An act to add

Section 51225.45 to the Education Code, relating to career technical education. career technical education Career technical education: high school graduation requirements: apprenticeship and preapprenticeship programs. Existing law requires a pupil to complete designated coursework while in grades to 12, inclusive, in order to receive a diploma of graduation from high school. The coursework requirements include, among others, the completion of one course in visual or performing arts, foreign language, or career technical education.

Existing law establishes the Division of Apprenticeship Standards within the Department of Industrial Relations and requires the division, among other things, to evaluate apprenticeship and preapprenticeship programs to ensure that the program evaluated is complying with its standard, as specified.

This bill would authorize school districts, county offices of education, and charter schools to deem a pupil who successfully completes coursework provided in an apprenticeship or preapprenticeship program to have fulfilled, in order to receive a diploma of graduation from high school, the one course in visual or performing arts, foreign language, or career technical education requirement if the apprenticeship or preapprenticeship program meets specified requirements, including, among others, that it is approved by the division or registered with the United States Department of Labor.

Existing law requires the Commission on Teacher Credentialing to, among other things, establish standards for the issuance and renewal of credentials, certificates, and permits, as specified. Existing law imposes minimum requirements for a preliminary multiple subject, single subject, or education specialist teaching credential.

Existing law specifies minimum requirements for the 3-year preliminary designated subjects career technical education teaching credential and the 5-year clear designated subjects career technical education teaching credential.</xhtml:p><xhtml:p>This bill would require the commission to grant a waiver from the minimum requirements for the 3-year preliminary designated subjects career technical education teaching credential and the 5-year clear designated subjects career technical education teaching credential to an individual meeting prescribed requirements, including, among other things, having a valid industry-recognized certification in a trade designated by the commission.

The bill would require the commission to develop and maintain a list of designated trades eligible for the waiver, as provided.</xhtml:p>"?> MAJORITY NO NO NO NO NO NO NO NO NO NO The people of the State of California do enact as follows:

SECTION

Section 51225.45 is added to the Education Code , to read: 51225.45. (

a) A local educational agency may deem a pupil who successfully completes a course, or a series of courses, provided in an apprenticeship or preapprenticeship program to have fulfilled the requirements of subparagraph (

E) of paragraph (1) of subdivision (

a) of

Section 51225.3 if the apprenticeship or preapprenticeship program meets all of the following requirements:

(1) The program is approved by the Division of Apprenticeship Standards or registered with the United States Department of Labor.

(2) The instructional content of the coursework aligns with the model curriculum standards for career technical education adopted pursuant to

Section 51226.

(3) The coursework is supervised by qualified industry instructors approved by the Division of Apprenticeship Standards pursuant to

Chapter 4 (commencing with

Section 3070) of Division of the Labor Code or certified by the North America’s Building Trades Unions. (

b) For purposes of this section, a “local educational agency” means a school district, county office of education, or charter school. <caml:Num>SECTION 1.</caml:Num><caml:ActionLine action="IS_ADDED" xlink:href="urn:caml:codes:EDC:caml#xpointer(%2Fcaml%3ALawDoc%2Fcaml%3ACode%2F%2Fcaml%3ALawSection%5Bcaml%3ANum%3D'44260.15'%5D)" xlink:label="fractionType: LAW_SECTION" xlink:type="locator">Section 44260.15 is added to the <caml:DocName>Education Code</caml:DocName>, <caml:Positioning>immediately following

Section 44260.1</caml:Positioning>, to read:</caml:ActionLine><caml:Fragment><caml:LawSection id="id_CF47B070-B5D8-42A3-B426-86A53A068E9E"><caml:Num>44260.15.</caml:Num><caml:LawSectionVersion id="id_C388CD83-351B-4FFB-B072-7B82751E735B"><caml:Content><xhtml:p>(a)<xhtml:span class="EnSpace"/>The commission shall grant a waiver from the minimum requirements prescribed in Sections and 44260.1 to an individual meeting all of the following requirements:</xhtml:p><xhtml:p>(1)<xhtml:span class="EnSpace"/>Possesses a valid industry-recognized certification in a trade designated by the commission pursuant to subdivision (b).</xhtml:p><xhtml:p>(2)<xhtml:span class="EnSpace"/>Has a minimum of five years of documented work experience in a trade designated by the commission pursuant to subdivision (b).</xhtml:p><xhtml:p>(3)<xhtml:span class="EnSpace"/>Successfully completes a commission-approved course on teaching and classroom management.</xhtml:p><xhtml:p>(b)<xhtml:span class="EnSpace"/>The commission shall develop and maintain a list of designated trades eligible for a waiver pursuant to subdivision (a).

The list of designated trades shall include, but is not limited to, general contracting, masonry, welding, heating, ventilation, and air conditioning (HVAC), electrical, auto and diesel repair, healthcare, and medical field trades.

The commission shall consider the following factors when designating additional trades to include on the list:</xhtml:p><xhtml:p>(1)<xhtml:span class="EnSpace"/>Whether the trade requires a high level of skill and knowledge.</xhtml:p><xhtml:p>(2)<xhtml:span class="EnSpace"/>Whether there is a demonstrated shortage of qualified career technical education instructors in the trade.</xhtml:p><xhtml:p>(3)<xhtml:span class="EnSpace"/>Whether the trade has established industry-recognized certification programs that include all of the following:</xhtml:p><xhtml:p>(A)<xhtml:span class="EnSpace"/>A minimum of 4,000 hours of documented, supervised work experience in the trade.</xhtml:p><xhtml:p>(B)<xhtml:span class="EnSpace"/>A comprehensive examination process covering both theoretical knowledge and practical skills.</xhtml:p><xhtml:p>(C)<xhtml:span class="EnSpace"/>Ongoing professional development and continuing education requirements.</xhtml:p><xhtml:p>(D)<xhtml:span class="EnSpace"/>A system for tracking and reporting work experience and continuing education to an industry-recognized certification body or state licensing board.</xhtml:p><xhtml:p>(c)<xhtml:span class="EnSpace"/>The commission shall adopt regulations to implement this section.</xhtml:p></caml:Content></caml:LawSectionVersion></caml:LawSection></caml:Fragment></caml:BillSection>"?>
