LOI SUR LA DÉSIGNATION PROFESSIONNELLE EN GESTION DE LA CHAÎNE D’APPROVISIONNEMENT The Commissioner of the Northwest Territories, by and with the advice and consent of the Legislative Assembly, enacts as follows: La commissaire des Territoires du Nord-Ouest, sur l’avis et avec le consentement de l’Assemblée législative, édicte :

Definitions 1. In this Act, "Association" means the Supply Chain Management Association Northern T erritories (SCMANT); (association) "designated professional" means a person who (

a) is a member in good standing of the Association, and (

b) holds a valid Supply Chain Management Professional Designation from the Association. (professionnel désigné) 1. (Association) «professionnel désigné» Personne qui, à la fois :

a) est membre en règle de l’association;

b) est titulaire d’une désignation valide en gestion de la chaîne d’approvisionnement d e l ’ a s s o c i a t i o n . (designated professional) Définitions Only designated professional may use designation 2.

(1) Subject to subsection (2), no person shall use any of the following designations or abbreviations, unless the person is a designated professional: ( a ) "Supply Chain Management Professional" or "S.C.M.P."; (b) "professionnel en gestion de la chaîne d’approvisionnement" or "PGCA"; (c) "Certified Professional Purchaser" or "C.P.P."; (d) "acheteur professionnel agréé" or "APA". 2.

(1) Sous réserve du paragraphe (2), il est interdit à quiconque d’utiliser l’une ou l’autre des désignations ou abréviations suivantes, à moins que la personne ne soit un professionnel désigné :

a) «Supply Chain Management Professional» ou «S.C.M.P.»;

b) «professionnel en gestion de la chaîne d’approvisionnement» ou «PGCA»;

c) «Certified Professional Purchaser» ou «C.P.P.»;

d) «acheteur professionnel agréé» ou «APA». Usage de la désignation réservé au professionnel désigné Exception (2) Subsection (1) does not prohibit a person who is not a designated professional from using the abbreviation S.C.M.P., PGCA, C.P.P. or APA if the person is not engaged in supply chain management.

(2) Le paragraphe (1) n’a pas pour effet d’interdire à la personne qui n’est pas un professionnel désigné d’utiliser l’abréviation S.C.M.P., PGCA, C.P.P. ou APA dans la mesure où elle n’exerce pas la gestion de la chaîne d’approvisionnement. Exception Right not affected 3. For greater certainty, not hing in this Act affects the right of a person who is not a designated professional to engage in supply chain management. 3. Il est entendu que la présente loi ne porte pas atteinte au droit d’une personne de travailler en gestion de la chaîne d’approvisionnement si celle-ci n’est pas un professionnel désigné.

Protection des droits Offence 4. Every person who contravenes this Act is guilty of an offence and liable on

summary conviction to a fine not exceeding $1000. 4. Quiconque contrevient à la présente loi est coupable d’une infraction et encourt, sur déclaration de culpabilité par procédure

sommaire, une amende maximale de 1 000 $. Infraction Evidence 5. In a prosecution under this Act, a certificate of the President or the Secretary of the Association that states that a person is or is not a designated professional is admissible in evidence as proof, in the absence of evidence to the contrary, of the statements contained in the certificate, without proof of the office or signature of the President or Secretary. 5.

Dans une poursuite pour toute infraction visée à la présente loi, le certificat du président ou du secrétaire de l’association, qui confirme ou infirme la qualité de professionnel désigné d’un individu, est admissible en preuve et, sauf preuve contraire, fait foi de son contenu sans qu’il ne soit nécessaire de prouver la fonction ou la signature du président ou du secrétaire.
