(1) In this Act,

(1) Les définitions suivantes s’appliquent à la présente loi : “amendment” includes an addition to or replacement of the document being amended; « modification » “attached building ”, in relation to a bare land condominium, means a building (

a) that is constructed across a series of two or more bare land units in the bare land condominium, (

b) that contains one residential or commercial space for each bare land unit across which it is constructed, and (

c) that is constructed so that a shared wall divides each bare land unit from its adjacent bare land units; « bâtiment lié » “bare land condominium ” means a condominium the condominium plan for which is described as a condominium plan of bare land units with or without common property; « condominium de terrain nu » “bare land unit” means a unit (

a) that is shown on a condominium plan, (

b) that is defined on a horizontal plane by a plan of survey, (

a) comprend à la fois des parties privatives résidentielles et des parties privatives non résidentielles;

b) comprend à la fois des parties privatives traditionnelles et des fractions de terrain nu; b.01) comprend des parties privatives résidentielles de différents types, notamment des maisons simples, des maisons en rangées et des appartements;

c) comprend des parties privatives non résidentielles dont les propriétaires se servent ou peuvent se servir à des fins sensiblement différentes;

d) that includes space vertically above and below the boundaries of the unit; « fraction de terrain nu » “buildings” includes fixtures attached to, and infrastructure of, the buildings, and other improvements to land; « bâtiments » “bylaw” means a bylaw of a condominium corporation including any amendments to it; « règlement administratif » “common assets” means (

a) personal property held by or on behalf of a condominium corporation, (

b) real property, registered in the name of or held on behalf of a condominium corporation, that (

i) is not shown on the condominium plan, or (ii) is a unit shown on the condominium plan, or (

c) in the case of a bare land condominium with managed real property, the managed real property; « éléments d’actif communs » “common assets certificate ”, in relation to a condominium, means a certificate issued by the registrar and kept in the condominium register under

section 15, on which instruments affecting the common assets of the condominium that are real property may be registered; « certificat d’éléments d’actif communs » “common expenses” means (

a) the costs of properly maintaining, repairing and, when necessary, replacing the common property (if any) and any common assets, (

b) the costs of administering the common property (if any), any common assets and the corporation itself, such as management fees, bookkeeping, office expenses, professional fees, and the costs of holding meetings, (

c) the costs of insurance for the common property (if any) and any common assets, and for directors serving on the board, and (

d) any other costs properly incurred by a condominium corporation for achieving its objects; « dépenses communes » “common property ” means all parts of the land and buildings shown on a condominium plan that are not part of a unit, and all electrical, plumbing and other

annexe des quotes -parts de propriété » L’annexe mentionnée à l’article 10. “schedule of unit entitlement” « arpenteur » S’entend au sens de la Loi de 2015 sur les titres de biens-fonds. “surveyor” « assemblée générale » À l’égard de l’association condominiale, assemblée générale annuelle ou assemblée générale extraordinaire des personnes admises à voter de l’association. “general meeting” « association condominiale » Association constituée en vertu de la présente loi. “condominium corporation” « association »

Sauf indication contraire du contexte, toute association condominiale. “corporation” « autorité publique » Le gouvernement du Yukon, d’une municipalité ou tout autre gouvernement ou organisme prescrit comme tel par règlement. “ public authority” « avis aux fins de signification » L’avis visé à l’article 12. “notice of address for service” « avis des règlements administratifs » L’avis visé à l’article 14. “notice of bylaws” « bâtiment lié » Relativement à un condominium de terrain nu, un bâtiment qui, à la fois :

a) est construit sur une série de deux ou plusieurs condominiums de terrain nu dans le condominium de terrain nu;

b) contient au moins un espace résidentiel ou commercial pour chaque fraction de terrain nu sur lequel il est construit;

c) est construit de façon à ce qu’un mur mitoyen divise chaque fraction de terrain nu des fractions de terrain nu adjacentes. “attached building”

section 22, but does not include (

a) roads, public utilities or reserves vested in the Commissioner by virtue of subsection 20(1) of the Subdivision Act, nor (

b) lands dedicated to the public use and vested in a municipality or other government by virtue of subsection 315(6) of the Municipal Act; « parties communes » “common property certificate ” means a certificate issued by the registrar and kept in the condominium register under

section 15, on which instruments affecting the common property may be registered; « certificat des parties communes » “condominium corporation ” means a corporation created under this Act; « association condominiale » “condominium plan ” means a plan of survey that complies with

