INTERPRETATION DÉFINITIONS

Definitions 1. In this Act, "collector" means a person who is authorized to be a collector under

section 19; (collecteur) "fiscal year" means the period beginning on April 1 in one year and ending on March 31 in the next year; (exercice) "fuel tank" means a tank or container that is (

a) originally provided by the manufacturer of a mobile machine, airplane or vessel to carry the fuel required to propel it, or (

b) carried in or on a mobile machine and capable of being easily connected to its fuel system; (réservoir) "Government" means the Government of the Northwest Territories; (gouvernement) "highway system" means the highway system as defined by regulation; (réseau routier) "importer" means a person who brings petroleum products or natural gas into the Northwest Territories for sale to or for the use of any other person; (importateur) "Indian" means an Indian as defined in the Indian Act (Canada); (Indien) "Indian band" means a band as defined in the Indian Act (Canada) and includes the council of a band; (bande) "Minister" means the Minister of Finance; (ministre) "mobile machine" means a wheeled or tracked machine, implement or combination of machines or implements, that is powered by the combustion of petroleum products or natural gas, is self-propelled or capable of self-propulsion and is used for purposes of construction, mining, forestry or the transportation of persons, goods or materials, including without limiting the generality of the foregoing, an automobile, 1.

motorcycle, bus, truck, truck tractor, front-end loader, bulldozer, backhoe, excavator, grader, roller, hauler, crane, drill, dragline, skidder, tree-harvester, scraper, and compactor, but not including (

a) a tractor, combine, thresher or similar machine used for agricultural purposes, (

b) a railway locomotive, or (

c) an aircraft; (machine mobile) "natural gas" means a fossil fuel that consists of at least 90% methane by volume; (gaz naturel) "petroleum products" includes all liquid products obtained whether by distillation, condensation, absorption or any other process, from petroleum, natural gas, casing head or natural gasoline, benzol, benzine, coal, coal tar, oil shales, kerosene, gas, oil or any combination of these products; (produit pétrolier) "producer" means a person who manufactures or produces petroleum products or natural gas in the Northwest Territories; (producteur) "purchaser" means a person who, for his or her own consumption or use, (

a) purchases or receives delivery of petroleum products or natural gas in the Northwest Territories; or (

b) brings into the Northwest Territories petroleum products or natural gas purchased or acquired outside the Northwest Territories; (acheteur) "railway locomotive" means a vehicle that runs or is intended to run only on rails or tracks and includes all equipment attached directly to the same fuel line; (locomotive) "reserve" means a reserve as defined in the Indian Act (Canada); (réserve) "retail price" includes the amount of tax on gasoline payable under the Excise Tax Act (Canada); (prix de détail) "tax" means a tax imposed by this Act; (taxe) "taxable price per litre of gasoline" means the price per litre prescribed in accordance with

section 22 as the taxable price per litre of gasoline; (prix taxable par litre d’essence) «machine mobile»

Sont toutefois exclus :

a) les tracteurs, moissonneuses-batteuses, batteuses ou machine semblable utilisés à des fins agricoles;

b) les locomotives de chemin de fer;

c) les aéronefs. (mobile machine) «ministre» Le ministre des Finances. (Minister) «navire» Moyen de transport qui navigue sur ou sous l’eau, notamment un bateau, un canot, un radeau ou un sous-marin. "Taxation Section" means the Taxation

Section of the Taxation, Corporate Credit and Collections Division of the Department of Finance; (Service de la fiscalité) "vendor" means a person who sells or delivers petroleum products or natural gas in the Northwest Territories to a purchaser; (vendeur) "vessel" means any conveyance navigated in or on water and includes a ship, boat, canoe, raft or underwater boat. (1) Subject to this section, there shall be imposed, levied and collected on all petroleum products, other than propane, butane or naphtha, that are delivered by a vendor to a purchaser, a fuel tax, (

a) in the case of gasoline purchased at a location on the highway system, and used for any purpose other than for aviation purposes, at the rate of 17% of the taxable price per litre of gasoline, and where no taxable price per litre is prescribed, at the rate of $0.058 per litre; (

b) in the case of gasoline not purchased at a location on the highway system, and used for any purpose other than for aviation purposes, at the rate of 0.6 times the rate of tax imposed on gasoline under paragraph (a); (

c) in the case of petroleum products used for aviation purposes, at a rate of $0.01 per litre; (

d) in the case of petroleum products used in a railway locomotive, other than a vehicle used exclusively in a mine as defined in the Mine Health and Safety Act, at a rate of 1.07 times the rate of tax imposed on gasoline under paragraph (a); 2.

