Definitions 1 Définitions In this Regulation Les définitions qui suivent s ’appliquent au présent règlement. “business day” means a day other than Saturday or a holiday; « jour ouvrable » “electronic hearing” means a hearing at which one or more of the parties or their representatives attend by conference telephone or some other form of electronic technology allowing persons to hear one another; « audience électronique » “haze”, in relation to an animal, means to use deterrents, such as yelling, noisemakers, projectiles, or other repellants, to move an animal out of an area or to discourage an undesirable behaviour or activity; « moyens de dissuasion » “in-person hearing ” means a hearing at which the parties or their representatives attend before the director or the Minister, as the case may be, in person.

(1) For the purpose of clause 34(1)(b)(i)(

B) of the Act, a person must not kill an animal, or cause an animal to be killed, in the circumstances described in subparagraph 34(1)(b)(

i) of the Act if the animal that was causing the imminent or immediate threat of death or grievous bodily harm to the other animal has stopped attacking the other animal or has retreated.

a) the person must destroy or dispose of the carcass of the animal in accordance with the directions of an animal protection and control officer;

b) as soon as reasonably possible after reporting the action to an animal protection and control officer, the person must provide a written

summary of the incident to an animal protection and control officer , which must include the following information:

c) of the Act, a person is permitted to kill an animal or cause an animal to be killed using the method described in subparagraph 34(3)(c)(

v) of the Act if the killing

a) removal of a dog ’s dewclaws when the dog is more than five days old;

(2) A director may issue a permit to an individual if the director is satisfied that the individual has the qualifications, training and experience that are appropriate in the circumstances to assist in the control of a feral animal or high-risk animal that is at large.

i) killing the animal, (

c) the methods that may be used by the permit holder to take an action authorized under paragraph (b);

(4) A director may impose any other terms or conditions on a permit that they consider appropriate.

(1) Subject to subsection (3), on recei ving a notice of appeal, the director or the Minister, as the case may be, must provide the parties with written notice of the following:

b) if the appeal will be conducted by way of written submissions, the da y by which all submissions and evidence must be filed with the director or the Minister;

section 14, the person whose decision is being appealed, or who issued the order or permit that is being appealed, must provide the director or the Minister, as the case may be, with copies of all materials relevant to the appeal, including
