In these regulations, "housing benefit" means the amount included in computing the income of a taxpayer for a taxation year as income from employment in respect of the benefit conferred on the taxpayer where an employer who owns or leases, bona fide, an accommodation described in the

Schedule to the Isolated Posts Housing and Travel Assistance Benefits Remission Order , made under the Financial Administration Act (Canada) as issued by the Treasury Board of Canada, as amended, as it reads when the entitlement to the benefit arises, provides such accommodation to the taxpayer at no rent or at a rent that is lower than the rent that the taxpayer would otherwise have to pay for such accommodation if the taxpayer dealt with the employer at arm's length; (indemnité de logement) "isolated post" means (

a) a location in Canada north of the 60th parallel of latitude, (

b) a location in Canada south of the 60th parallel of latitude with no all-weather road access for the purpose of

Schedule H (Appendix 8) to the Isolated Posts Directive, 1977, as issued by the Treasury Board of Canada, as amended or substituted and as it reads when the entitlement to the benefit arises, and with a population of less than 10,000 and entitled to 50 points or more for the factors of population, climate, barren or taiga lands and access under

Schedule H as it so reads, (

c) a location in Canada south of the 60th parallel of latitude, other than a location described in paragraph (b), with a population of less than 10,000 that is more than 161 km from a location with a population of more than 10,000 and more than 322 km from a location with a population of more than 50,000 and 1. 2 entitled to 50 points or more in the manner described in paragraph (b), and (

d) a location named in

Schedule A (Appendix 1) to the Isolated Posts Directive, 1977, as issued by the Treasury Board of Canada, as amended or substituted and as it reads when the entitlement to the benefit arises; ( poste isolé) "isolation benefit" means a housing benefit or travel assistance benefit relating to employment at an isolated post and not exceeding an amount that is reasonable for the purposes of that employment but does not include a benefit in respect of which the Isolated Posts Benefits and Allowances Remission Regulations apply; (avantage d'isolement) "metropolitan area" in respect of an isolated post means Vancouver, Edmonton, Calgary, Saskatoon, Winnipeg, North Bay, Toronto, Ottawa, Montreal, Quebec City, Moncton, Halifax or St.

John's, whichever place is the nearest to that isolated post by the most practical route and means of transportation; (région métropolitaine) "travel assistance benefit" means the amount included in computing the income of a taxpayer for a taxation year as income from employment in respect of the benefit conferred on the taxpayer where an employer pays return transportation costs for the taxpayer or members of his or her family for a trip from an isolated post to a metropolitan area in respect of travel assistance, not exceeding an amount equal to the lesser of (

a) the costs actually incurred by the employer for two sets of trips for the taxpayer and members of his or her family, each set of trips comprising not more than one trip for the taxpayer and one trip for each member of his or her family residing at the isolated post, and (

b) the relevant cost of two such sets of trips by means of transportation that is the most practical and economical. ( aide au

c) un endroit, au Canada, situé au sud du 60 e parallèle de latitude, autre qu'un endroit décrit à l'alinéa b), comptant moins de 10 000 habitants et situé à plus de 161 km d'une agglomération de plus de 10 000 habitants et à plus de 322 km d'une agglomération de plus de 50 000 habitants et ayant droit à 50 points ou plus de la manière décrite à l'alinéa b);

(1) Subject to

section 8, remission of income tax for a taxation year is granted in favour of each taxpayer employed at an isolated post in an amount equal to the amount by which the amount of income tax payable by him or her for that year exceeds the amount of income tax that would be payable by him or her for that year if, in respect of an isolation benefit received or enjoyed by the taxpayer in that year, only the maximum taxable amount in respect of an isolation benefit were included in computing the income of the taxpayer as income from employment. 4.

(2) For the purposes of subsection (1), the maximum taxable amount in respect of (

a) a travel assistance benefit is the lesser of (i) $250 for each set of trips taken in a taxation year, and (ii) the return transportation costs actually incurred for each such set of trips; and (

b) a housing benefit is the least of (

i) the applicable base rate per month for the accommodation provided by the employer as set out in the

Schedule to the Isolated Posts Housing and Travel Assistance Benefits Remission Order , made under the Financial Administration Act (Canada), multiplied by the number of months in the taxation year during which the accom- modation is provided minus the aggregate amount paid by the taxpayer in respect of the accommodation for that period, (ii) 20% of the income of the taxpayer from employment with the employer for the period in the year during which the accommodation is provided minus the aggregate amount paid by the taxpayer in respect of the accommodation for that period, and (iii) the fair rental value of the accommodation for the period in the year during which the accom- modation is provided minus the

For the purpose of calculating the remission of income tax for a taxation year after 1983, the amount set out in subparagraph 4(2)(a)(

i) and each amount set out in the

Schedule to the Isolated Posts Housing and Travel Assistance Benefits Remission Order , made under the Financial Administration Act (Canada), shall be adjusted annually so that the amount to be used for the taxation year is an amount equal to the product obtained by multiplying (

a) the amount that would have been applicable for the taxation year if no adjustment had been made under this

section with respect to that year by (

b) the ratio that the transportation component, in the case of a travel assistance benefit, or the housing component, in the case of a housing benefit, of the Consumer Price Index for the 12-month period that ends on the 30th day of September next before that taxation year bears to the transportation component or housing component, as the case may be, of the Consumer Price Index for the 12-month period that ended on the 30th day of September, 1982. 5. Subject to

section 8, where, in respect of any individual, (

a) a remission of any amount of the tax that would have been paid or payable by him or her, if these regulations had not been applicable, is granted to him or her for a taxation year under

section 4, and (

b) a penalty has been imposed on him or her under the Act in respect of the tax referred to in paragraph (a), remission is granted of the penalty referred to in paragraph (

b) in an amount not exceeding the amount by which the penalty referred to in paragraph (

b) exceeds the penalty that would have been imposed if

a) a remission of any amount of the tax that would have been paid or payable by him or her, if these regulations had not been applicable, is granted to him or her for a taxation year under

section 4, and (

b) interest has been paid or become payable under the Act in respect of the tax referred to in paragraph (a), remission is granted of the interest referred to in paragraph (

b) in an amount not exceeding the amount by which the interest referred to in paragraph (

b) exceeds the interest that would have been paid or become payable if the amount of the tax so remitted had not been taken into account in computing the interest.

Remission is granted under sections 4, 6 and 7 on condition that a claim for remission is made by the taxpayer or his or her employer to the Commissioner not later than four years after the end of the taxation year in respect of which the remission is claimed. 8.
