An act to add

Section 52064.7 to the Education Code, relating to school accountability. school accountability School accountability: school climate report. Existing law requires the governing board of each school district and county board of education to adopt a local control accountability plan and to update its local control and accountability plan before July of each year. Existing law requires a local control and accountability plan to include, among other things, a description of the annual goals to be achieved for each state priority, as specified, for all pupils and certain subgroups of pupils.

The state’s delineated priorities include, among others, pupil engagement, as measured by specified attendance, dropout, and graduation rates, and school climate, as measured by pupil suspension and expulsion rates and other local measures, as provided. Existing law requires the State Department of Education, in collaboration with, and subject to the approval of, the executive director of the State Board of Education, to develop and maintain the California School Dashboard, a web-based system for publicly reporting performance data on the state and local indicators included in the evaluation rubrics.

The department, pursuant to the requirement of developing the California School Dashboard, has included as one of several local indicators, school climate, as measured by a local climate survey.</xhtml:p>"?> This bill, commencing with the 2026–27 school year, would require a school district, county office of education, or charter school that serves pupils in any of grades to 12, inclusive, to annually (1) compile a school climate report detailing the pupil engagement and school climate data collected for purposes of their local control and accountability plan, and (2) if the local educational agency identifies any deficiencies in school climate, detail a plan to improve school climate to be included in the report.

The bill would require the school climate report, including the plan to improve school climate, if applicable, to be presented at a regularly scheduled meeting of the governing board or body of the local educational agency and made public accessibly on the local educational agency’s internet website, as provided. By imposing additional duties on local educational agencies, the bill would impose a state-mandated local program. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state.

Statutory provisions establish procedures for making that reimbursement. This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to the statutory provisions noted above. SECTION

Section 52064.7 is added to the Education Code , to read: 52064.7. (

a) Commencing with the 2026–27 school year, and annually thereafter, a local educational agency serving pupils in any of grades to 12, inclusive, shall compile a school climate report detailing data collected pursuant to paragraphs (5) and (6) of subdivision (

d) of

Section 52060. If the local educational agency identifies any deficiencies in school climate, the local educational agency shall detail a plan to improve school climate, which shall be included in the school climate report. (

b) A local educational agency shall present the school climate report, including the plan to improve school climate, if applicable, as its own agenda item at a regularly scheduled meeting of the governing board or body of the local educational agency for discussion and public input, and shall make the school climate report, including the plan to improve school climate, if applicable, publicly available on the local educational agency’s internet website within days of being presented at the meeting. (

c) For purposes of this section, “local educational agency” means a school district, county office of education, or charter school.

SEC. 2. If the Commission on State Mandates determines that this act contains costs mandated by the state, reimbursement to local agencies and school districts for those costs shall be made pursuant to

Part 7 (commencing with

Section 17500) of Division of Title of the Government Code. <caml:Num>SECTION 1.</caml:Num><caml:ActionLine action="IS_AMENDED" xlink:href="urn:caml:codes:EDC:caml#xpointer(%2Fcaml%3ALawDoc%2Fcaml%3ACode%2Fcaml%3ALawHeading%5B%40type%3D'TITLE'%20and%20caml%3ANum%3D'2.'%5D%2Fcaml%3ALawHeading%5B%40type%3D'DIVISION'%20and%20caml%3ANum%3D'4.'%5D%2Fcaml%3ALawHeading%5B%40type%3D'PART'%20and%20caml%3ANum%3D'28.'%5D%2Fcaml%3ALawHeading%5B%40type%3D'CHAPTER'%20and%20caml%3ANum%3D'6.1.'%5D%2Fcaml%3ALawHeading%5B%40type%3D'ARTICLE'%20and%20caml%3ANum%3D'4.5.'%5D%2Fcaml%3ALawSection%5Bcaml%3ANum%3D'52060.'%5D)" xlink:label="fractionType: LAW_SECTION" xlink:type="locator">Section of the <caml:DocName>Education Code</caml:DocName> is amended to read:</caml:ActionLine><caml:Fragment><caml:LawSection id="id_20AD49D0-801C-4E37-BE74-32829E4E2BB7"><caml:Num>52060.</caml:Num><caml:LawSectionVersion id="id_F5F2ABBD-1263-480D-951E-9B01522224E3"><caml:Content><xhtml:p>(a)<xhtml:span class="EnSpace"/>On or before July 1, 2014, the governing board of each school district shall adopt a local control and accountability plan using a template adopted by the state board.</xhtml:p><xhtml:p>(b)<xhtml:span class="EnSpace"/>A local control and accountability plan adopted by the governing board of a school district shall be effective for a period of three years, and shall be updated on or before July of each year.</xhtml:p><xhtml:p>(c)<xhtml:span class="EnSpace"/>A local control and accountability plan adopted by the governing board of a school district shall include, for the school district and each school within the school district, all of the information specified in the template adopted by the state board pursuant to