d) au taux de 1,07 fois le taux visé à l’alinéa a), dans le cas des produits pétroliers utilisés par une locomotive, aut r e q u’un véhicule utilisé exclusivement dans une mine au sens de la

Loi sur la santé et la sécurité dans les mines;

e) au taux de 0,85 fois le taux visé à l’alinéa a), dans le cas du carburant diesel utilisé par une machine mobile;

f) au taux de 0,29 fois le taux visé à Taxe sur le carburant 7

(

e) in the case of diesel oil used in a mobile machine, at the rate of 0.85 times the rate of tax imposed on gasoline under paragraph (a); and (

f) in the case of any petroleum products not falling under paragraphs (

(2) The fuel tax payable under subsection (1) shall be computed to the nearest tenth of a cent per litre, and for this purpose, 1/20 of a cent shall be computed as 1/10 of a cent.

(3) Subject to this section, every vendor, importer or producer shall, with respect to any petroleum products, other than propane, butane or naphtha that are used or consumed by himself or herself or his or her agents or employees, pay a fuel tax at the rate specified in the relevant paragraph of subsection (1).

c) a visiting force as defined in the Visiting Forces Act (Canada).

(1) Subject to this section, there shall be imposed, levied and collected on those petroleum products listed in the

Schedule and on natural gas delivered by a vendor to a purchaser, a carbon tax, at the rate for that type of product as set out in the Schedule. 2.1.

Rebate of carbon tax 2.2.

(1) The Minister may, in accordance with the regulations, at the time of purchase or on the application of a purchaser, provide a rebate to a purchaser that has paid a carbon tax under this Act in respect of the carbon tax paid. 2.2.

Definitions 2.4.

section 3.5 of the Income Tax Act, (ii) the total amount of fees charged by the Canada Revenue Agency to the Minister for administering the p r o g r a m r e f e r r e d t o i n subparagraph (i), (iii) the total amount of rebates provided under subsection 2.2(1), (iv) the total amount of grants provided under subsection 2.3(2); (

b) the total amount of costs incurred by the Taxation

c) any prescribed deductions.

(1) Subject to subsection (2), every vendor shall (

a) at the time of delivery of petroleum products or natural gas, collect the applicable taxes on the petroleum products or natural gas from the purchaser; and (

b) on or before the 28th day of each month, in respect of all deliveries made by the vendor during the immediately preceding month, send to a collector (

i) the total fuel tax payable by purchasers, (ii) the total carbon tax payable by purchasers, (iii) any tax payable on petroleum products under subsection 2(3), (iv) any tax payable on petroleum products or natural gas under subsection 2.1(2), and (

v) a return, in the prescribed form, showing, in respect of the immediately preceding month and for each of the following on hand at the commencement of the month, purchased or received during the month, delivered during the month and on hand at the close of business on the last day of the month: (

A) the total petroleum products for use for aviation purposes, (

B) the total gasoline for use for other than aviation purposes, (

C) the total diesel oil for use in mobile machines, (

D) the total petroleum products other than diesel oil for use in mobile machines or gasoline for use for other than aviation purposes, (

E) the total natural gas. 3.

(4) Where a person intending to export petroleum products or natural gas provides the collector with proof that a deposit was made in accordance with subsection (2) or waived under subsection (3), a collector shall not collect tax in respect of the petroleum products or natural gas.

(5) Where a person intending to export petroleum products or natural gas complies with subsection (6), the Minister shall (

a) subject to

section 57 of the Financial Administration Act, refund the amount of money deposited under subsection (2) or that portion of the amount of money attributable to the petroleum products or natural gas exported; or (

b) deliver up the security deposited under subsection (2) or that portion of the security attributable to the petroleum products or natural gas exported.

(6) A person intending to export the petroleum products or natural gas shall, within 60 days after the date of the intended export, (

a) provide the Minister with proof satisfactory to the Minister that the petroleum products or natural gas have been exported; or (

b) advise the Minister that the petroleum products or natural gas will not be exported and pay any tax owing in accordance with subsection (7).