section 6 and includes (

a) an amended condominium plan referred to in

Part 10, and (

b) a plan relating to development in phases referred to in

section 6; « plan condominial » “condo fee” means the monthly installment, calculated under

section 128, by which a unit owner pays the unit’s annual assessment for (

a) its share of the common expenses, (

b) its reserve fund contribution (if any), and (

c) its contribution to any other funds established by the condominium corporation under

section 129; « charges de copropriété » “contact information ” means a residential address, mailing address and telephone number, as the context requires; « coordonnées » “conventional building unit ” means a unit shown on a condominium plan that defines a three dimensional space by reference to the floors, walls and ceilings of a building; «

partie privative traditionnelle » “converted building” means a building that (

a) existed before registration of a condominium plan that includes it, and (

section 9 and includes (

a) the

schedule of unit entitlement, (

b) the

schedule of voting rights, and (

a) who is the registered owner of the parcel shown on a condominium plan on the date that the application to create the condominium is submitted to the registrar for registration and to whom title to all of the units in the condominium plan are to be issued, or (

a) more than 50 percent of the units shown in the condominium plan; « promoteur » “electrical, plumbing and other facilities ” means all pipes, wires, cables, chutes, ducts and other facilities or systems for the passage or provision of air, water, sewage, drainage, gas, oil, electricity, telephone, radio, television, internet, garbage disposal, heating, cooling, fire suppression or other similar services; « installations de plomberie, d’électricité et autres installations » “eligible voter “ means a person who is entitled to exercise a unit’s vote under

b) a person who stands in the place of a parent to the unit owner or to whom the unit owner stands in the place of a parent, whether or not there is any degree of consanguinity between that person and the owner; « famille » “file”, when used as a verb, means (

a) to submit to the registrar a document that is to be kept in the corporate record folder for a condominium but not entered in the condominium index or registered on a certificate of title or certificate of common property, or (

b) to submit to a condominium corporation a document that is to be kept as part of the condominium corporation’s records; « deposer » “financial statements ” means statements prepared in accordance with generally accepted accounting principles that include (

a) a statement of assets and liabilities, (

b) a statement of revenues and expenses, and (

c) any other statements, information or documents respecting the financial position of a condominium corporation and the results of its operations that may be required by the regulations; « états financiers » “first directors ” means the first directors of a condominium corporation appointed by the developer as shown in (

a) the notice of first directors that forms part of an application to create a condominium, or (

b) a notice of change of first directors; « premiers administrateurs » “fixture”, in relation to a building in a condominium, means any item attached to the building, and (

a) includes any floor and wall covering and any electrical and plumbing fixture, but (

section 137; « budget provisoire » “managed real property ”, in relation to an attached building, means the following: (

a) if the condominium declaration has a description of the portions of the building that are to be managed real property, those portions, (

b) in any other case, the portions of that building that are of the types prescribed as managed real property; « bien réel administré » “management contract ” means an agreement entered into by or on behalf of a condominium corporation for the provision of management services, with or without exceptions or additional services as may be agreed, in relation to (

a) the general administration and management of the affairs of the corporation, or (

a) with both residential units and non -residential units, (

a) starts on the first day of the first month that begins after the month in which the first conveyance of a unit by a developer to a purchaser occurs, and (

b) ends on the last day of the month in which the condominium corporation’s first annual general meeting is held; « période de transition » “unanimous resolution” means a resolution (

a) passed at a general meeting by all of the votes cast by eligible voters, or (

b) passed in a written resolution signed by all eligible voters; « résolution unanime » “unit” means a unit shown on a condominium plan, which may be either (

a) a bare land unit, or (

b) a conventional building unit; «

partie privative » “unit entitlement ” of a unit means the percentage specified in the

(1) The registrar must register a condominium application if satisfied that it complies with this Act and the Land Titles Act, 2015 and the regulations made under both Acts.

a) enter the creation of the condominium corporation in the condominium corporations index and establish its corporate record folder;

b) file the notice of bylaws, notice of first directors and notice of address in the corporate record folder established for the condominium corporation;

c) register the condominium plan in the same way as a plan of survey is registered under the Land Titles Act, 2015;

d) cancel the certificate of title to the parcel shown in the condominium plan, except as to any mines and minerals comprised in it;

e) issue a separate certificate of title in the name of the developer for each unit shown on the condominium plan;