Section 52064.</xhtml:p><xhtml:p>(d)<xhtml:span class="EnSpace"/>All of the following are state priorities for purposes of a school district’s local control and accountability plan:</xhtml:p><xhtml:p>(1)<xhtml:span class="EnSpace"/>The degree to which the teachers of the school district are appropriately assigned in accordance with

Section 44258.9, and fully credentialed in the subject areas, and, for the pupils they are teaching, every pupil in the school district has sufficient access to the standards-aligned instructional materials as determined pursuant to

Section 60119, and school facilities are maintained in good repair, as defined in subdivision (

d) of

Section 17002.</xhtml:p><xhtml:p>(2)<xhtml:span class="EnSpace"/>Implementation of the academic content and performance standards adopted by the state board, including how the programs and services will enable English learners to access the common core academic content standards adopted pursuant to

Section 60605.8 and the English language development standards adopted pursuant to former

Section 60811.3, as that

section read on June 30, 2013, or former

Section 60811.4, as that

section read on June 30, 2016, for purposes of gaining academic content knowledge and English language proficiency.</xhtml:p><xhtml:p>(3)<xhtml:span class="EnSpace"/>(A)<xhtml:span class="EnSpace"/>Parental involvement and family engagement, including efforts the school district makes to seek parent input in making decisions for the school district and each individual schoolsite, and including how the school district will promote parental participation in programs for unduplicated pupils and individuals with exceptional needs.</xhtml:p><xhtml:p>(B)<xhtml:span class="EnSpace"/>Family engagement may include, but need not be limited to, efforts by the school district and each individual schoolsite to apply research-based practices, such as welcoming all families into the school community, engaging in effective two-way communication, supporting pupil success, and empowering families to advocate for equity and access.

Family engagement may include, but need not be limited to, treating families as partners to inform, influence, and create practices and programs that support pupil success and collaboration with families and the broader community, expand pupil learning opportunities and community services, and promote civic participation.</xhtml:p><xhtml:p>(4)<xhtml:span class="EnSpace"/>Pupil achievement, as measured by all of the following, as applicable:</xhtml:p><xhtml:p>(A)<xhtml:span class="EnSpace"/>Statewide assessments administered pursuant to

Article 4 (commencing with

Section 60640) of

Chapter of Part or any subsequent assessment, as certified by the state board.</xhtml:p><xhtml:p>(B)<xhtml:span class="EnSpace"/>The percentage of pupils who have successfully completed courses that satisfy the requirements for entrance to the University of California and the California State University.</xhtml:p><xhtml:p>(C)<xhtml:span class="EnSpace"/>The percentage of pupils who have successfully completed courses that satisfy the requirements for career technical education sequences or programs of study that align with state board-approved career technical education standards and frameworks, including, but not limited to, those described in subdivision (

a) of

Section 52302, subdivision (

a) of

Section 52372.5, or paragraph (2) of subdivision (

e) of

Section 54692.</xhtml:p><xhtml:p>(D)<xhtml:span class="EnSpace"/>The percentage of pupils who have successfully completed both types of courses described in subparagraphs (

