An act to amend

Section 14045.15 of the Welfare and Institutions Code, relating to Medi-Cal. Medi-Cal Mental health services: peer support specialist certification. Existing law establishes the Medi-Cal program, which is administered by the State Department of Health Care Services and under which qualified low-income persons receive health care benefits. The Medi-Cal program is, in part, governed and funded by federal Medicaid program provisions. Existing law establishes a

schedule of benefits under the Medi-Cal program and provides for various services, including behavioral and mental health services that are rendered by Medi-Cal enrolled providers. Existing law authorizes a county, or an agency representing the county, to develop a peer support specialist certification program, subject to department approval. Existing law imposes specified requirements on applicants for certification as a peer support specialist, including that the applicant be at least years of age and possess a high school diploma or equivalent degree.

This bill would remove the requirement of possessing a high school diploma or equivalent degree from the requirements necessary for an applicant to receive certification. Existing law required the Department of Health Care Access and Information, on or before July 1, 2023, to develop and approve statewide requirements for community health worker certificate programs. Existing law requires the department, as part of developing those requirements, to, among other things, determine the necessary curriculum to meet certificate program objectives.

Existing law defines “community health worker” for these purposes to mean a liaison, link, or intermediary between health and social services and the community to facilitate access to services and to improve the access and cultural competence of service delivery.

Existing law specifies that “community health worker” include Promotores, Promotores de Salud, Community Health Representatives, navigators, and other nonlicensed health workers with the qualifications developed by the department. </xhtml:p><xhtml:p>This bill would also specify for these purposes that a “community health worker” includes a peer support specialist and would deem a certified peer support specialist to have satisfied all education and training requirements developed by the department for certification as a community health worker.</xhtml:p>"?> MAJORITY NO YES NO NO NO NO NO NO NO NO The people of the State of California do enact as follows:

SECTION

Section 14045.15 of the Welfare and Institutions Code is amended to read: 14045.15. (

a) To receive a certification under this article, an applicant shall meet all of the following requirements:

(1) Be at least years of age. (2)<xhtml:span class="EnSpace"/>Possess a high school diploma or equivalent degree.</xhtml:p><xhtml:p>(3)</xhtml:p>"?>

(2) Be self-identified as having experience with the process of recovery from mental illness or substance use disorder either as a consumer of these services or as the parent or family member of the consumer. (4)</xhtml:p>"?>

(3) Be willing to share their experience. (5)</xhtml:p>"?>

(4) Have a strong dedication to recovery. (6)</xhtml:p>"?>

(5) Agree, in writing, to adhere to a code of ethics. (7)</xhtml:p>"?>

(6) Successfully complete the curriculum and training requirements for a peer support specialist. (8)</xhtml:p>"?>

(7) Pass a certification examination approved by the department for a peer support specialist. (

b) To maintain certification under this article, a certified peer support specialist shall meet both of the following requirements:

(1) Adhere to the code of ethics and biennially sign an affirmation.

(2) Complete any required continuing education, training, and recertification requirements. <caml:Num>SECTION 1.</caml:Num><caml:ActionLine action="IS_AMENDED" xlink:href="urn:caml:codes:WIC:caml#xpointer(%2Fcaml%3ALawDoc%2Fcaml%3ACode%2Fcaml%3ALawHeading%5B%40type%3D'DIVISION'%20and%20caml%3ANum%3D'9.'%5D%2Fcaml%3ALawHeading%5B%40type%3D'PART'%20and%20caml%3ANum%3D'6.'%5D%2Fcaml%3ALawHeading%5B%40type%3D'CHAPTER'%20and%20caml%3ANum%3D'16.5.'%5D%2Fcaml%3ALawSection%5Bcaml%3ANum%3D'18998.'%5D)" xlink:label="fractionType: LAW_SECTION" xlink:type="locator">Section of the <caml:DocName>Welfare and Institutions Code</caml:DocName> is amended to read:</caml:ActionLine><caml:Fragment><caml:LawSection id="id_451AA441-2648-4F5E-8048-A9D52E49353B"><caml:Num>18998.</caml:Num><caml:LawSectionVersion id="id_147D790F-7582-41BF-8921-8C1F80D5D863"><caml:Content><xhtml:p>For purposes of this chapter, the following terms have the following meanings:</xhtml:p><xhtml:p>(a)<xhtml:span class="EnSpace"/>“Community-defined” means a set of practices that communities have used and found to yield positive results, as determined by community consensus over time.

