A. On June 23,20 25, the Council passed Resolution No. R-31 6263, approving the City's Fiscal Year 20 26 Budget (20 26 Budget). B. On June 30 ,20 25, the San Diego City Council (Council) adopted Ordinance No.

O-21 981 entitled "An Ordinance Adopting the Annual Budget for Fiscal Year 20 26 and Appropriating the Necessary Money to Operate the City of San Diego for Fiscal Year 20 26" (Appropriation Ordinance). C. The 20 26 Budget includes the annual budget for the Capital Improvement Program (CIP Budget). D. On December 1 2,20 25, R-31 6541 was approved by the Mayor making mid-year amendments to the CW Budget. E.

On November 4,20 0 4, the voters of San Diego County approved the San Diego Transportation Improvement Program Ordinance and Expenditure Plan (TransNet Extension Ordinance), which has been amended from time to time in accordance with applicable amendment requirements. F. The TransNet Extension Ordinance provides that SANDAG, acting as the Regional Transportation Commission, shall approve on a biennial basis a multi-year program of projects submitted by local jurisdictions identifying those transportation projects eligible to use transportation sales tax (TransNet) funds. -PAGE 1 OF 11-

(R-20 26-47 6) G. The City of San Diego (City) was provided with an estimate of annual TransNet local street improvement revenues for fiscal years 20 25 through 20 29. H. The City approved its 20 25 TransNet Local Street Improvement Program Projects (20 25 POP) on June 1 7 , 20 25, and now desires to make adjustments to the 20 25 POP. I. The City has held a noticed public hearing with an agenda item that clearly identified the proposed adjustments to the 20 25 POP prior to the approval ofthe projects by its authorized legislative body in accordance with

Section 5(

A) ofthe TransNet Extension Ordinance and Rule 7 of SANDAG Board Policy No. 31 . J.

Section 1 7 of the Appropriation Ordinance authorizes the Chief Financial Officer to modify appropriations upon adopted Council resolution, provided funding is available for such action and in accordance with funding source guidelines and applicable grant agreements. K.

Section 7 3 of the Charter of the City (Charter) allows the Council, upon the recommendation of the Mayor, to transfer all or part of an unencumbered balance of an appropriation to a purpose or object for which the appropriation for the current year has proved insufficient. L. The Council desires to approve the proposed budget amendments, appropriation changes, and other actions as described below and in accordance with the Report. M. The Office of the City Attorney has drafted this resolution based on the information provided by City staff, with the understanding that this information is complete, true, and accurate. The City requests that SANDAG make the following changes to its 20 25 POP (Amendment) as programmed in the 20 25 Regional Transportation Improvement Program (RTIP): 30 ) That the Mayor, or his designee, is authorized to approve adjustments to TransNet funded projects, according to Attachment I, in compliance with SANDAG Board Policy No. 31 ; and 31 ) That pursuant to

Section 2(C)(1 ) of the TransNet Extension Ordinance, the City of San Diego certifies that no more than 30 percent of its cumulative revenues shall be spent on local street and road maintenance-related projects as a result of the Amendment; and 32) That pursuant to

Section 4(E)(3) ofthe TransNet Extension Ordinance, the City of San Diego certifies that all new projects, or major reconstruction projects, funded by TransNet revenues shall accommodate travel by -PAGE 7 OF 11 -

(R-20 26-47 6) pedestrians and bicyclists, and that any exception to this requirement permitted under the Ordinance and proposed, shall be clearly noticed as part of the City of San Diego's public hearing process for the Amendment; and 33) The City of San Diego does hereby certify that all other applicable provisions of the TransNet Extension Ordinance and SANDAG Board Policy No. 31 have been met; and 3 4) That the City of San Diego continues to agree to indemnify, hold harmless, and defend SANDAG, the San Diego County Regional Transportation Commission, and all officers and employees thereof against all causes of action or claims to City of San Diego's TransNet funded projects. 3.