B) and (C).</xhtml:p><xhtml:p>(E)<xhtml:span class="EnSpace"/>The percentage of English learner pupils who make progress toward English proficiency as measured by the English Language Proficiency Assessments for California or any subsequent assessment of English proficiency, as certified by the state board.</xhtml:p><xhtml:p>(F)<xhtml:span class="EnSpace"/>The English learner reclassification rate.</xhtml:p><xhtml:p>(G)<xhtml:span class="EnSpace"/>The percentage of pupils who have passed an advanced placement examination with a score of or higher.</xhtml:p><xhtml:p>(H)<xhtml:span class="EnSpace"/>The percentage of pupils who demonstrate college preparedness pursuant to the Early Assessment Program, as described in

Chapter 6 (commencing with

Section 99300) of Part of Division of Title 3, or any subsequent assessment of college preparedness.</xhtml:p><xhtml:p>(5)<xhtml:span class="EnSpace"/>Pupil engagement, as measured by all of the following, as applicable:</xhtml:p><xhtml:p>(A)<xhtml:span class="EnSpace"/>School attendance rates.</xhtml:p><xhtml:p>(B)<xhtml:span class="EnSpace"/>Chronic absenteeism rates.</xhtml:p><xhtml:p>(C)<xhtml:span class="EnSpace"/>Middle school dropout rates.</xhtml:p><xhtml:p>(D)<xhtml:span class="EnSpace"/>High school dropout rates.</xhtml:p><xhtml:p>(E)<xhtml:span class="EnSpace"/>High school graduation rates.</xhtml:p><xhtml:p>(6)<xhtml:span class="EnSpace"/>School climate, as measured by all of the following, as applicable:</xhtml:p><xhtml:p>(A)<xhtml:span class="EnSpace"/>Pupil suspension rates.</xhtml:p><xhtml:p>(B)<xhtml:span class="EnSpace"/>Pupil expulsion rates.</xhtml:p><xhtml:p>(C)<xhtml:span class="EnSpace"/>The results of the California Healthy Kids Survey, as required by subdivision (

a) of

Section 52064.7.</xhtml:p><xhtml:p>(D)<xhtml:span class="EnSpace"/>Other local measures, including surveys of pupils, parents, and teachers on the sense of safety and school connectedness.</xhtml:p><xhtml:p>(7)<xhtml:span class="EnSpace"/>The extent to which pupils have access to, and are enrolled in, a broad course of study that includes all of the subject areas described in

Section and subdivisions (

a) to (i), inclusive, of

Section 51220, as applicable, including the programs and services developed and provided to unduplicated pupils and individuals with exceptional needs, and the programs and services that are provided to benefit these pupils as a result of the funding received pursuant to

Section 42238.02, as implemented by

Section 42238.03.</xhtml:p><xhtml:p>(8)<xhtml:span class="EnSpace"/>Pupil outcomes, if available, in the subject areas described in

Section and subdivisions (

a) to (i), inclusive, of

Section 51220, as applicable.</xhtml:p><xhtml:p>(e)<xhtml:span class="EnSpace"/>For purposes of the descriptions required by subdivision (

b) of

Section 52064, the governing board of a school district may consider qualitative information, including, but not limited to, findings that result from school quality reviews conducted pursuant to subdivision (

b) of

Section or any other reviews.</xhtml:p><xhtml:p>(f)<xhtml:span class="EnSpace"/>To the extent practicable, data reported in a local control and accountability plan shall be reported in a manner consistent with how information is reported on the California School Dashboard maintained by the department pursuant to