These practices may or may not have been measured empirically, but have reached a level of acceptance by the community.</xhtml:p><xhtml:p>(b)<xhtml:span class="EnSpace"/>“Community health worker” means a liaison, link, or intermediary between health and social services and the community to facilitate access to services and to improve the access and cultural competence of service delivery. A community health worker is a frontline health worker either trusted by, or who has a close understanding of, the community served.

Community health workers include Promotores, Promotores de Salud, Community Health Representatives, navigators, peer support specialists, as defined in

Section 14045.12, and other nonlicensed health workers with the qualifications developed pursuant to this chapter, including violence prevention professionals.

A community health worker’s lived experience shall align with and provide a connection to the community being served.</xhtml:p><xhtml:p>(c)<xhtml:span class="EnSpace"/>“Core competencies” means the foundational and essential knowledge, skills, and abilities required for community health workers, which include all of the following:</xhtml:p><xhtml:p>(1)<xhtml:span class="EnSpace"/>Communication skills.</xhtml:p><xhtml:p>(2)<xhtml:span class="EnSpace"/>Interpersonal and relationship-building skills.</xhtml:p><xhtml:p>(3)<xhtml:span class="EnSpace"/>Service coordination and navigation skills.</xhtml:p><xhtml:p>(4)<xhtml:span class="EnSpace"/>Capacity building skills.</xhtml:p><xhtml:p>(5)<xhtml:span class="EnSpace"/>Advocacy skills.</xhtml:p><xhtml:p>(6)<xhtml:span class="EnSpace"/>Education and facilitation skills.</xhtml:p><xhtml:p>(7)<xhtml:span class="EnSpace"/>Individual and community assessment skills.</xhtml:p><xhtml:p>(8)<xhtml:span class="EnSpace"/>Outreach skills.</xhtml:p><xhtml:p>(9)<xhtml:span class="EnSpace"/>Professional skills and conduct.</xhtml:p><xhtml:p>(10)<xhtml:span class="EnSpace"/>Evaluation and research skills.</xhtml:p><xhtml:p>(11)<xhtml:span class="EnSpace"/>Knowledge base, including knowledge of basic public health principles, and social determinants of health and related disparities, of the community to be served.</xhtml:p><xhtml:p>(d)<xhtml:span class="EnSpace"/>“Cultural competence” means a set of congruent behaviors, attitudes, and policies that come together in a system or agency that enables that system or agency to work effectively in cross-cultural situations.

A culturally competent system of care acknowledges and incorporates, at all levels, the importance of language and culture, intersecting identities, assessment of cross-cultural relations, knowledge and acceptance of dynamics of cultural differences, expansion of cultural knowledge, and adaptation of services to meet culturally unique needs to provide services in a culturally competent manner.</xhtml:p><xhtml:p>(e)<xhtml:span class="EnSpace"/>“Department” means the Department of Health Care Access and Information.</xhtml:p><xhtml:p>(f)<xhtml:span class="EnSpace"/>“Lived experience” means personal knowledge of a specific health condition or circumstance, which may include, but not be limited to, Alzheimer’s and other related dementia, climate impact on health, disability, foster system placement, homelessness, justice involved, LGBTQ+ status, mental health conditions, substance use, military service, pregnancy, and birth.

A community health worker may draw on their lived experience to assist other individuals with navigation to treatment and services.

