LOI SUR LA FAUNE SALE OF WILDLIFE REGULATIONS RÈGLEMENT SUR LA VENTE D’ANIMAUX DE LA FAUNE The Commissioner, on the recommendation of the Minister, under

section 98 of the Wildlife Act and every enabling power, makes the Sale Of Wildlife Regulations. Le commissaire, en vertu de l’article 98 de la

In these regulations, "area" means a portion of a Wildlife Management Zone subdivided into a Wildlife Management Area, under subsection 88(2) of the Act, by the Wildlife Management Zones and Areas Regulations; (région) "commercial tag" means a tag authorizing the holder of the licence to harvest and possess wildlife for the purpose of trafficking in it; (étiquette commerciale) "zone" means a Wildlife Management Zone designated, under subsection 88(1) of the Act, by the Wildlife Management Zones and Areas Regulations. a) Inuvialuit Settlement Region Tuktoyaktuk Hunters and Trappers Committee Regulations; (

b) Inuvialuit Settlement Region Aklavik Hunters and Trappers Committee Regulations; (

c) Inuvialuit Settlement Region Paulatuk Hunters and Trappers Committee Regulations; (

d) Inuvialuit Settlement Region Inuvik Hunters and Trappers Committee Regulations; (

e) Inuvialuit Settlement Region Sachs Harbour Hunters and Trappers Committee Regulations; (

(1) A local harvesting committee may issue a commercial tag to a hunter for the following animals: (

a) barren-ground caribou; (

b) muskox; (

c) polar bear. 2.

(1) Le comité local sur la récolte peut délivrer à un chasseur une étiquette commerciale pour les animaux suivants :

c) l’ours polaire.

(2) Where a local harvesting committee does not wish to issue commercial tags under subsection (1), an officer may issue commercial tags.

(3) Where a commercial tag is issued under subsection (1) or (2) in respect of wildlife that is subject to a quota under these regulations, the issuer may stipulate a date in the open season before which the hunter must use the commercial tag, and if the hunter fails to use the commercial tag before the stipulated date, the hunter shall return the commercial tag to the issuer and the issuer may issue the commercial tag to another hunter.

(3) L’émetteur d’étiquettes peut fixer une date pendant la saison de la chasse avant laquelle le chasseur doit utiliser l’étiquette commerciale qui lui est délivrée en vertu du paragraphe (1) ou (2), et qui vise un animal faisant l’objet d’un quota en vertu du présent règlement. (4) Where a commercial tag is returned and is not reissued or is unused at the end of the season, the person or local harvesting committee in possession of the commercial tag at the end of the season shall give the commercial tag to an officer.

(4) La personne ou le comité local sur la récolte qui a en sa possession une étiquette commerciale qui n’a pas été utilisée à la fin de la saison ou qui lui a été retournée sans être délivrée de nouveau, la remet à un agent à la fin de la saison.

(5) Where a hunter intends to use a commercial tag for barren-ground caribou, that hunter shall, where a quota exists, obtain a commercial tag before hunting.

(5) Le chasseur qui entend utiliser une étiquette commerciale pour le caribou des toundras visé par un quota doit obtenir l’étiquette commerciale avant d’aller à la chasse.

(6) Where a hunter intends to sell the meat of muskox or polar bear, the hunter may obtain a commercial tag after the animal is killed.

(6) Le chasseur qui entend vendre de la viande de boeuf musqué ou d’ours polaire peut obtenir une étiquette commerciale après avoir abattu l’animal.

(1) The zone or area, the quota and conditions on issue of a commercial tag for barren-ground caribou are set out in the Schedule. 3.

Schedule may be changed through the process set out in

(1) Subject to subsection (2), (

a) the holder of a commercial tag may sell, trade or barter the meat of caribou, muskox and polar bear; and (

b) the holder of a licence to deal in the meat of wildlife may purchase, sell, trade or barter the meat of caribou, muskox and polar bear where that meat has been taken under the authority of a commercial tag and a commercial tag is attached to the meat. 4.

(1) Sous réserve du paragraphe (2) :

a) le titulaire d’une étiquette commerciale peut vendre, échanger ou troquer de la viande de caribou, de boeuf musqué ou d’ours polaire;

b) le titulaire d’un permis autorisant le commerce de la viande d’animaux de la faune peut acheter, vendre, échanger ou troquer de la viande de caribou, de boeuf musqué ou d’ours polaire si l’animal dont provient la viande a été abattu en vertu d’une étiquette commerciale et qu’une étiquette commerciale est fixée à la viande.

(2) Where the meat described in subsection (1) is a portion of a carcass and the commercial tag is not attached to the portion, the person obtaining the meat shall obtain a receipt from the other party to the transaction stating, (

a) where the other party is the person who lawfully harvested the meat, (

i) the name and licence number or identification number of the harvester, (ii) the commercial tag number, (iii) the date of the transaction, (iv) the species the meat came from, and (

v) the weight of the portion of meat; or (

b) w h e r e t h e o t h e r p a r t y i s a h o l d e r o f a licence to deal in the meat of wildlife, (

i) the name and licence number of the holder of the licence to deal in the meat of wildlife, (ii) the commercial tag number, (iii) the date of the transaction, (iv) the species the meat came from, and (

v) the weight of the portion of meat.

(2) Lorsque la viande dont il est question au paragraphe (1) consiste d’une

partie de carcasse et que l’étiquette commerciale n’y est pas fixée, la personne qui obtient la viande se procure un reçu indiquant :

a) lorsque la personne qui vend ou échange la viande l’a récoltée légalement : (

b) lorsque la personne qui vend ou échange la viande est titulaire d’un permis autorisant le commerce de la viande d’animaux de la faune : (

i) le nom et le numéro du permis du titulaire du permis autorisant le commerce de la viande d’animaux de la faune, (ii) le numéro de l’étiquette commerciale, (iii) la date de la transaction, (iv) l’espèce d’animal abattu, (

v) le poids de la viande.
