LOI SUR LA SANTÉ MENTALE MENTAL HEALTH GENERAL REGULATIONS RÈGLEMENT GÉNÉRAL SUR LA SANTÉ MENTALE The Commissioner, on the recommendation of the Minister, under

section 106 of the Mental Health Act and every enabling power, makes the Mental Health General Regulations. La commissaire, sur la recommandation du ministre, en vertu de l’article 106 de la

Definitions Définitions 1. For the purposes of the Act and these regulations, "attending medical practitioner", in respect of a patient, means a medical practitioner who (

a) is a member of the medical staff of a designated facility in or from which the patient is cared for, observed, examined, assessed, treated or supervised on an inpatient or outpatient basis, and (

b) has, in accordance with written policies or procedures of the designated facility, the primary responsibility for exercising powers and performing duties in relation to the patient; (médecin traitant) "Director" means the Director of Mental Health appointed under subsection 14(1). (1) Subject to the reasonable limits set out in these regulations, a patient detained under the authority of subsection 5(1) of the Act has the rights set out in subsection 8(2) of the Act, and a reference to "admission" and "involuntary admission" shall be read as a reference to "detention". 2.

(2) On the detention of a patient in a designated facility under the authority of subsection 5(1) of the Act, the member of the treatment staff responsible for the decision to detain the patient, or the director of the facility where the patient is detained, shall, at the earliest opportunity, provide the following information to the patient in written and verbal form:

(1) For greater certainty, a patient detained under the authority of a certificate of involuntary assessment has the right to consult with or continue to consult with and instruct legal counsel in private. 4.

(2) For greater certainty, a health professional who issues a certificate of involuntary assessment or the director of a designated facility where a person is detained under the authority of a certificate of involuntary assessment shall, at the earliest opportunity, inform the person in written and verbal form of the right to consult or continue to consult with and instruct legal counsel in private.

In ensuring that an involuntary patient is informed of the rights referred to in subsection 8(2) of the Act at the earliest opportunity after admission, the director of the designated facility shall ensure that the information is provided to the patient in written and verbal form. 5. If, in the opinion of the attending medical practitioner, a patient to whom information is provided under subsection 8(2) of the Act or subsection 2(1) of these regulations appears to not comprehend that information, the attending medical practitioner, a health professional or the director of the designated facility where the patient is admitted or detained shall endeavour to provide that information on a reasonable ongoing basis, and at least daily. 6.

(1) The exercise of a right referred to in subsection 8(2) of the Act or subsection 2(1) of these regulations may be limited by the attending medical practitioner (

a) if the attending medical practitioner has reasonable grounds to believe that exercise of the right would result in a risk of harm to the physical, emotional or mental health or well-being of the patient or another person; and 7.

(2) An attending medical practitioner who limits the exercise of a right by a patient under subsection (1) shall provide the following information in written and verbal form to the patient and, if applicable, to the patient’s substitute decision maker: (

a) an explanation of how the exercise of the right is being limited; (

b) the reasons for limiting the exercise of the right; (

c) the period of time during which the exercise of the right is being limited; (

d) the right to apply to the Review Board for an order cancelling the limitation.

The attending medical practitioner of an involuntary patient shall, at the earliest opportunity after issuing a certificate of involuntary admission or a renewal certificate, inform the patient in written and verbal form of the requirements under the Act to conduct psychiatric assessments of the patient on a reasonable ongoing basis to determine whether the involuntary admission criteria continue to be met. 8.

(1) In the case of a patient who has a substitute decision maker, the attending medical practitioner or the director of the designated facility where the patient is detained shall, at the earliest opportunity, ensure that the following applicable information is provided to the substitute decision maker in written and verbal form: (

a) the information required to be provided to a patient under subsection 8(1) of the Act; (

b) information respecting the rights of a patient under subsection 2(1) of these regulations and subsection 8(2) and sections 9.1, 26, 27 and 77 of the Act. 9.

(2) The duties set out in

section 9 of the Act respecting informing a patient of his or her rights apply equally to the patient's substitute decision maker.

(1) On the cancellation of a treatment decision certificate in respect of a patient, the attending medical practitioner or the director of the designated facility where the patient is detained shall, at the earliest opportunity, provide the following information to the patient in written and verbal form: (

a) the information required to be provided to a patient under subsection 8(1) of the Act; 10.

b) information respecting the rights of a patient under subsection 2(1) of these regulations and subsection 8(2) and sections 9.1, 26, 27 and 77 of the Act.

(2) The duty in subsection (1) applies in addition to duties under the Act and these regulations to provide information to the patient regardless of whether the patient is mentally competent to make treatment decisions.

(1) A written notice under subsection 57(2), (3) or (4) of the Act must be made at the earliest opportunity after the cancellation or expiration of the certificate. 11.

(2) A written notice of expiration or cancellation of a certificate of involuntary admission or renewal certificate, made under subsection 57(2) or (3) of the Act, must, if applicable, include information in respect of the expected date and time of release of the patient.

(2) L’avis écrit de l’expiration ou de l’annulation d’un certificat d’admission involontaire ou d’un certificat de renouvellement, donné en application du paragraphe 57(2) ou (3) de la loi, doit, s’il y a lieu, comprendre des renseignements quant à la date et l’heure prévues de la libération du patient.

(3) A written notice of expiration or cancellation of a certificate of involuntary admission or renewal certificate, made under subsection 57(4) of the Act, must, if applicable, include information in respect of (

a) the expected date and time of release of the patient; and (

b) the expected date and time of return of the patient to the community where the patient will receive follow-up treatment.

