LOI SUR L’ACCORD SUR LES REVENDICATIONS TERRITORIALES ET L’AUTONOMIE GOUVERNEMENTALE DU PEUPLE TÅÎCHÔ

Whereas the Tåîchô is an aboriginal people of Canada that has traditionally used and occupied lands in and adjacent to the Northwest Territories from time immemorial;

Whereas the Constitution Act, 1982 recognizes and affirms the existing aboriginal and treaty rights of the aboriginal peoples of Canada;

Whereas the Tåîchô, the Government of the Northwest Territories and the Government of Canada negotiated a land claims and self-government agreement in order to define and achieve certainty in respect of rights of the Tåîchô relating to lands, resources and self-government;

Whereas the Tåîchô approved the Tåîchô Agreement by a vote held on June 26 and 27, 2003;

Whereas the Tåîchô, the Government of the Northwest Territories and the Government of Canada signed the Tåîchô Agreement on August 25, 2003;

Whereas the Tåîchô Agreement provides that it will be a land claims agreement within the meaning of

section 35 of the Constitution Act, 1982 and that approval by the Legislative Assembly of the Northwest Territories is a condition precedent to the validity of the agreement; The Commissioner of the Northwest Territories, by and with the advice and consent of the Legislative Assembly, enacts as follows: Attendu : que le peuple Tåîchô est un peuple autochtone du Canada qui, de temps immémorial, a traditionnellement utilisé et occupé des terres dans les Territoires du Nord-Ouest et des terres contiguës; que la Loi constitutionnelle de 1982 reconnaît et confirme les droits existants — ancestraux ou issus de traités — des peuples autochtones du Canada; que le peuple Tåîchô et les gouvernements des Territoires du Nord-Ouest et du Canada ont négocié un accord de revendications territoriales et d’autonomie gouvernementale en vue de déterminer en toute certitude les droits du peuple Tåîchô relatifs aux terres, à leurs ressources naturelles et à l’autonomie gouvernementale; que le peuple Tåîchô a, par un vote tenu les 26 et 27 juin 2003, autorisé la conclusion de l’ Accord Tåîchô; que le peuple Tåîchô et les gouvernements des Territoires du Nord-Ouest et du Canada ont signé l’Accord Tåîchô le 25 août 2003; que l’ Accord Tåîchô stipule qu’il constitue un accord sur des revendications territoriales selon les termes de l’article 35 de la Loi constitutionnelle de 1982 et que son approbation par l’Assemblée législative des Territoires du Nord-Ouest est un préalable à sa validité, le commissaire des Territoires du Nord-Ouest, sur l’avis et avec le consentement de l’Assemblée législative, édicte :

INTERPRETATION DÉFINITIONS

Definitions 1.

(1) In this Act, "Tåîchô Agreement " means the Land Claims and Self-Government Agreement among the Tåîchô and the Government of the Northwest Territories and the Government of Canada, signed on August 25, 2003, including any amendments made to it from time to time; (Accord Tåîchô) 1.

"Tåîchô Government" means the government of the Tåîchô First Nation established in accordance with the Tåîchô Agreement; (gouvernement tåîchô) "Tåîchô law" means a law enacted by the Tåîchô Government. (3) The Tåîchô Agreement may be used as an aid in interpreting this Act or the regulations if there is any doubt as to the meaning of one of its provisions.

(1) In the case of any inconsistency or conflict between an enactment and the Tåîchô Agreement, the Tåîchô Agreement prevails to the extent of the inconsistency or conflict. 3.

(1) The Tåîchô Agreement is approved, given effect and declared valid, and has the force of law. 4.

(2) For greater certainty, any person or body may exercise the powers, rights, privileges and benefits conferred on the person or body by the Tåîchô Agreement and shall perform the duties and is subject to the liabilities imposed on the person or body by the Tåîchô Agreement.

(3) For greater certainty, the Tåîchô Agreement is binding on, and can be relied on, by persons and bodies that are not parties to it.

(1) The Minister shall, by order, identify any personal property, including cash, assets and liabilities, that is to be transferred to the Tåîchô Government by the Government of the Northwest Territories under the Tåîchô Agreement. 5.

(2) The order referred to in subsection (1) may include any personal property that was transferred to the Government of the Northwest Territories by the Government of Canada, or by a band or a corporation held by a band, for the purpose of being transferred on their behalf to the Tåîchô Government under the Tåîchô Agreement.

(3) The Tåîchô Government shall hold title to any property identified in the order referred to in subsection (1) on the date this Act comes into force, unless the order provides for the vesting of title at a later date.

(1) If a security interest was registered before the date this Act comes into force in the Personal Property Registry under the Personal Property Security Act for personal property that has vested in the Tåîchô Government under the Tåîchô Agreement, the Tåîchô Government shall, without delay after the date of the vesting, send a written notice to the holder of the security interest advising the holder of the vesting of title. 6.

(2) The Registrar of Motor Vehicles may cancel or modify an entry in the registry established under the Motor Vehicles Act for any motor vehicle that has vested in the Tåîchô Government under the Tåîchô Agreement, if any of the information in the registry must be changed as a result of the vesting.

(1) Judicial notice shall be taken of the Tåîchô Agreement and the Tåîchô Tax Treatment Agreement. 9.

(2) A copy of the Tåîchô Agreement or the Tåîchô Tax Treatment Agreement published by the Queen’s Printer of Canada is evidence of that agreement, and a copy purporting to be published by the Queen’s Printer of Canada is deemed to be so published, unless the contrary is shown.

(1) If, in any judicial or administrative proceeding, an issue arises in respect of the

interpretation, validity or applicability of the Tåîchô Agreement, this Act or the regulations or any Tåîchô law, the issue shall not be decided until the party raising the issue has properly served notice on the Attorney General of the Northwest Territories, the Attorney General of Canada and the Tåîchô Government. 11.

(2) The notice required under subsection (1) must (

a) describe the judicial or administrative proceeding in which the issue arises; (

b) state whether the issue arises in respect of the matters referred to in subsection (1); (

c) state the day on which the issue is to be argued; (

d) give particulars necessary to show the point to be argued; and (

e) be served at least 14 days before the day of argument, unless the court or tribunal authorizes a shorter period.

(3) In any judicial or administrative proceeding to which subsection (1) applies, the Attorney General of the Northwest Territories, the Attorney General of Canada and the Tåîchô Government may appear and participate in the proceeding as parties with the same rights as any other party.

(4) For greater certainty, subsections (2) and (3) do not require that an oral hearing be held, if one is not otherwise required.

The Commissioner in Executive Council may, on the recommendation of the Minister, make regulations for the purpose of carrying out any of the provisions of the Tåîchô Agreement or the Tåîchô Tax Treatment Agreement. 12.