Failure of purchaser to pay tax 6. Where the Minister is of the opinion, on evidence satisfactory to the Minister that the tax on any petroleum products or natural gas that should have been paid was not paid, the Minister may direct a collector to collect the tax for those petroleum products or natural gas from the purchaser who is liable to pay the tax and the direction shall be deemed to impose the tax on that purchaser in respect of those petroleum products or natural gas. (1) Every collector, vendor, importer and person to whom

section 5 applies shall (

a) maintain books or records in respect of importation, sale and use or consumption of petroleum products or natural gas, in sufficient detail to permit examination and calculation of the tax; and (

b) preserve the books or records referred to in paragraph (

a) for at least four years from the time the tax is collected. 7.

b) preserve the books and records referred to in paragraph (

section 5 to report the importation of petroleum products or natural gas shall prove to the member of the Royal Canadian Mounted Police or authorized person mentioned in

section 8, that the tax on the petroleum products or natural gas has been paid or pay the tax. 9.

section 8 may, without warrant, seize the petroleum products or natural gas and the containers in which they are kept and the airplane, vessel or mobile machine in or on which they are carried and retain them in his or her possession as security for payment of the unpaid tax. (1) A justice who is satisfied on oath that there are reasonable grounds for believing that a contravention of this Act or the regulations has been committed or is likely to be committed, may issue a warrant to a peace officer authorizing the peace officer to enter and search, by force if necessary, any premises for documents, books, records, papers, petroleum products or natural gas or things that may afford evidence as to the contravention, and seize and remove any such documents, books, records, papers, petroleum products or natural gas or things until they are produced in any court proceedings or returned to their owner. 12.

(2) Where the owner or person in possession of petroleum products or natural gas seized under subsection (1) is convicted of an offence under this Act or the regulations, the justice making the conviction may order, in addition to any other punishment that may be imposed, that the petroleum products or natural gas and containers in which they are kept shall be forfeited to the Minister. section 11 or subsection 12(2), the Minister shall arrange for its sale at the earliest possible time in the same manner as a sale conducted pursuant to subsection 67(1) of the Financial Administration Act. 13.

a) calculate the amount of the tax; and (

b) assess the person by whom the Minister finds the tax should have been paid in respect of the tax, interest or penalties payable under this Act. 14.

(2) Every person who is in arrears in the payment of the tax owing to the Government, shall pay to the Government, in addition to the tax, a penalty in the amount of $500 or 10% of the tax in arrears, whichever is greater, together with interest, at the rate prescribed under paragraph 145(

j) of the Financial Administration Act.

(4) Where the Minister is satisfied that a person is in arrears in the payment of the tax owing to the Government because of extenuating circumstances, the Minister may remit the penalty mentioned in subsection (2) subject to the conditions that the Minister considers just, and in such a case the provisions of the Financial Administration Act relating to the remission of penalties apply.

The Minister may refund, as the circumstances require, any amount that was erroneously paid or collected under this Act or that was paid or collected for a purpose that is partially fulfilled or not fulfilled. (1) A person that objects to a notice of assessment under

section 14 may, within 90 days after the Minister gives the notice, serve on the Minister a notice of objection in a form approved by the Minister setting out the reasons for the objection and the relevant facts on which the objection is based. 16.2.

Effect of filing of material 16.7.

(1) On the filing of the notice of appeal in accordance with

section 16.5 and the reply in accordance with

section 16.6, the matter is deemed to be an action in the Supreme Court and, unless the Court otherwise orders, ready for hearing. 16.7.

The filing and service of a notice of appeal by any person or any delay in the hearing of the appeal does not affect the due date, interest, penalties or any liability for payment provided under this Act in respect of any taxes due and payable or that have been collected on behalf of the Government that are the subject matter of the appeal or in any way delay the collection of those taxes, but, where an assessment is set aside or reduced on appeal, the Minister shall refund the amount or excess amount of taxes that have been paid or collected and any additional interest or penalty imposed and paid on those taxes.

to any person employed by the Government of Canada or by the government of a province or territory if, (

d) the information, records and returns obtained by the government for the purpose of any Act that imposes a tax are communicated or made accessible on a reciprocal basis to the Minister, and (

e) the information, records and returns communicated or made accessible by the Minister will not be used for any purpose other than the administration and enforcement of a law of Canada, a province or territory that provides for the imposition of a tax. a) for the purpose of making the application and administration of this Act and any similar Act of a province or territory more equitable; and (

b) respecting the payment or the relief from the payment of the tax under this Act or imposed under a similar Act of a province or territory to avoid the duplicate imposition of any such tax. 18.

