CHANGE OF NAME ACT

LOI SUR LE CHANGEMENT DE NOM CHANGE OF NAME REGULATIONS RÈGLEMENT SUR LE CHANGEMENT DE NOM The Commissioner, on the recommendation of the Minister, under

section 23 of the Change of Name Act and every enabling power, makes the Change of Name Regulations. Le commissaire, sur la recommandation du ministre, en vertu de l’article 23 de la

(1) For the purposes of subsection 3(3) of the Act, a person who applies to change their name to a single name shall submit to the Registrar General (

a) a copy of a birth certificate or a certified copy of a birth registration statement with a single name issued by the Registrar General in respect of the applicant or a person who is related lineally to the applicant; (

b) a copy of a change of name certificate with a single name issued by the Registrar General in respect of the applicant or a person who is related lineally to the applicant; (

c) a copy of a document that is equivalent to a document referred to in paragraph (

a) or (

b) issued by (

i) a government of a province or another territory, or (ii) a government of a jurisdiction outside Canada; (

d) a certified copy of a valid immigration document with a single name issued by the Government of Canada under the Immigration and Refugee Protection Act (Canada) in respect of the applicant or a person who is related lineally to the applicant; or (

e) a statement from one of the following third parties confirming that the traditional culture of which the applicant is a member has a single naming practice: (

i) an officer of a non-profit organization or charity, registered in Canada, that represents the traditional culture, (ii) a leader or other person able to represent an Aboriginal organization that represents the traditional culture, (iii) a person who is from an Aboriginal 2.

d) une copie certifiée conforme d’un document d’immigration valide avec indication d’un nom unique délivré par le gouvernement du Canada en vertu de la

Loi sur l’immigration et la protection des réfugiés (Canada) à l’égard du requérant ou d’une personne ayant des liens de parenté en ligne directe avec le requérant;

e) une attestation, de l’une ou l’autre des tierces parties ci-après, confirmant que la culture traditionnelle à laquelle appartient le requérant a pour pratique de donner un nom unique : (

i) un représentant officiel d’un organisme sans but lucratif ou d’un organisme caritatif, enregistré au Canada, qui représente la culture 1

community that represents the traditional culture and who is recognized as an Elder by the community, (iv) a consul of a nation that represents the traditional culture, (

(3) A statutory declaration completed under subsection (2) must include a statement that (

a) the translator understands the language of the translated document and the language of the original document; and (

b) the translator is of the opinion that the translation is complete and correct.

(1) For the purposes of subsection 3(3) of the Act, a person who applies to change the name of a child in their lawful custody to a single name shall submit to the Registrar General (

a) a copy of a birth certificate or a certified copy of a birth registration statement with a single name issued by the Registrar General in respect of the child or a person who is related lineally to the child; (

b) a copy of a change of name certificate with a single name issued by the Registrar General in respect of the child or a person who is related lineally to the child; (

c) a copy of a document that is equivalent to a document referred to in paragraph (

a) or (

b) issued by (

i) an officer of a non-profit organization or charity, registered in Canada, that represents the traditional culture, (ii) a leader or other person able to represent an Aboriginal organization that represents the traditional culture, (iii) a person who is from an Aboriginal community that represents the traditional culture and who is recognized as an Elder by the community, (iv) a consul of a nation that represents the traditional culture, (

v) an academic with expertise in the traditional culture or in naming practices or a related field who is affiliated with a college or university. l’enfant;

a) the person’s full present and proposed names; (

b) the person’s current address, phone number and date of birth; (

c) confirmation of the spousal relationship, including the date on which the spousal relationship commenced; (

d) confirmation of the person’s understanding that the declaration does not confer any legal rights or responsibilities other than the right to use the surname of a spouse. R-058-2017,s.2. 2.2. Schedule A and must include the following information: (

a) the person’s full present name; (

b) the surname the person intends to resume using; (

c) the person’s current address, phone number and date of birth; (

d) confirmation of the breakdown of the spousal relationship, including the date on which the spouses started living separate and apart; (

e) confirmation of the person’s understanding that the declaration does not take the place of a separation or divorce agreement and is solely for the purpose of the resumption of use of a surname. 3. a) and (

b) of the Act do not apply to a person who (

a) is a protectee under the Witness Protection Program established by the Witness Protection Program Act (Canada); or (

b) is assuming a new identity under a program established by the Government of Canada to change the identities of victims of abuse. 4. Les alinéas 6(1)

(1) The prescribed form of the written consent referred to in paragraphs 7(4)(a), (

(1) The prescribed form of the statutory declaration referred to in subsection 9(4) of the Act is set out in Form 5 of

a) confirmation of the person’s understanding that the Registrar General will notify authorities of the change of name in accordance with the Act and these regulations; (

b) the full present and former names and places of birth of the person’s parents. 6.

(2) If a person is applying to change their name to a single name, the statutory declaration referred to in subsection 9(4) of the Act must include the following information, in addition to the information listed under that subsection of the Act and under subsection (1) above: (

a) confirmation that the applicant is a member of a traditional culture that has a single naming practice; (

b) the name of the traditional culture; (

c) confirmation that the requested single name was determined in accordance with the traditional culture.

(2) Si une personne demande de changer son nom pour un nom unique, la déclaration solennelle visée au paragraphe 9(4) de la Loi doit inclure, en plus des renseignements énoncés dans ce paragraphe et de ceux énoncés au paragraphe (1), les renseignements suivants :

(3) If a person is applying to change the name of a child in their lawful custody to a single name, the statutory declaration referred to in subsection 9(4) of the Act must include the following information, in addition to the information listed under that subsection of the Act and under subsection (1) above: (

a) confirmation that either the applicant or the child is a member of a traditional culture that has a single naming practice; (

b) the name of the traditional culture; (

c) confirmation that the requested single name was determined in accordance with the traditional culture.

(3) Si une personne demande de changer le nom d’un enfant dont elle a la garde légitime pour un nom unique, la déclaration solennelle visée au paragraphe 9(4) de la Loi doit inclure, en plus des renseignements énoncés dans ce paragraphe et de ceux énoncés au paragraphe (1), les renseignements suivants :

(4) An applicant shall submit with a change of name application, in respect of each person for whom a change of name is requested, in addition to the information, evidence and supporting material listed in subsection 9(5) of the Act, (

a) documentation proving residency; and (

b) where the applicant anticipates that the Registrar General will decline to publish notice of the change of name of the person under paragraph 14(4)(

b) of the Act, documentation proving common usage of the name applied for by the person. R-058-2017,s.3; R-011-2025,s.2,3.

(1) The prescribed form of a change of name certificate referred to in subsection 13(1) of the Act is set out in Form 6 of

Schedule A and must include the following information: (

a) the person’s full newly acquired and former names; (

b) the person’s date of birth; (

c) the registration date and number of the change of name certificate. 7.

(2) The prescribed form of an application for a duplicate change of name certificate referred to in subsections 13(2) and (3) of the Act is set out in Form 7 of

Schedule A and must include the following information: (

a) the applicant’s full present name; (

b) the applicant’s current address and phone number; (

c) the details of the change of name certificate for which a duplicate is being requested, including, (

i) the former name of the person for whom the change of name certificate was issued, (ii) the present name of the person for whom the change of name certificate was issued, (iii) the date of birth of the person for whom the change of name certificate was issued, (iv) the date the change of name certificate was registered.