A community health worker with lived experience involving a behavioral health or other health condition may need additional training on how to appropriately use this lived experience to assist other individuals with their recovery from that condition.</xhtml:p><xhtml:p>(g)<xhtml:span class="EnSpace"/>“Specialty certificate” means the next level of training that concentrates on specific program focus areas, with learning objectives and topics tailored to the skills required for distinct program and population needs.</xhtml:p></caml:Content></caml:LawSectionVersion></caml:LawSection></caml:Fragment></caml:BillSection><caml:BillSection id="id_613C6EC0-67D3-43A4-8CEC-F42A6ED6ECB2"><caml:Num>SEC. 2.</caml:Num><caml:ActionLine action="IS_AMENDED" xlink:href="urn:caml:codes:WIC:caml#xpointer(%2Fcaml%3ALawDoc%2Fcaml%3ACode%2Fcaml%3ALawHeading%5B%40type%3D'DIVISION'%20and%20caml%3ANum%3D'9.'%5D%2Fcaml%3ALawHeading%5B%40type%3D'PART'%20and%20caml%3ANum%3D'6.'%5D%2Fcaml%3ALawHeading%5B%40type%3D'CHAPTER'%20and%20caml%3ANum%3D'16.5.'%5D%2Fcaml%3ALawSection%5Bcaml%3ANum%3D'18998.1.'%5D)" xlink:label="fractionType: LAW_SECTION" xlink:type="locator">Section 18998.1 of the <caml:DocName>Welfare and Institutions Code</caml:DocName> is amended to read:</caml:ActionLine><caml:Fragment><caml:LawSection id="id_5423EB5F-8DA7-4BEC-8487-18C88D7C9DE2"><caml:Num>18998.1.</caml:Num><caml:LawSectionVersion id="id_78615C69-EFFF-426F-9815-A70167876C42"><caml:Content><xhtml:p>(a)<xhtml:span class="EnSpace"/>On or before July 1, 2023, the department shall do all of the following:</xhtml:p><xhtml:p>(1)<xhtml:span class="EnSpace"/>Develop statewide requirements for community health worker certificate programs in consultation with stakeholders, including, but not limited to, the State Department of Health Care Services, the State Department of Public Health, community health workers, Promotores and Promotores de Salud, or representative organizations.

In developing the requirements, the department shall do all of the following:</xhtml:p><xhtml:p>(A)<xhtml:span class="EnSpace"/>Consult evidenced-based and community-defined materials.</xhtml:p><xhtml:p>(B)<xhtml:span class="EnSpace"/>Determine necessary curriculum to meet certificate program objectives.</xhtml:p><xhtml:p>(C)<xhtml:span class="EnSpace"/>Determine criteria for specialty certificate programs and specialized training requirements that build on the lived experience of community health workers.</xhtml:p><xhtml:p>(D)<xhtml:span class="EnSpace"/>Determine a structure of statewide oversight that reduces barriers to training.</xhtml:p><xhtml:p>(E)<xhtml:span class="EnSpace"/>Determine how past experience as a community health worker may provide a pathway to certification, and how to verify past experience.</xhtml:p><xhtml:p>(2)<xhtml:span class="EnSpace"/>Approve statewide requirements for the development of certificate programs for community health workers.</xhtml:p><xhtml:p>(3)<xhtml:span class="EnSpace"/>Approve the curriculum required for programs to certify community health workers.</xhtml:p><xhtml:p>(4)<xhtml:span class="EnSpace"/>Review, approve, or renew evidence-based curricula and community-defined curricula for core competencies, specialized programs, and training.</xhtml:p><xhtml:p>(b)<xhtml:span class="EnSpace"/>Notwithstanding subdivision (a), a peer support specialist certified pursuant to

Article 1.4 (commencing with

Section 14045.10) of

Chapter of Part shall be deemed to have satisfied all education and training requirements developed by the department for certification as a community health worker.</xhtml:p></caml:Content></caml:LawSectionVersion></caml:LawSection></caml:Fragment></caml:BillSection>"?>