Section 52064.5.</xhtml:p><xhtml:p>(g)<xhtml:span class="EnSpace"/>The governing board of a school district shall consult with teachers, principals, administrators, other school personnel, local bargaining units of the school district, parents, and pupils in developing a local control and accountability plan.</xhtml:p><xhtml:p>(h)<xhtml:span class="EnSpace"/>A school district may identify local priorities, goals in regard to the local priorities, and the method for measuring the school district’s progress toward achieving those goals.</xhtml:p></caml:Content></caml:LawSectionVersion></caml:LawSection></caml:Fragment></caml:BillSection><caml:BillSection id="id_CC6070DF-4D68-4714-9A8C-5B907B9AA259"><caml:Num>SEC. 2.</caml:Num><caml:ActionLine action="IS_ADDED" xlink:href="urn:caml:codes:EDC:caml#xpointer(%2Fcaml%3ALawDoc%2Fcaml%3ACode%2F%2Fcaml%3ALawSection%5Bcaml%3ANum%3D'52064.7'%5D)" xlink:label="fractionType: LAW_SECTION" xlink:type="locator">Section 52064.7 is added to the <caml:DocName>Education Code</caml:DocName>, to read:</caml:ActionLine><caml:Fragment><caml:LawSection id="id_8E526C0B-A595-4481-8514-D1934FCB281A"><caml:Num>52064.7.</caml:Num><caml:LawSectionVersion id="id_D4D7667F-EC1E-47A0-830A-73573E581DA5"><caml:Content><xhtml:p>(a)<xhtml:span class="EnSpace"/>Commencing with the 2026–27 school year, a local educational agency serving pupils in any of grades to 12, inclusive, shall administer the California Healthy Kids Survey (CHKS) at least once every two years.</xhtml:p><xhtml:p>(b)<xhtml:span class="EnSpace"/>A local educational agency shall develop a School Climate Improvement Report (SCIR) if the local educational agency meets the criteria described in paragraph (1) or (2), or both, pursuant to results from the CHKS, for two consecutive administrations of the survey:</xhtml:p><xhtml:p>(1)<xhtml:span class="EnSpace"/>Falls below an average of percent across all grade levels tested in any of the following categories:</xhtml:p><xhtml:p>(A)<xhtml:span class="EnSpace"/>School connectedness.</xhtml:p><xhtml:p>(B)<xhtml:span class="EnSpace"/>Academic motivation.</xhtml:p><xhtml:p>(C)<xhtml:span class="EnSpace"/>Caring adult relationships.</xhtml:p><xhtml:p>(D)<xhtml:span class="EnSpace"/>Meaningful participation.</xhtml:p><xhtml:p>(E)<xhtml:span class="EnSpace"/>Promotion of parental involvement in school.</xhtml:p><xhtml:p>(F)<xhtml:span class="EnSpace"/>High expectations.</xhtml:p><xhtml:p>(G)<xhtml:span class="EnSpace"/>School perceived as very safe or safe.</xhtml:p><xhtml:p>(2)<xhtml:span class="EnSpace"/>Has an average of more than percent across all grade levels tested in any of the following categories:</xhtml:p><xhtml:p>(A)<xhtml:span class="EnSpace"/>Chronic truancy.</xhtml:p><xhtml:p>(B)<xhtml:span class="EnSpace"/>Experienced any harassment or bullying.</xhtml:p><xhtml:p>(C)<xhtml:span class="EnSpace"/>Had mean rumors or lies spread about you.</xhtml:p><xhtml:p>(D)<xhtml:span class="EnSpace"/>Been afraid of being beaten up.</xhtml:p><xhtml:p>(E)<xhtml:span class="EnSpace"/>Been in a physical fight.</xhtml:p><xhtml:p>(F)<xhtml:span class="EnSpace"/>Seen a weapon on campus.</xhtml:p><xhtml:p>(G)<xhtml:span class="EnSpace"/>Current alcohol or drug use.</xhtml:p><xhtml:p>(H)<xhtml:span class="EnSpace"/>Current marijuana use.</xhtml:p><xhtml:p>(I)<xhtml:span class="EnSpace"/>Very drunk or “high” 7 or more times, ever.</xhtml:p><xhtml:p>(J)<xhtml:span class="EnSpace"/>Been drunk or “high” on drugs at school, ever.</xhtml:p><xhtml:p>(K)<xhtml:span class="EnSpace"/>Current cigarette smoking.</xhtml:p><xhtml:p>(L)<xhtml:span class="EnSpace"/>Current tobacco vaping.</xhtml:p><xhtml:p>(c)<xhtml:span class="EnSpace"/>(1)<xhtml:span class="EnSpace"/>An SCIR shall include all of the following:</xhtml:p><xhtml:p>(A)<xhtml:span class="EnSpace"/>Key areas of concern based on survey responses and local school climate measures.</xhtml:p><xhtml:p>(B)<xhtml:span class="EnSpace"/>An outline of existing strategies and interventions used to address areas identified in survey results.</xhtml:p><xhtml:p>(C)<xhtml:span class="EnSpace"/>Specific additional measures the local educational agency will implement to address concerns.</xhtml:p><xhtml:p>(2)<xhtml:span class="EnSpace"/>A local educational agency shall present an SCIR at a regularly scheduled meeting of the governing board or body of the local educational agency for discussion and public input and shall be publicly accessible on the local educational agency’s internet website within days of being presented at the meeting.</xhtml:p><xhtml:p>(3)<xhtml:span class="EnSpace"/>To the extent possible, a local educational agency may use the information from an SCIR to meet the requirements of the school climate local indicator developed for the California School Dashboard pursuant to

