LOI SUR LA DÉLIVRANCE DE LICENCES AUX AGENTS IMMOBILIERS REAL ESTATE AGENTS' REPORTING REGULATIONS RÈGLEMENT SUR LA PRÉPARATION DU RAPPORT DES AGENTS IMMOBILIERS 1. In these regulations, "Act" means the Real Estate Agents' Licensing Act. 1. Dans le présent règlement, «Loi» désigne la

(1) The following information must be contained in the report of an auditor required to be filed under

section of the Act: (

a) the name of the agent in respect of whom the report was prepared; (

b) the name, address and qualifications of the auditor who prepared the report; (

c) the date of the report and the year covered by the report; (

d) the place at which the books and accounts of the agent are maintained; (

e) a statement regarding the previous year (

i) that the agent kept proper books and accounts of the agent's trades in accordance with the Act, (ii) that the auditors examined the balance due from the agent to clients on a certain day and found them in agreement with the books and accounts of the agent, (iii) that the amount of money held in accounts in trust for clients was verified by personal inspection by the auditors or by certificates obtained from the bank or credit union with which the accounts are maintained, (iv) setting out the amount of money due to clients on the last day covered by the report, as set out in the books and accounts of the agent, (

v) that the auditors, in their opinion, have done a sufficient review of the trust account transactions of the agent for the previous year to satisfy themselves that the money held in trust for clients is kept separate and apart from money belonging to the agent, and (vi) that, after due consideration, the auditors formed an independent opinion regarding money held in trust for clients and, according to the 2.

(1) Le rapport d'un vérificateur, dont le dépôt est exigé en vertu de l'article de la Loi, doit contenir les renseignements suivants :

a) le nom de l'agent pour lequel le rapport a été préparé;

b) le nom, l'adresse et les qualifications professionnelles du vérificateur qui a préparé le rapport;

c) la date du rapport et l'année qu'il vise;

e) une déclaration relative à l'année précédente à l'effet que : (

i) l'agent a tenu des livres et registres comptables convenables de ses opérations immobilières en conformité avec la Loi, (ii) les vérificateurs ont vérifié le solde dû aux clients par l'agent à une date spécifique et ont constaté qu'il était en conformité avec les livres et registres comptables de l'agent, (iii) les sommes détenues dans les comptes en fiducie pour les clients ont été vérifiées personnellement par les vérificateurs ou sur la foi de certificats obtenus de la banque ou de la caisse populaire dans laquelle les comptes sont détenus, (iv) les sommes dues aux clients au terme de la période visée par le rapport, telles qu'inscrites dans les livres et registres comptables de l'agent, sont inscrites au rapport, (

(2) The report of an auditor must be signed and certified by an independent chartered accountant, certified general accountant or certified management accountant.

(2) Le rapport d'un vérificateur doit être signé et certifié par un comptable agréé indépendant, un comptable général licencié ou un comptable en management licencié.

(3) The report of an auditor must be accompanied by a statement signed by the agent or by a partner or an officer of the agent, where the agent is a partnership or a corporation, respectively, (

a) stating that the information contained in the report is true and complete; and (

b) setting out civil actions commenced, and judgments entered, against the agent in the year covered by the report, if any.

(3) Le rapport d'un vérificateur doit être accompagné d'une déclaration signée par l'agent ou par un associé lorsque l'agent est une société de personnes ou par un dirigeant de l'agent lorsque celui-ci est une personne morale,

a) qui affirme que les renseignements contenus dans le rapport sont exacts et complets;

b) qui énonce, le cas échéant, les actions civiles intentées et les jugements enregistrés contre l'agent pendant l'année visée par le rapport.
