par consolidation avec un autre terrain, 1a superficie du terrain ainsi créé peut être infédeure à la supelficie réglementaire autrement autorisée. " Mount Lorne Amendment 2009.doc
