LOI SUR LA SANTÉ MENTALE ASSISTED COMMUNITY TREATMENT REGULATIONS RÈGLEMENT SUR LE TRAITEMENT EN MILIEU COMMUNAUTAIRE ASSISTÉ The Commissioner, on the recommendation of the Minister, under

section 106 of the Mental Health Act and every enabling power, makes the Assisted Community Treatment Regulations. La commissaire, sur la recommandation du ministre, en vertu de l’article 106 de la

In these regulations, "approved form" means the applicable form set out in the Mental Health Forms Regulations. (formule approuvée) 1. An attending medical practitioner, as defined in the Mental Health General Regulations, shall after consulting with a patient and if applicable, his or her substitute decision maker under subsection 37(4) of the Act, but before taking any other steps required under the Act to prepare a community treatment plan, ensure that the patient provides confirmation of the patient’s (

a) desire to participate in the development of a community treatment plan; and (

b) willingness to comply with the responsibilities of the patient that will be developed and incorporated into the plan. 2. a) made in the approved form; and (

b) provided to the director of the designated facility (

i) only after the confirmation referred to in

section 2 is obtained, and (ii) before the consultation with health professionals and other persons and bodies required under subsection 39(1) of the Act is initiated. 3. Within 24 hours after the issuance of an assisted community treatment certificate, the medical practitioner responsible for the general supervision and management of the community treatment plan shall provide the community treatment plan to the patient and, if applicable, to the patient’s substitute decision maker. 4.

5. The filing of an assisted community treatment certificate, with the appended community treatment plan, or the cancellation of an assisted community treatment certificate under subsection 54(1) of the Act must be done by the medical practitioner responsible for the general supervision of the community treatment plan within 24 hours after the issuance or cancellation of the certificate. 5.

(1) A director of a designated facility who authorizes, under subsection 23(1) of the Act, the transfer of an involuntary patient subject to an assisted community treatment certificate to another designated facility shall (

a) amend, in the approved form, the assisted community treatment certificate in respect of the information referred to in paragraph 38(2)(

e) of the Act; (

b) attach that form to the assisted community treatment certificate; and (

c) file the assisted community treatment certificate with the director of the receiving designated facility. 6.

(2) On the transfer, under subsection 23(1) of the Act, of an involuntary patient subject to an assisted community treatment certificate to another designated facility, the patient is deemed to be admitted to the receiving designated facility.

(1) A community treatment plan may be amended by (

a) the director of the designated facility named in the applicable assisted community treatment certificate; or (

b) the medical practitioner responsible for the general supervision and management of the community treatment plan. 7.

(2) A community treatment plan shall be amended if (

a) the director or medical practitioner, whichever is applicable, arranges, under subsection 49(1) of the Act, for other suitable services under the plan; or (

(3) A person referred to in subsection (1) who intends to amend a community treatment plan shall provide notice of the nature of the intended amendments (

a) if applicable, to the director of the designated facility named in the applicable assisted community treatment certificate; and (

b) to the patient and, if applicable, to the patient’s substitute decision maker.

(4) A person referred to in subsection (1) who intends to amend a community treatment plan shall consult with the health professionals and other persons and bodies named in the plan, and proposed to be named in the amended plan, to ensure that adequate treatment, services and support will be available for the patient.

(5) Before an amendment is made to a community treatment plan, a written agreement must be received by the director or medical practitioner from each person and body named in the amended plan, in respect of the responsibilities of that person or body under the plan.

(6) An amendment to a community treatment plan must be (

a) made in an approved form; (

b) attached to the applicable assisted community treatment certificate; and (

c) filed with the director of the designated facility named in the plan.

(1) The medical practitioner responsible for the general supervision and management of a community treatment plan for an involuntary patient may, in accordance with this section, renew the applicable assisted community treatment certificate by issuing a new assisted community treatment certificate. 8.

(2) Before renewing an assisted community treatment certificate under subsection (1), the medical practitioner shall (

(1) A designation, under subsection 41(2) of the Act, may be made, in writing, by (

a) the director of the designated facility named in the applicable assisted community treatment certificate; or (

b) the medical practitioner responsible, either under subsection 41(1) of the Act or under a previous designation, for the general supervision and management of the community treatment plan. 9.

a) include the period during which the designation is effective; and (

b) provided to the health professionals and other persons and bodies named in the plan.

(1) A designation, under subsection 42(2) of the Act, may be made, in writing, by the applicable health professional or other person or body if that professional, person or body is satisfied that the designate is qualified and capable of complying with subsection 42(1) of the Act. 10.

In exceptional circumstances, the director of the designated facility or the medical practitioner responsible for the general supervision and management of the community treatment plan may amend a designation made under subsection 41(2) or 42(2) of the Act, and sections 9 or 10 apply to that amendment. 11.

(1) If an assisted community treatment certificate was issued for an involuntary patient, notice must be provided to the health professionals and other persons and bodies named in the community treatment plan (

a) in the case of the cancellation of a certificate of involuntary admission under

section 21, or subsections 44(2), 46(2) or 50(2) of the Act, within 24 hours after the cancellation of that certificate; and (

b) in the case of the issuance of a certificate cancelling an assisted community treatment certificate under subsection 48(1) or 49(2) of the Act, within 24 hours after the issuance of that certificate. 13.

(2) If an assisted community treatment certificate was issued for an involuntary patient, notice of the expiration of a certificate of involuntary admission or of the expiration of an assisted community treatment certificate must be provided, at least 14 days before the expiry of the certificate, to the health professionals and other persons and bodies named in the community treatment plan.
