LOI SUR LA DÉCLARATION OBLIGATOIRE DES BLESSURES PAR BALLE ET PAR ARME BLANCHE The Commissioner of the Northwest Territories, by and with the advice and consent of the Legislative Assembly, enacts as follows: Le commissaire des Territoires du Nord-Ouest, sur l’avis et avec le consentement de l’Assemblée législative, édicte :

Definitions 1. In this Act, "ambulance service" means a service for the conveyance of persons requiring medical attention; (service d’ambulance) "health facility" means (

a) a facility as defined in the Hospital Insurance and Health and Social Services Administration Act from which health services are provided, or (

b) a prescribed facility; ( établissement de santé) "stab wound" means a wound caused by a knife or other sharp or pointed instrument. (blessure par arme blanche) S.N.W.T. 2015,c.14,s.26. 1. a) a stab wound that is reasonably believed to be self-inflicted or unintentionally inflicted; or (

b) an ambulance service, health facility or class of health facility that is exempted by the regulations. 2. La présente loi ne vise pas, selon le cas :

a) la blessure par arme blanche que l’on croit raisonnablement être auto-infligée ou non intentionnelle;

b) le service d’ambulance, l’établissement de santé ou la catégorie d’établissements de santé exempté par règlement. Application Mandatory disclosure 3.

(1) A health facility or an ambulance service that treats a gunshot or stab wound shall disclose the following information to the local detachment of the Royal Canadian Mounted Police: (

a) the injured person’s name, if known; (

b) whether the injury is a gunshot or stab wound; (

c) in the case of an ambulance service, the location attended to treat the injured person; (

d) in the case of a health facility, the name and location of the health facility; (

e) any other information that may be required by the regulations. 3.

(1) L’établissement de santé ou le service d’ambulance qui traite une personne pour une blessure par balle ou par arme blanche communique au détachement local de la Gendarmerie royale du Canada les renseignements suivants :

a) le nom de la personne blessée, s’il est connu;

b) la nature de la blessure, à savoir une blessure par balle ou une blessure par arme blanche;

c) dans le cas d’un service d’ambulance, l’endroit visité pour traiter la personne blessée;

d) dans le cas d’un établissement de santé, le nom et l’emplacement de cet établissement;

e) tout autre renseignement réglementaire. Communi- cation obligatoire 1

Manner and timing of disclosure

(2) Subject to the regulations, the disclosure required by subsection (1) must be made orally and as soon as it is reasonably practicable to do so without interfering with the injured person’s treatment or disrupting the regular activities of the health facility or ambulance service.

(2) Sous réserve des règlements, la communication qu’exige le paragraphe (1) doit se faire de vive voix et dès qu’il est raisonnablement possible de le faire sans nuire au traitement de la personne blessée ou perturber les activités normales de l’établissement de santé ou du service d’ambulance. (4) Every health facility and ambulance service shall ensure that a person is responsible at all times to make the disclosure required under subsection (1) on behalf of the health facility or ambulance service.

No action or proceeding may be brought against a health facility, an ambulance service, a director, officer or employee of a health facility or ambulance service, or any other person in respect of anything done or not done by that person in good faith under this Act. 5.

Bénéficient de l’immunité les établissements de santé et les services d’ambulance, et leurs administrateurs, dirigeants ou employés, ou toute autre personne, pour les actes accomplis ou les omissions commises de bonne foi sous l’autorité de la présente loi. Immunité Conflict with Access to Information and Protection of Privacy Act 6. If there is a conflict between a provision of the Access to Information and Protection of Privacy Act and a provision of this Act, the provision of this Act prevails to the extent of the conflict. 6.

Loi sur l’accès à l’information et la protection de la vie privée Regulations 7. The Commissioner, on the recommendation of the Minister, may make regulations (

a) prescribing facilities or classes of facilities for the purposes of paragraph (

b) of the definition "health facility" in

section 1; (

b) exempting an ambulance service, health facility or class of health facility from the requirements of this Act, including providing for circumstances in which the exemption is or is not applicable; (

c) respecting information that must be disclosed under paragraph 3(1)(e); (

d) governing the manner and timing of the disclosure required under

section 3; and (

e) respecting any other matter the Commissioner considers necessary or advisable for carrying out the purposes and provisions of this Act. 7. Le commissaire, sur la recommandation du ministre, peut, par règlement :

a) pour l’application de l’alinéa b) de la définition de «établissement de santé» à l’article 1, désigner des établissements ou des catégories d’établissements;