Section 52064.7.</xhtml:p><xhtml:p>(D)<xhtml:span class="EnSpace"/>Other local measures, including surveys of pupils, parents, and teachers on the sense of safety and school connectedness.</xhtml:p><xhtml:p>(7)<xhtml:span class="EnSpace"/>The extent to which pupils have access to, and are enrolled in, a broad course of study that includes all of the subject areas described in

Section and subdivisions (

a) to (i), inclusive, of

Section 51220, as applicable, including the programs and services developed and provided to unduplicated pupils and individuals with exceptional needs, and the programs and services that are provided to benefit these pupils as a result of the funding received pursuant to

Section 42238.02, as implemented by

Section 42238.03.</xhtml:p><xhtml:p>(8)<xhtml:span class="EnSpace"/>Pupil outcomes, if available, in the subject areas described in

Section and subdivisions (

a) to (i), inclusive, of

Section 51220, as applicable.</xhtml:p><xhtml:p>(9)<xhtml:span class="EnSpace"/>How the county superintendent of schools will coordinate instruction of expelled pupils pursuant to

Section 48926.</xhtml:p><xhtml:p>(10)<xhtml:span class="EnSpace"/>How the county superintendent of schools will coordinate services for foster children, including, but not limited to, all of the following:</xhtml:p><xhtml:p>(A)<xhtml:span class="EnSpace"/>Working with the county child welfare agency to minimize changes in school placement.</xhtml:p><xhtml:p>(B)<xhtml:span class="EnSpace"/>Providing education-related information to the county child welfare agency to assist the county child welfare agency in the delivery of services to foster children, including, but not limited to, educational status and progress information that is required to be included in court reports.</xhtml:p><xhtml:p>(C)<xhtml:span class="EnSpace"/>Responding to requests from the juvenile court for information and working with the juvenile court to ensure the delivery and coordination of necessary educational services.</xhtml:p><xhtml:p>(D)<xhtml:span class="EnSpace"/>Establishing a mechanism for the efficient expeditious transfer of health and education records and the health and education passport.</xhtml:p><xhtml:p>(e)<xhtml:span class="EnSpace"/>For purposes of the descriptions required by subdivision (

b) of

Section 52064, a county board of education may consider qualitative information, including, but not limited to, findings that result from school quality reviews conducted pursuant to subdivision (

b) of

Section or any other reviews.</xhtml:p><xhtml:p>(f)<xhtml:span class="EnSpace"/>To the extent practicable, data reported in a local control and accountability plan shall be reported in a manner consistent with how information is reported on the California School Dashboard maintained by the department pursuant to

