An act to add

Article 9 (commencing with

Section 49397) to

Chapter of Part of Division of Title of the Education Code, relating to pupil safety. pupil safety Pupil safety: electric bicycle: safety and training program. Existing law establishes the State Department of Education in state government, and vests the department with specified powers and duties relating to the state’s public school system. Existing law establishes the Department of the California Highway Patrol, under the control of the Commissioner of the California Highway Patrol, within the Transportation Agency.

Existing law requires the Department of the California Highway Patrol to develop statewide safety and training programs based on evidence-based practices for users of electric bicycles. This bill would require, on or before March 1, 2028, the State Department of Education, in consultation with the Department of the California Highway Patrol, to develop a standardized electric bicycle safety and training program for pupils in grades to 12, inclusive, as provided.

In developing the program, the bill would authorize the State Department of Education and the Department of the California Highway Patrol to collaborate with local law enforcement agencies or local governments that have implemented electric bicycle training programs already to ensure the program reflects proven best practices. The bill would encourage local educational agencies and parent organizations to offer training demonstrations to pupils and parents on electric bicycle operations in collaboration with local law enforcement agencies or local governments, as specified.

Existing law authorizes the governing board of any school district having jurisdiction over elementary, intermediate, junior high, or high school to provide time and facilities to local law enforcement agency having jurisdiction over the school of the district for bicycle, scooter, electric bicycle, motorized bicycle, or motorized scooter safety instruction.

Existing law prohibits a person from driving or parking a vehicle or animal upon the driveways, paths, parking facilities, or grounds of specific public entities, including a public school or an educational institution exempted, in whole or in part, from taxation, except with the permission of, and subject to any condition or regulation that may be imposed by, the governing body of the specified public entity.

Existing law authorizes a public agency to adopt rules or regulations to restrict, or specify the conditions for, the use of bicycles, motorized bicycles, electric bicycles, skateboards, electrically motorized boards, and roller skates on public property under the jurisdiction of that agency.</xhtml:p><xhtml:p>This bill would require each school district and county office of education that allows pupils in kindergarten or any of grades to 12, inclusive, to park a class 1, 2, or electric bicycle, as defined, on campus to require pupils to complete the electric bicycle safety and training program developed by the Department of the California Highway Patrol, as provided, or a related safety course, as specified, as a condition for parking on campus.

The bill would also require a pupil to submit proof of completion of the above-described course to their school before parking their class 1, 2, or electric bicycle on the school campus. The bill would exempt school districts and county offices of education that adopted a policy related to electric bicycle safety, on or before January 1, 2027, from the above-described requirements.</xhtml:p>"?> MAJORITY NO YES NO NO NO NO NO NO NO NO The people of the State of California do enact as follows:

SECTION

Article 9 (commencing with

Section 49397) is added to

Chapter of Part of Division of Title of the Education Code , to read: 9. Electric Bicycle Safety 49397. (a)

(1) On or before March 1, 2028, the department, in consultation with the Department of the California Highway Patrol, shall develop a standardized electric bicycle safety and training program for pupils in grades to 12, inclusive.

(2) The program developed pursuant to paragraph (1) shall include, but is not limited to, an online component consisting of instructional videos and a knowledge-based comprehensive assessment covering rules of the road, operating differences between the classes of electric bicycles, required safety equipment, and the civil and criminal implications of operating noncompliant electric bicycles that exceed legal speed limits.

(3) The department and the Department of the California Highway Patrol may collaborate with local law enforcement agencies or local governments that have already implemented electric bicycle training programs to ensure the program developed pursuant to paragraph (1) reflects proven best practices. (

b) A local educational agency or parent organization, in collaboration with local law enforcement agencies or local governments, is encouraged to offer training demonstrations to pupils and parents on electric bicycle operations related to safe mounting, braking, signaling, yielding, and riding protocols. These training demonstrations may be administered on school campuses or at a designated community facility. (

c) For purposes of this section, the following

definitions apply: (1) “Classes of electric bicycles” include “class electric bicycles,” “class electric bicycles,” and “class electric bicycles,” as defined in

Section 312.5 of the Vehicle Code. Section of the Streets and Highway Code, or a related safety course, if one is available, as prescribed by a local government or the local law enforcement authority having jurisdiction over the school, as a condition for parking on campus.</xhtml:p><xhtml:p>(b)<xhtml:span class="EnSpace"/>A pupil shall submit proof of completion from one of the prescribed courses described in subdivision (

a) to their school before parking their class 1, 2, or electric bicycle on the school campus.</xhtml:p><xhtml:p>(c)<xhtml:span class="EnSpace"/>A local educational agency that has adopted a policy related to electric bicycle safety on or before January 1, 2027, shall be exempt from the requirements of this section.</xhtml:p><xhtml:p>(d)<xhtml:span class="EnSpace"/>For purposes of this section, the following

definitions apply:</xhtml:p><xhtml:p>(1)<xhtml:span class="EnSpace"/>“Class electric bicycle,” “class electric bicycle,” and “class electric bicycle” shall have the same meanings as prescribed in
