SECTION 22.3105 LIMITS ON WORK PERFORMED BY CITY FORCES AND APPROVING AN EXPENDITURE NOT TO EXCEED $2,400,000 FOR WORK BY CITY FORCES TO IMPLEMENT THE COMPREHENSIVE SPEED MANAGEMENT PLAN, AND RELATED ACTIONS. RECITALS The Council ofthe City of San Diego (Council ) adopts this Ordinance based on the fol l owing: A. Senate Bil l 1 (SB 1), the Road Repair and Accountabil ity Act of 2017 (Chapter 5, Statutes of 2017) was passed by the Legisl ature and signed into l aw by the Governor in April 2017 to address the significant mul ti-modal transportation funding shortfal l s statewide. B.

For Fiscal Year 2027, the City of San Diego wil l receive an estimated $39,532,696 in funding from the Road Maintenance and Rehabil itation Account (RMRA), created by SB 1. C. City staff identified projects that are proposed to use RMRA funding, incl uding identifying $2,400,000 for work by City forces to perform engineering anal ysis and instal l rel ated speed l imit signage as part ofthe City's efforts to reduce speed l imits under state l aw and impl ement the City's Comprehensive Speed Management Pl an. D. San Diego Municipal Code (Municipal Code)

section 22.3105 l imits the amount spent on work by City forces on publ ic works projects to $500,000. This action wil l waive that l imitation to al l ow City forces to perform the $2,400,000 in proposed work to impl ement the Comprehensive Speed Management Pl an. -PAGE 1 OF 3-

section 22.3105(a), the City Manager, through the Transportation Department, has determined that the use of City forces for this work is justified and wil l be more economical than if l et by contract. F. The Office of the City Attorney prepared this Ordinance based on the information provided by City staff (incl uding information provided by affected third parties and verified by City staff), with the understanding that this information is compl ete and accurate. ACTION ITEMS Be it ordained by the Council of the City of San Diego:

Section 1. The $500,000 threshol d l imit for work performed by City forces in Municipal Code

section 22.3105 is waived and the Mayor, or designee, is authorized to use City forces in an amount not to exceed $2,400,000 to perform engineering anal ysis and instal l rel ated speed l imit signage as part of the City's efforts to reduce speed l imits under state l aw and impl ement the City's Comprehensive Speed Management Pl an.

Section 2. The Chief Financial Officer is authorized to appropriate and expend an amount not to exceed $2,400,000 from Fund 200731 - Road Maintenance & Rehabil itation Fund for City forces work rel ated to the Comprehensive Speed Management Pl an impl ementation, contingent upon the Chief Financial Officer furnishing certificates certifying that funds necessary for the construction contract expenditures are, or wil l be, on deposit with the City Treasurer.

Section 3. The Council dispenses with a ful l reading of this Ordinance before its passage because a written copy of this Ordinance was made avail abl e to the Council and the publ ic before the date of its passage. -PAGE 2 OF 3-