Section 52064.5.</xhtml:p><xhtml:p>(g)<xhtml:span class="EnSpace"/>The county superintendent of schools shall consult with teachers, principals, administrators, other school personnel, local bargaining units of the county office of education, parents, and pupils in developing a local control and accountability plan.</xhtml:p><xhtml:p>(h)<xhtml:span class="EnSpace"/>A county board of education may identify local priorities, goals in regard to the local priorities, and the method for measuring the county office of education’s progress toward achieving those goals.</xhtml:p><xhtml:p>(i)<xhtml:span class="EnSpace"/>(1)<xhtml:span class="EnSpace"/>Beginning with the 2018–19 fiscal year and in each fiscal year thereafter, a county superintendent of schools shall prepare a

summary of how the county superintendent of schools plans to support school districts and schools within the county in implementing this

article and present the

summary to the county board of education at the same public meeting required under paragraph (2) of subdivision (

b) of

Section 52068. The

summary shall include, but is not necessarily limited to, all of the following:</xhtml:p><xhtml:p>(A)<xhtml:span class="EnSpace"/>A description of how the county superintendent of schools will support the continuous improvement of all school districts within the county, including steps that the county superintendent of schools plans to take to collaborate with the California Collaborative for Educational Excellence, the department, the lead agencies specified in Sections and 52073.1, and other county superintendents of schools to support school districts and schools within the county in implementing this article.</xhtml:p><xhtml:p>(B)<xhtml:span class="EnSpace"/>A description of how the county superintendent of schools will assist each school district identified for technical assistance pursuant to subdivision (

c) of

Section and each charter school identified for technical assistance pursuant to subdivision (

a) of

Section 47607.3 in improving pupil outcomes, including, at a minimum, clearly identifying the activities being performed by the county office of education and the source of funding for those activities. This description shall include the actions the school district and charter school will take independent of the county superintendent of schools to improve pupil outcomes pursuant to subparagraph (

C) of paragraph (1) of subdivision (

c) of

Section or paragraph (3) of subdivision (

a) of

Section 47607.3.</xhtml:p><xhtml:p>(C)<xhtml:span class="EnSpace"/>One or more goals for each of the following:</xhtml:p><xhtml:p>(i)<xhtml:span class="EnSpace"/>Completing the review of local control and accountability plans submitted by school districts pursuant to

Section 52070.</xhtml:p><xhtml:p>(ii)<xhtml:span class="EnSpace"/>Providing technical assistance to school districts pursuant to subdivisions (

a) and (

b) of

Section and charter schools pursuant to subdivision (

a) of

Section 47607.3.</xhtml:p><xhtml:p>(iii)<xhtml:span class="EnSpace"/>Providing any other support to school districts and schools within the county in implementing this article.</xhtml:p><xhtml:p>(iv)<xhtml:span class="EnSpace"/>Providing support to school districts in developing and implementing the addendum specified in

Section 52064.3.</xhtml:p><xhtml:p>(D)<xhtml:span class="EnSpace"/>One or more metrics to assess progress toward each goal identified in subparagraph (C).</xhtml:p><xhtml:p>(E)<xhtml:span class="EnSpace"/>Specific actions and related expenditures to achieve each goal identified in subparagraph (C), to the extent this information is not provided pursuant to subparagraph (B).

The specific actions shall not supersede the provisions of existing local collective bargaining agreements within the jurisdiction of the county superintendent of schools.</xhtml:p><xhtml:p>(2)<xhtml:span class="EnSpace"/>Commencing with the 2019–20 fiscal year and in each fiscal year thereafter, the county superintendent of schools shall submit the

summary described in this subdivision with its local control and accountability plan pursuant to subdivision (

a) of

Section 52070.5.</xhtml:p><xhtml:p>(3)<xhtml:span class="EnSpace"/>On or before November of each year, the department shall compile the information provided by county superintendents of schools pursuant to subparagraphs (

A) and (

B) of paragraph (1) into a single document and shall make this report available to the public on the department’s internet website.</xhtml:p></caml:Content></caml:LawSectionVersion></caml:LawSection></caml:Fragment></caml:BillSection><caml:BillSection id="id_398B8B44-6976-48E4-BF19-0F8E784CA107"><caml:Num>SEC. 4.</caml:Num><caml:Content><xhtml:p>If the Commission on State Mandates determines that this act contains costs mandated by the state, reimbursement to local agencies and school districts for those costs shall be made pursuant to

Part 7 (commencing with

Section 17500) of Division of Title of the Government Code.</xhtml:p></caml:Content></caml:BillSection>"?>