a) a person has in a province or territory paid a tax in respect of the use or consumption of petroleum products or natural gas in a mobile machine that is similar to the tax under this Act, and (

b) the Minister has entered into an agreement under subsection (1) with the government of that province or territory, which provides that a similar relief will be given where the circumstances are reversed, the Minister may relieve that person to the extent provided for in the agreement from the tax in respect of the use or consumption of the petroleum products or natural gas that would otherwise be payable under this Act or that part of the tax that would be equivalent to the amount of tax payable under the Act of that province or territory. Collectors 19.The Minister may authorize suitable persons to be collectors for the purposes of this Act and each collector shall exercise the powers and carry out the duties of that office for the period and within the area that the Minister may determine. i) the total amount of the grant, (ii) the name of the large emitter to whom the grant was provided, (iii) the purpose for which the grant was provided, if applicable, and (iv) if the grant was provided to offset the costs of an emissions reduction project, the anticipated reduction in greenhouse gas emissions resulting from the project;

g) the total amount of any refunds provided in respect of carbon tax under

section 16.1; (

h) the total amount of any carbon tax, interest, penalties or costs ordered to be paid or refunded for offences related to carbon tax under subsection 16.7(5); (

i) the total amount of any fines ordered under subsection 21(1.1) or (1.2) for offences related to carbon tax; (

j) the total amount of costs incurred by the Taxation

Section to administer carbon tax under this Act; (

k) a description of the effectiveness of carbon tax in reducing greenhouse gas emissions in the Northwest Territories; (

a) to be tabled in the Legislative Assembly at the earliest opportunity after completion of the report; and (

summary conviction and is liable, for a first offence, to a fine not exceeding $10,000 and, for a subsequent offence, to a fine not exceeding $25,000, a term of imprisonment not exceeding six months, or to both, if the person (

a) makes a false statement in a document or form used under this Act; (

b) obtains or attempts to obtain or knowingly induces, assists or attempts to assist another person in obtaining an unwarranted exemption from a tax imposed under this Act; (

c) obstructs a person lawfully authorized to audit or examine or enter and search during the exercise of that person’s authority or refuses, when requested by that person, to give the required assistance; (

d) refuses to answer or knowingly gives false information respecting any transactions involving petroleum products or natural gas; or (

e) refuses to produce any records or documents respecting petroleum products or natural gas or any container used for holding petroleum products or natural gas that is in the person’s possession or control. 21.

(1.1) Every person who refuses or neglects to pay or remit a tax where required to do so by this Act is guilty of an offence punishable on

summary conviction and liable (

a) for a first offence, to a fine not exceeding $10,000, a term of imprisonment not exceeding three months, or to both; and (

b) for a subsequent offence, to a fine not exceeding $25,000, a term of imprisonment not exceeding six months, or to both.

(1.3) In addition to any punishment imposed under this section, a judge may order a person convicted of an offence under subsection (1), (1.1) or (1.2) to pay to the Minister an amount equivalent to the amount of any unpaid or unremitted tax.

a) governing the methods of collecting tax; (

b) governing the accounting for and paying over of tax collected and the time and manner of the accounting and paying; (

c) prescribing the returns and statements to be made by persons appointed to collect the tax and the time or times for making the returns and statements; (c.1) prescribing any other information to be included in a return referred to in subparagraph 3(1)(b)(ii); (c.2) respecting the information that must be includ ed i n a rep ort under paragraph 5.1(2)(

a) and the manner in which the report and deposit shall be made under subsection 5.1(2); (

d) respecting the provision or payment of rebates of tax or any portion of tax under

section 2.2 and all matters related to the application for and granting of rebates; (

e) respecting all matters related to the provision of a grant under

section 2.3; (e.01) respecting all matters related to the provision of a grant under

section 2.4, including the allocation of grants among community governments or prescribed classes of community governments; (e.1) respecting the manner in which exemptions may be claimed; (

f) prescribing the periodic sampling to be used for obtaining a median price under subsection 22(2); (

g) prescribing the certificates and forms that the Minister considers necessary for the proper carrying out of this Act; (

h) defining, for the purposes of this Act, "highway system"; and (

i) prescribing any matter or thing that by this Act may or is to be prescribed. section applies to a vendor who has paid to a collector the carbon tax on petroleum products or natural gas delivered to the vendor for the purpose of resale to retail purchasers. 24.

(2) On each of the dates set out in subsection (3), a vendor shall pay to the Minister, in respect of petroleum products or natural gas on hand on that date, a carbon tax at a rate that is determined by the formula DAPD where (

a) DA is the carbon tax rate for that type of petroleum product or for natural gas as set out in the

Schedule on the date this subsection applies; and (

b) PD is the carbon tax rate for that type of petroleum product or for natural gas as set out in the

Schedule on the date immediately preceding the date referred to in paragraph (a).
