LOI SUR L’ADOPTION ADOPTION REGULATIONS RÈGLEMENT SUR L’ADOPTION The Commissioner, on the recommendation of the Minister, under subsection 76(1) of the Adoption Act and every enabling power, makes the Adoption Regulations. The notice referred to in subparagraph 6(1)(b)(

i) of the Act by a relative of the child of the proposed placement must be in a form approved by the Director. 2. L’avis exigé par le sous-alinéa 6(1)b)(

(1) Where a relative of the child wishes to give notice under subparagraph 6(1)(b)(

i) of the Act less than 45 days before the date on which the proposed placement is to occur, the person must in writing request the Director to agree to reduce the period of giving notice to a date specified in the request and give the reasons for the request. 3.

(1) La personne apparentée à l’enfant qui souhaite donner l’avis exigé par le sous-alinéa 6(1)b)(

(2) The Director shall, without delay, notify the person making the request of whether or not the Director agrees under subsection 6(3) of the Act to reduce the period of giving notice and, if the Director agrees, the date by which notice must be given.

(3) Notice by the Director under subsection (2) may be by any method and may be oral or in writing, but where oral notice is given it must be followed by written notice as soon as is reasonably practicable.

(1) An application referred to in subsection 7(1) of the Act consists of (

a) an application form approved by the Director; and 4.

(2) A person or, in the case of a joint application, the persons who wish to make an application under subsection 7(1) of the Act to obtain the Director’s written approval of the proposed placement of a child with that person or persons must request an application form and a request form for a criminal records check referred to in subsection (5) from (

a) the Director, who shall refer the request to an Adoption Worker; or (

b) an Adoption Worker.

(2) La personne ou, dans le cas d’une demande d’adoption conjointe, les personnes qui souhaitent présenter la demande visée au paragraphe 7(1) de la Loi afin d’obtenir l’autorisation écrite du directeur relativement au placement proposé d’un enfant demandent une formule de demande ainsi qu’une formule de demande en vue de la vérification du casier judiciaire mentionnée au paragraphe (5) :

a) soit au directeur, lequel fait parvenir la demande à un préposé à l’adoption;

b) soit à un préposé à l’adoption.

(3) A request under subsection (2) may be made orally or in writing.

(3) La demande visée au paragraphe (2) peut être présentée oralement ou par écrit.

(4) An applicant or the joint applicants, as the case may be, must complete the application form and attach to it or include the following: (

a) a certificate of the applicant’s or each joint applicant’s birth; (

b) where the applicant is married, a certificate of marriage; (

c) in the case of a joint application, where the joint applicants are married, the certificate of marriage of the joint applicants; (

d) where the applicant is co-habiting outside marriage, a statutory declaration setting out the period of co-habitation and whether the applicant and his or her spouse are together the parents of a child; (

e) in the case of a joint application, where the joint applicants are co-habiting outside marriage, a statutory declaration setting out the period of co-habitation and whether the joint applicants are together the parents of a child; (

f) where the applicant or a joint applicant is divorced, a certificate issued under subsection 12(7) of the Divorce Act (Canada); (

g) where the applicant or a joint applicant is a surviving spouse, the certificate of death of any previous spouse; (

h) where the applicant or a joint applicant has changed his or her name, proof satisfactory to the Director of the change of name; (

i) a photograph of the applicant and his or her children and parents;

(4) Le demandeur ou les co-demandeurs remplissent la formule de demande et y joignent ou y incluent :

a) le certificat de naissance du demandeur ou de chacun des co-demandeurs;

b) si le demandeur est marié, son certificat de mariage;

c) dans le cas d’une demande d’adoption conjointe, si les co-demandeurs sont mariés, leur certificat de mariage;

d) si le demandeur cohabite avec quelqu’un en dehors des liens du mariage, une déclaration solennelle indiquant la période de cohabitation et si le demandeur et son conjoint sont ensemble les parents d’un enfant;

e) dans le cas d’une demande d’adoption conjointe, si les co-demandeurs cohabitent en dehors des liens du mariage, une déclaration solennelle indiquant la période de cohabitation et si les co-demandeurs sont ensemble les parents d’un enfant;

f) si le demandeur ou l’un des co- demandeurs est divorcé, un certificat délivré en vertu du paragraphe 12(7) de la

Loi sur le divorce (Canada);

g) si le demandeur ou l’un des co- demandeurs est un conjoint survivant, le certificat de décès de tout conjoint antérieur;

h) si le demandeur ou l’un des co- demandeurs a changé de nom, une preuve du changement de nom satisfaisante pour le directeur;

i) une photographie du demandeur, de ses 2

j) in the case of a joint application, a photograph of the joint applicants, their children together or separately, and their parents; (

k) the names of three persons who are not relatives of the applicant or joint applicants and can be contacted to provide a letter of recommendation of the applicant or of the joint applicants in support of the application; (

l) a copy of the request form for a criminal records check referred to in subsection (5) that the applicant or joint applicants, as the case may be, submitted to the Royal Canadian Mounted Police. enfants et de ses parents;

(5) An applicant or the joint applicants, as the case may be, must arrange for the Royal Canadian Mounted Police to conduct a criminal records check of the applicant or joint applicants and all adults living with the applicant or joint applicants, and for the results of the check to be sent directly to the Adoption Worker referred to in subsection (2).

