CHAPTER 1 AN ORDINANCE TO AMEND" THE SUCCESSION DUTY ORDINANCE." (t1.uented to fllne 15,1928.) The Commissioner of the Yukon Territory, by and with the advice and consent of the Council of said Territory, enacts as follows: 1. "The Succession Duty Ordinance,"

Chapter 1 of the Ordinances of the Yukon Territory, 1923, is hereby amended by adding thereto the following sub-section imme diately after sub-section 4 of

Section 7 of the said Ordin ance: 5. 'Persoal property of a non-resident deceased person (except tangible personal property having an actual sitlls in this Territory) shall not be subject to the duty imposed by this Ordinance if a like exemption is made by the laws of the country, province, state, or territory of the deceased's residence in favour of residents of the Yukon Territory. 2. "'. ~i _:, AN ORDINANCE TO AMEND "THE ASSESSMENT ORDINANCE." (·1ssented 10 Jllne 15, 1928.) The Commissioner of the Yukon Territory, by and with the advice and consent of the Council of said Territory, enacts as follows: I.

Section 60 of the Asses::ment Ordinance, being

Chapter 5 of the Consolidated Ordinances of the Yukon Territory, 1914, is hereby repealed and the following substituted therefor: 60. \\Then any lands arid improvements become liable to be sold for rates in respect thereto unpaid the Assessor may proceed in the following manner: 1.

He shall prepare a copy of the list of lands to be sold, as authorized by this Ordinance, showing tbe respec tive owners thereof and the amounts of taxes due thereon, and shall include therein in a separate column a statement of the proportion of costs chargeable on each lot for adver tising, and the sum of fifty cents for each parcel to be sold, and shall cause said list to be posted in a conspicuous place in his office at Dawson, and in three places within the town or area fo.r four weeks before the day fixed for said sale.

He shall also pubiish once a copy of the said list in one or mere newspapers published in said town or area, and if no newspaper is published in said town or area, then in the newspaper published neare:;t thereto. The publication of t::c said list shall be at least four weeks before the day fixed for the sale. The said list shall be headed as follows:

Upon the sale of such property to such bidder the Assessor shall deliver to the purchaser a receipt for the price paid therefor in Form "G" in the second

schedule to this Ordinance. 2. The said Ordinance is further amended by repealing

Section 65 thereof and substituting the following therefor: 65. -No application for an order for confirmation of a sale of" lands or improvements for taxes made under the provisions of this Ordinance shall be heard by a judge until three months after the sale.

Notice of such application may. with the permission of· the judge, be given by one publication in a newspaper published in the town or area within which such lands arc situate, or if no newspaper is published in said town or area, then in the newspaper puh lished nearest thereto, and :it such a time in advance of the day. on which the applica'tion ,is to be made as the judge shall direct. In such notice the names of all persons appear~ ing by the records of the Land Titles Office to have any interest in the said lands or improvements shall be set forth. Form of notcc.

Any disabilities which have been placed upon licensees or premises under'the provisions of the above tw·o sections shall cease upon the coming into force of this Ordinance. Provided that any licensee whose license has been cancelled shall have no right to a refund of any portion of the fee paid therefor, and shall be subject in all respects to the general provisions of the said 11 Sale of Beer Ordinance," should he at any time make application for another license. 8. SUPPLY. 9 The Commissioner of the Yukon Territory, by and with the advice and consent of the Council of said Territory, therefore, enacts as follows: 1. From and out of the sums at the disposal of the Yuksn Council there shaH be paid and applied a further sum, not exceeding in the whole one hundred and thirty seven thousand, eight hundred and sixty-three dollars and ten cents, for defraying the several charges and expenses of the Public Service of the Yukon Territory for the year ended March 31st, 1928, as set forth in

Schedule "A" to this Ordinance; and frem and out of the sums at the rlis posal of the Yukon Council there shall be paid and applied a further sum not exceeding in the whole one thousand, five hundred and ninety-four dollars and eighty-two cents, for defraying the several charges and expenses of the Public Service of the City of Dawson for the year ended March 31 st, 1928, as set forth in

Schedule "A" to this Ordinance. 2. From and out of the funds at the disposal of the Yukon Council there shall and may be paid and applied a sum not exceeding on the whole two hundred and thirteen thousand and ninety-eight dollars and sixty-four cents, . for defraying the several charges ~nd expenses of the Public Service of the Yukon Territory for the twelve months ending March 31st, 1929, as set for.th in Schedule" B " to this Ordinance. 3.

From and out of the funds at the disposal of the Yukon Council there shall and may be paid and applied a sum not exceeding thirty-six thousand and eighty-five dollars and sixty-two cents for defraying the several charges and exp~nses of the Public Service of the City of Dawson for the twelve months ending March 31st, 1929, as set forth in Schedule" C " to this Ordinance. 4. The due application of all moneys expended shall be duly accounted for.

In the event of there being a surplus of moneys standing to the credit of any item voted for Roads, Bridges and Public 'Norks after the construction or repairs provided for have been completed to the satisfaction of the Superin tendent of \Vorks and Buildings, such surplus of moneys shall forthwith, on the acceptance of such works or repairs by the Commissioner of the Yukon Territory, be taken from said item and become part of and be added to the amount provided for contingencies to such Roads, Bridges and Public vVorks, and shall therea fter be at the disposal of the Commissioner of the Yukon Territory for Roads, Bridges and Public \"orks_ -
