LOI SUR L’ORGANISATION JUDICIAIRE FEES AND ALLOWANCES REGULATIONS RÈGLEMENT SUR LES HONORAIRES, DROITS ET INDEMNITÉS The Commissioner, on the recommendation of the Minister, under

section 83 of the Judicature Act and every enabling power, makes the Fees and Allowances Regulations. Le commissaire, sur la recommandation du ministre, en vertu de l’article 83 de la

Loi sur l’organisation judiciaire et de tout pouvoir habilitant, prend le Règlement sur les honoraires, droits et indemnités. Amounts Payable to Interpreters and Translators Montants payables aux interprètes et aux traducteurs 1.

(1) Subject to subsection (3), a person who requires an interpreter for the hearing of a civil action or proceeding in the Supreme Court or the Territorial Court shall pay the interpreter the applicable fee set out in

Schedule A. 1.

(1) Sous réserve du paragraphe (3), la personne qui requiert les services d’un interprète pour l’instruction d’une poursuite ou d'une instance civile devant la Cour suprême ou la Cour territoriale paie à ce dernier les honoraires applicables fixés à l’annexe A.

(2) Subject to subsection (3), if an interpreter is required for the hearing of a criminal action or proceeding in the Supreme Court or the Territorial Court, the court shall pay the interpreter the applicable fee set out in

Schedule A.

(2) Sous réserve du paragraphe (3), si les services d'un interprète sont requis pour l’instruction d’une poursuite ou d'une instance criminelle devant la Cour suprême ou la Cour territoriale, le tribunal paie à l’interprète les honoraires applicables fixés à l’annexe A.

(2.1) Notwithstanding subsection (2) but subject to subsection (3), the Director of Court Services or, if authorized by the Director, a clerk of the court may increase the amount of the fee payable to an interpreter in respect of an action or proceeding to an amount not exceeding $400 each day, if the Director or the clerk, as the case may be, considers it necessary and appropriate to increase the fee.

(2.1) Par dérogation au paragraphe (2), mais sous réserve du paragraphe (3), le directeur des services judiciaires ou un greffier du tribunal que le directeur autorise, peut augmenter le montant payable à un interprète relativement à l’action ou à l’instance, jusqu’à un maximum de 400 $ par jour, si le directeur ou le greffier, selon le cas, estime nécessaire et indiqué d’augmenter l’honoraire.

(3) The fees set out in

Schedule A are not payable (

a) to an interpreter who is employed as an interpreter or translator by the Government of the Northwest Territories, if his or her services are provided in the course of that employment; or (

b) for services that are provided under a contract with the Government of the Northwest Territories for the provision of

interpretation services.

(3) Les honoraires fixés à l’annexe A ne s’appliquent pas, selon le cas :

a) à l’interprète qui, au service du gouvernement des Territoires du Nord- Ouest à

titre d’interprète ou de traducteur, est appelé à fournir ses services dans le cadre de son travail;

b) aux services fournis en vertu d’un contrat passé avec le gouvernement des Territoires du Nord-Ouest pour la fourniture de services d’interprétation.

Schedule A, “certified interpreter” means an individual who has been certified as an interpreter by the Department of Justice or has successfully completed an interpreter training course delivered by Aurora College. R-113-98,s.2,3; R-049-2012,s.2,3.