(3) L’avis écrit de l’expiration ou de l’annulation d’un certificat d’admission involontaire ou d’un certificat de renouvellement, donné en application du paragraphe 57(4) de la loi, doit, s’il y a lieu, comprendre les renseignements suivants :

a) la date et l’heure prévues de la libération du patient;

b) la date et l’heure prévues du retour du patient dans le milieu communautaire où il recevra un traitement de rappel. Administrative Matters Questions administratives 12.

(1) Subject to subsection (4), the attending medical practitioner of a patient, or the director of the designated facility in or from which the patient is cared for, observed, examined, assessed, treated or supervised, may designate one or more medical practitioners to exercise one or more powers or perform one or more duties or functions of an attending medical practitioner under the Act. 12.

(2) A designation made under subsection (1) must (

a) be made in writing; (

b) state the name of the designate, the powers to be exercised or the duties or functions to be performed by the designate, and the circumstances under

(3) For greater certainty, a medical practitioner who is responsible for the general supervision and management of a community treatment plan for a patient may be designated, under subsection (1), to act on behalf of an attending medical practitioner for the patient.

(4) A designation may not be made under subsection (1) without the agreement of the designated medical practitioner.

(5) A copy of a designation made under subsection (1) by the attending medical practitioner must be filed, at the earliest opportunity, with the director of the designated facility.

(1) The director of a designated facility may, in writing, delegate to one or more individuals each of the following duties: (

a) the duty under subsection 55(1) of the Act to examine certificates of involuntary admission and renewal certificates; (

b) the duty under subsection 55(2) of the Act to bring to the attention of the attending medical practitioner of a patient an opinion that a certificate of involuntary admission or renewal certificate was not completed in accordance with the Act; (

c) the duty under subsection 56(1) of the Act or

section 10 of the Apprehension, Conveyance and Transfer Regulations to forward copies of the specified documents to the Minister’s designate. 13.

(1) Le directeur d’un établissement désigné peut, par écrit, déléguer à un ou plusieurs particuliers chacune des obligations suivantes :

a) l’obligation prévue au paragraphe 55(1) de la loi d’examiner les certificats d’admission involontaire et les certificats de renouvellement;

a) the name of the director; (

b) the name and title of the delegate; (

c) the duties that the delegate is to assume; and (

d) the period during which the delegation is in effect.

(4) For greater certainty, the director retains overall responsibility for the performance of the duties listed in paragraphs (1)(

a) to (

c) for the period during which the delegation is in effect.

(1) The Minister shall appoint a Director of Mental Health to administer the Act and regulations. 14.

(2) The Director is the designate of the Minister for the purpose of

section 56 of the Act.

Certificate of Involuntary Assessment Certificat d’évaluation non volontaire 15.A health professional who issues a certificate of involuntary assessment of a person shall file the certificate, at the earliest opportunity, with the director of the designated facility where the person is to be conveyed for assessment. 15.Le professionnel de la santé qui délivre un certificat d’évaluation non volontaire d’une personne dépose le certificat, dès que possible, auprès du directeur de l’établissement désigné où la personne sera transportée en vue de l’évaluation.

Registry of Involuntary Patients Registre des patients en placement non volontaire 16.The registry of involuntary patients referred to in subsection 56(2) of the Act must include the following information in respect of each involuntary patient: (

a) the name of the patient; (

b) the date and time of issue of the certificate of involuntary admission; (

c) the name of the designated facility to which the patient is admitted under

section 15 of the Act; (

d) if applicable, the name of the designated facility to which the patient is being or was transferred; (

e) if applicable, the name and address of a facility outside the Northwest Territories to which the patient is being or was transferred, and the date and time of that transfer; (

f) the date and time of issue of any renewal certificates; (

g) the date of cancellation of any certificates of involuntary admission or renewal certificates; (

h) the date and time of expiration of any certificates of involuntary admission and any renewal certificates. 16.Le registre des patients en placement non volontaire visé au paragraphe 56(2) de la loi doit comprendre les renseignements ci-après à l’égard de chaque patient en placement non volontaire :

a) le nom du patient;

f) la date et l’heure de délivrance de tous les certificats de renouvellement;

g) la date d’annulation de tous les certificats d’admission involontaire ou de renouvellement;

h) la date et l’heure d’expiration de tous les certificats d’admission involontaire et de renouvellement. 6

Notice to Review Board Avis au conseil de révision 17.In the case of a patient who has been subject to a certificate of involuntary admission and renewal certificates for a continuous period of six months, and in respect of whom an application for an order cancelling the certificate has not been made, the director of the designated facility where the patient is detained shall provide written notice of the patient's detention to the Review Board at least 14 days before the expiry of that six month period. 17.Dans le cas d’un patient qui a été assujetti à un certificat d’admission involontaire et à des certificats de renouvellement pour une période continue de six mois, et à l’égard duquel aucune demande d’ordonnance annulant le certificat n’a été présentée, le directeur de l’établissement désigné où le patient est détenu donne avis écrit de la détention du patient au conseil de révision au moins 14 jours avant l’expiration de cette période de six mois.

Standards Normes 18.

(1) The Minister may establish a code of rules or standards in respect of designated facilities, or in respect of areas of designated facilities or rooms where persons are cared for, observed, examined, assessed, treated or detained under the Act. 18.

(2) The director of a designated facility shall ensure compliance with and the monitoring of compliance with any codes of rules or standards established by the Minister.