(6) The results of the criminal records check referred to in subsection (5) and the letters of recommendation provided by the persons referred to in paragraph (4)(

k) shall be deemed to have been attached to the application form as documents under subsection (4).

(1) Where a person wishes to submit an application and the fee under subsection 7(1) of the Act less than 45 days before the date on which the proposed placement is to occur, the person must in writing request the Director to agree to reduce the period for submission to a date specified in the request and give the reasons for the request. 5.

(1) La personne qui souhaite présenter la demande et acquitter le droit visés au paragraphe 7(1) de la Loi moins de 45 jours avant la date du placement proposé demande par écrit au directeur de consentir à réduire le délai prévu à cette fin et de permettre que la demande soit présentée et que le droit soit acquitté au plus tard à la date que précise la demande faite en vertu du présent paragraphe, tout en lui mentionnant les motifs de celle-ci.

(2) The Director shall, without delay, notify the person making the request of whether or not the Director agrees under subsection 7(2) of the Act to reduce the period for submitting the application and the fee and, if the Director agrees, the date by which the application and fee must be submitted.

(3) Notice by the Director under subsection (2) may be by any method and may be oral or in writing, but where oral notice is given it must be followed by written notice as soon as is reasonably practicable.

(1) An application under subsection 7(11) of the Act for a review of a decision of the Director made under subsection 7(10) or (10.1) of the Act must be in writing and set out the reasons of the applicant or joint applicants, as the case may be, for requesting the review. 6.

(1) La demande visée au paragraphe 7(11) de la Loi et ayant pour objet la révision de la décision prise par le directeur en application du paragraphe 7(10) ou (10.1) de la Loi est présentée par écrit et indique les motifs qu’invoquent le demandeur ou les co- demandeurs pour demander la révision.

(2) An application may be submitted to the Minister by mail, fax or personal delivery.

(2) La demande peut être présentée au ministre par la poste, par télécopieur ou par remise en mains propres.

(3) A review shall be conducted in accordance with the rules of natural justice.

(3) La révision se déroule en conformité avec les règles de justice naturelle.

(4) In conducting a review, the designated person or persons (

a) may have full access to the Director’s file on the applicant or joint applicants, as the case may be, respecting the application under subsection 7(1) of the Act and to all information considered by the Director in making the decision under review; (

b) shall review all information considered by the Director in making the decision under review; and (

c) shall share all information obtained under paragraph (a), reviewed under paragraph (

b) or obtained through any inquiries under subsection 7(13) of the Act relating to the decision under review with the Director and the applicant or joint applicants, as the case may be, and shall provide each with an opportunity to respond to the information and specify the time within which to respond. (4) Au moment de la révision, la ou les personnes désignées :

a) peuvent avoir accès au dossier que possède le directeur au sujet du demandeur ou des co-demandeurs en ce qui a trait à la demande visée au paragraphe 7(1) de la Loi et à tous les renseignements que le directeur a pris en considération lorsqu’il a pris la décision qui fait l’objet de la révision;

b) réexaminent les renseignements que le directeur a pris a considération lorsqu’il a pris la décision qui fait l’objet de la révision;

c) partagent les renseignements obtenus en vertu de l’alinéa a), réexaminés en vertu de l’alinéa b) ou obtenus grâce aux enquêtes effectuées en vertu du paragraphe 7(13) de la Loi relativement à la décision qui fait l’objet de la révision avec le directeur et le demandeur ou les co-demandeurs, donnent à chacune de ces personnes la possibilité de faire connaître son point de vue au sujet de ces renseignements et indiquent le délai accordé à cette fin. DEPARTMENTAL ADOPTIONS ADOPTIONS ADMINISTRATIVES Application for Departmental Adoption Demande d’adoption administrative 7.

(1) An application referred to in subsection 15(1) of the Act consists of (

a) an application form approved by the Director; and (

b) all applicable documents and material listed in subsection (4). 7.

(1) La demande visée au paragraphe 15(1) de la Loi comporte :

a) une formule de demande approuvée par le directeur;

b) les documents et les éléments applicables énumérés au paragraphe (4).

(2) A person or, in the case of a joint application, the persons who wish to make an application under subsection 15(1) of the Act to adopt a child through a departmental adoption must request an application form and a request form for a criminal records check referred to in subsection (5) from (

a) the Director, who shall refer the request to an Adoption Worker; or (

b) an Adoption Worker.

(2) La personne ou, dans le cas d’une demande d’adoption conjointe, les personnes qui souhaitent présenter la demande visée au paragraphe 15(1) de la Loi afin d’adopter un enfant par voie d’adoption administrative demandent une formule de demande ainsi qu’une formule de demande en vue de la vérification du casier judiciaire mentionnée au paragraphe (5) :
