LOI SUR LES QUESTIONS JURIDIQUES Reference of questions 1. The Minister may refer to the Supreme Court for hearing and consideration any matter that the Minister thinks fit to refer, and the Supreme Court shall hear and consider the matter referred to it. 1. The Supreme Court shall certify to the Minister its opinion on the matter referred, with the reasons for the opinion, and the opinion shall be given in the same manner as in the case of a judgment in an ordinary action. 2. La Cour suprême communique au ministre son avis certifié et motivé sur la question qui lui a été renvoyée. Cet avis est donné de la même manière que dans le cas d’un jugement rendu dans une action ordinaire. Opinion de la Cour suprême Notice to Attorney General of Canada 3. Where the matter relates to the validity of

an Act or any provision of

an Act, whether enacted before, on or after March 5, 1982, the Minister shall notify the Attorney General of Canada of the hearing in order that the Attorney General may be heard if the Attorney General sees fit. 3. Si la question porte sur la validité d’une loi ou d’une de ses dispositions adoptée avant le mars ou après cette date, le ministre avise le procureur général du Canada de l’audition afin qu’il puisse, s’il le juge à propos, être entendu. a) any person interested, or (

b) where there is a class of persons interested, any one or more persons as representatives of that class, shall be notified of the hearing, and those persons shall be entitled to be heard. 4. La Cour suprême peut ordonner que soient avisés de l’audition et aient le droit d’être entendus :

a) les personnes intéressées;

The opinion of the Supreme Court shall be deemed to be a judgment of the Supreme Court and an appeal lies from the opinion as in the case of a judgment in an action. 5. (1) Where a matter to be referred to the Supreme Court under this Act relates to questions arising out of an agreement between the Government of Canada and the Government of the Northwest Territories that provides for a reference to the Supreme Court to hear, consider and determine questions arising out of the agreement, the form and terms of reference shall be determined as provided in the agreement, and if no such provision is made, the form and terms of reference shall be (

a) those that are agreed upon by the parties to the agreement, or (

b) where the parties cannot agree, those that are determined by the Supreme Court on the application of either party. 6.

(1) Si la question à renvoyer à la Cour suprême en conformité avec la présente loi porte sur des matières découlant d’un accord entre le gouvernement du Canada et celui des Territoires du Nord-Ouest qui prévoit de soumettre au jugement de la Cour suprême les matières en découlant, la forme et les modalités du renvoi sont celles que prévoit l’accord. Si aucune disposition n’est prévue dans l’accord, la forme et les modalités sont :

a) celles sur lesquelles les parties s’entendent;

b) si les parties ne peuvent s’entendre, celles que fixe la Cour suprême à la demande de l’une ou l’autre des parties. Accord sur le renvoi Rights of Attorneys’ General to appear

(2) The Attorney General of Canada and the Attorney General of any province or territory that has entered into an agreement of a similar nature and having similar purposes to the agreement referred to in subsection (1) may appear before the Supreme Court

Income Tax Collection Agreement Questions Act 7. Notwithstanding sections to of this Act, the Income Tax Collection Agreement Questions Act remains in force in respect of any matter that relates to questions arising out of the collection agreement between the Government of Canada and the Government of the Northwest Territories entered into under the Income Tax Act and no such matter shall be referred to the Supreme Court by virtue of this Act. 7. Par dérogation aux articles 1 à 6 de la présente loi, la

Loi sur les questions touchant l’accord de perception de l’impôt sur le revenu reste applicable à toute question relative à l’accord de perception entre le gouvernement du Canada et celui des Territoires du Nord-Ouest, conclu sous le régime de la Loi de l’impôt sur le revenu. Aucune question de cette nature ne peut être renvoyée à la Cour suprême en vertu de la présente loi. L.T.N.-O. 1995, ch. 11, art. 29.
